ORDINANCE # ~
AN ORDINANCE Vacating a 5 foot strip of right-of-way that is 200 feet
long and located along the north margin of Marine Drive, west of Dora Avenue.
WHEREAS, the City of Bremerton has been petitioned to vacate a portion of
undeveloped right-of-way; and
WHEREAS, notice has been posted and published according to law; and
WHEREAS, the City Council finds that the portion of the right-of-way set forth
herein is not needed for present or future use and should be vacated to allow the
abutting property owners to maintain the parcel, now therefore,
THE CITY OF BREMERTON DOES HEREBY ORDAIN:
Section 1. Vacation. The following right-of-way is hereby vacated to the
adjoining property owners.
A PORTION OF THE NORTHWEST QUARTER OF SECTION 15, TOWNSHIP
24 NORTH, RANGE 1 EAST, W.M., IN KITSAP COUNTY, WASHINGTON,
DESCRIBED AS FOLLOWS:
COMMENCING AT A POINT ON THE WEST MARGIN OF DORA AVENUE
WHICH IS NORTH 89°52'15'' WEST 900.00 FEET, AND SOUTH 00016'54'' WEST
557.23 FEET FROM THE NORTHEAST CORNER OF THE SOUTHEAST QUARTER
OF SAID NORTHWEST QUARTER. THENCE NORTH 89043'06'' WEST 21.23 FEET
TO THE EASTERLY MARGIN OF MARINE DRIVE AND THE POINT OF BEGINNING;
THENCE NORTH 47037'00'' EAST 5.00 FEET; THENCE NORTH 42023'00'' WEST
200.00 FEET; THENCE SOUTH 47°37'00'' WEST 5.00 FEET; THENCE SOUTH
42°23'00'' EAST 200.00 FEET TO THE POINT OF BEGINNING.
Section 2. Reservation of Easements. This vacation shall have no affect on
public utility easements or private easements which have been established within the
rights-of-way subject to this vacation ordinance. Easements are reserved for all public
utilities which have been established within the right-of-way subject to this vacation
ordinance.
Section 3. Effective date. This vacation shall become effective ten (10) days
from passage and publication.
