5TH STREET AND 6TH STREET, WEST OF VENETA AVENUE AND THE
EASTERN MOST 16.25 FEET OF THE ADJOINING EAST/WEST ALLEY.
WHEREAS, Our Lady Star of The Sea Parish, owner of two-thirds
of the abutting property of the requested portion of right-of-way
has initiated proceedings for vacation of a portion of the alley
running north/south between 5th street and 6th street, west of
veneta avenue and the eastern most 16.25 Feet of the adjoining

WHEREAS, notice has been posted and published accorolng law
and a public hearing held on May 15, 199~; and
WHEREAS, the Council finds that the portion of the right-of-
way set forth herein is not needed for present or future traffic
circulation and should be vacated because Our Lady Star of The Sea
Parish is reconstructing and dedicating for public use a comparable
alley way located approximately 60 feet further west as described
in Section 2 below; now, therefore, FILED-BY: CITY OF 8RE~ERTON

Section 1. Vacation. The following right-of-way are hereby
vacated to the adjoining property owners:

Section 2. Conditions. This right-of-way vacation shall be
subject to the following conditions and deed restriction:
1. The applicant shall dedicated right-of-way for an alley
through 1 and 18, Block 1 and 5 feet of additional right
of way abutting the applicants property along Fifth
Street as more fully described and defined in Exhibit "A"
attached hereto.
2. Easements necessary for existing and future Utilities
shall be reserved.
Section 3. Effective Date. This vacation shall become
effective ten (10) days from passage and publication and
satisfaction of conditions of section 2.
