ORDINANCE # ~
AN ORDINANCE Vacating the 625 foot length by 7.5 foot wide of
undeveloped alley located east of Whitney Avenue between 15th Street
and 13th Street.
WHEREAS, the City of Bremerton initiated the vacation process of the 7.5 feet
wide portion of the undeveloped right-of-way; and
WHEREAS, notice has been posted and published according to law; and
WHEREAS, the City Council finds that the portion of the right-of-way set forth
herein is not needed for present or future use and should be vacated to allow the
abutting property owners to maintain the parcel, now therefore
THE CITY OF BREMERTON DOES HEREBY ORDAIN:
Section 1. Vacation. The following alley is hereby vacated to the adjoining
property owners.
The Alley dedicated in Volume 5 of deeds, Page 1, records of Kitsap County, Washington, lying
betweenl3th Street and 15th Street and abutting the east boundary of the Plat of Berry H. Hurt's
Addition to the City of Bremerton, recorded in Volume. 3, of plats Page 28, records of Kitsap
County, Washington, situate in the Northwest quarter of Section 14, Township 24 North, Range
1 East, W.M., Kitsap County, Washington.
Section 2. Reservation of Easements. This vacation shall have no affect
on public utility easements or private easements which have been established within the
rights-of-way subject to this vacation ordinance. Easements are reserved for all public
utilities which have been established within the right-of-way subject to this vacation
ordinance.
Section 3. Effective date. This vacation shall become effective ten (10) days
from passage and publication.
