AN ORDINANCE authorizing the purchase of a 30 acre parcel from the utility
fund through condemnation for the purpose of expanding the City's biosolids
application area.
WHEREAS, the City operates a biosolids application area for forest enhancement
and disposal of biosolids from its wastewater treatment facility; and
WHEREAS, it is necessary to acquire additional land adjacent to the City's
permitted application area to allow flexibility of application and extend the life of the
application site; now, therefore,
THE CITY OF BREMERTON DOES HEREBY ORDAIN:
Section 1. Necessity for Condemnation. The City finds that it is necessary to acquire
that property adjacent to the City's Biosolids Application Site 2 north of S.R.3 to protect
and improve the application program and extend the life of the facility.
Section 2. Condemnation. The City shall proceed to condemn the 30 acre parcel set
forth and legally described as:
That portion of the North 1/2 of the Northwest 1/4 lying north of S.R. 3,
Section 6, Township 23 North, Range 1 East, W.M.
The Mayor is authorized to execute purchase agreements in lieu of condemnation for any
of the parcels listed in Exhibit "A".
Section 3. Funding. The City shall pay the cost of the condemnation from the
Water Fund.
Section 4. Effective Date. This ordinance shall take effect ten (10) days from
passage and publication.
