Annexation of Seiepko/Lunde
AN ORDINANCE, annexing an area known as the Sciepko/Lunde Area, amending Ordinance
~t4506 and fixing the effective date of annexation.
WHEREAS, the City of Bremerton filed a Notice of Intention to annex certain property
described as the Sciepko/Lunde property with the Kitsap County Boundary Review Board
(hereafter Board); and
WHEREAS, a public hearing was held before the Board on April 20, 1995 at the request
of the Kitsap County Commissioners; and
WHEREAS, in findings released on May 23, 1995, the Board approved the annexation
with a modification, with authority granted through R.C.W. 36.93.150, to include five parcels
lying north of the original proposed site and south of Highway 16; and
WHEREAS, the Bremerton City Council did conduct a public heating on July 5, 1995,
following property posting and publication of the hearing as required by law, to accept public
comments on the modified annexation petition for the Sciepko/Lunde annexation; and
WHEREAS, additional signatures have been collected for the annexation petition,
attached as Exhibit "B"those signatures, together with the original petition, to constitute at
seventy-five percent (75%) petition of the modified area; and
WHEREAS, the Bremerton City Council did accept the modified annexation site.
NOW THEREFORE:
Section 1. The territory is described and further depicted in Exhibit "A: and is
attached hereto and incorporated by reference herein shall be and constitute a part of the
City of Bremerton.

Section 2. In conformance with the terms of the Annexation Petition all property within the
territory annexed hereby shall be subject to all the City's laws and ordinances including the
assessment or taxes in payment of any bonds issued or debts contracted prior to or existing at the
date of annexation.
Section 3. This ordinance shall take effect ten days following passage and publication. The
City Clerk shall certify this annexation ordinance with Kitsap County Commissioners Board,
following final approval by Kitsap County Boundary Review Board. If disapproved this
Ordinance shall become null and void.

OF THE CITY OF BREPLERTON, WASHINGTON
The city Council of Bremerton, Washington is hereby petitioned by
the undersigned, representing ownership of not less than 75 percent
in value of the real property herein described and lying contiguous
to the city of Bremerton, Washington, to annex such territory and
make it part of the City of Bremerton under the provisions of
Chapter 35.13 R.W..
The territory proposed to be annexed is within Kitsap County,
Washington, and described on Exhibit "A" attached hereto, and
further depicted on Exhibit "B" also attached hereto.
The city Council of the City of Bremerton met with the initiating
parties at a City Council meeting on February S, ~995 and did
determine that the City would accept the proposed annexation. At
said meeting the City Council did also determine that:
!) It would accept the annexation of the Sceipko/Lunde
Annexation;
2 WouLd require the assumption of a proportional share of the
city's current indebtedness as a condition of any future

3 Require the adoption of a Comprehensive Plan and upon
annexation.
as disclosed by that minute entry regarding the same in the minutes
of that City Council meeting of 2/8/95.
W~EREFORE, the undersigned petition the Honorable City Council and
ask:
(a) That appropriate action be taken to entertain this petition,
fixing a date for a public hearing, causing notice to be published
and posted, specifying the time and place of such hearing, and
inviting all persons interested to appear and voice approval or
disapproval of such annexation; and
(b) That following such hearing, the City Council determine by
ordinance that such annexation shall be made, annexing the above
described territory, and declaring the date whereon such annexation
shall be effective; and that property so annexed shall become a
part of the City of Bremerton, Washington, subject to its laws and
ordinances then and thereafter in force.
Any and all petitioners hereto agree that all property within the
territory hereby sought to be annexed shall be assessed and taxed
at the same rate and on the same basis as other property within the
City of Bremerton, including assessments or taxes in payment of any
bonds issued or debts contracted prior to or existing at the date
of annexation. Petitioners further agree that City zoning will be
applied to the area uDon annexation, in conformance with the City's
adopted Comprehensive Plan.

IRREVOCABLE LIMITED POWER OF ATTORNEY
THE UNDERSIGNED OWNER (hereinafter "Owner") of properties
outside the corporate boundaries of the City of Bremerton within
Kitsap County, Washington, (hereinafter "Property") described as:

in consideration of the purchase of property from the City of
Bremerton, as set forth in the Option to Purchase Unimproved
Property between the parties executed ~L~.¢_ , 1994,
and being domiciled and residing in the State of Washington,
designates the City of Bremerton as attorney in fact to act for the
undersigned for the following limited purposes:
1. Owner grants to the City of Bremerton the right to
include this Limited Power of Attorney as Owner's
consent to the annexation of the Property as part
of any Notice of Intent or Petition for Annexation
presented to the City of Bremerton pursuant to RCW
35.13. for the Property or any larger annexation
area that includes all or a portion of the
Property.

2. The annexation petition supported by the Power may
include proportional assumption of City
indebtedness by the area to be annexed. The
petition shall require the concurrent adoption of
land uses designated in an urban fringe zoning
approved for the annexation area pursuant to RCW
35.13.177 of Mixed General Business (GB) 15%, Mixed
Use (MX) 15% and General Industry (IG) 70%,
according to the Land Use Table of BMC 21.02.340,
or other zoning approved by Owner in writing prior
to submittal of the Petition.
This Limited Power of Attorney is irrevocable and the grant made
herein constitutes a covenant running with the land and shall be
binding upon the undersigned and successors in interest to the
Property. This Agreement shall be filed for record in the office
of the Kitsap County Auditor upon closing of the purchase of
property referenced above and sh~l have no effect until filed.
