HomeMy WebLinkAbout4459 AN ORDINANCE annexing approximately 58 acres known as the
West Hills Annexation Area I. which lies west of Cottman Avenue and
is bordered by the boundaries of the city on the north, west and
most of the southern side into the City of Bremerton and fixing the
effective date of annexation.
WHEREAS, the City of Bremerton, Washington received from
property owners residing in the West Hills Annexation area a Notice
of Intent to commence annexation proceedings; and
WHEREAS, the city Council approved the 10% petition for the
West Hills Annexation on December 7, 1993, and required the area to
assume a proportionate share of existing City indebtedness and the
simultaneous adoption of city landuse designations upon annexation;
and
WHEREAS, an environmental review was conducted in accordance
with the State Environmental Policy Act (SEPA) of the portion of
unincorporated County areas designated as the West Hills Annexation
Area, and a final Determination of Non-significance (DNS) was
issued on April 7, 1994; and
WHEREAS, there was filed with the City Council of the City of
Bremerton a Petition for Annexation, conforming to the City
Council's requirements as described above, in writing and signed by::~
the owners representing 75% of property value, according to the
assessed valuation for general taxation, of an annexation area
which is a portion of and included in the West Hills Annexation
Area and designated West Hill Annexation Area I.; and
WHEREAS, the Br~erton City Council conducted a public
hearing o~ April 27, 11994, following proper
posting
and
publication of the h~aring notice as required by law~ to accept
public comments on the annexation petition and accept said; now
therefore
THE CITY OF BREMERTON DOES ORDAIN ~
Section 1. The territory described and further depicted in
Exhibits "A" and "B" respectively and attached hereto and
incorporated by reference herein, shall be and constitute a part of
the City of Bremerton.
Section 2. In conformance with the terms of the Annexation
Petition, all property within the territory annexed hereby shall
be subject to all the City's laws and ordinances including
assessment or taxes in payment of any bonds issued or debts
contracted prior to or existing at the date of annexation.
Section 3. The official zoning map of the City of
Bremerton shall be amended to include those uses for the
territory annexed hereby described in the West Hills Area Plan,
adopted February T, 1990 and depicted on Exhibit C attached hereto
and incorporated herein.
Section 4. This ordinance shall take effect ten days
following passage and publication. The City Clerk shall certify
this annexation ordinance to the Kitsap County Commissioners
following final approval of the Kitsap County Boundary Review
Board. If the Annexation is not approved by the Kitsap County
Boundary Review Board, this Ordinance shall become null and void on
the date of said final decision.
