ORDINANCE to approve an interlocal agreement with the Tracyton Water
District regarding financing the design and construction of water system upgrades
with Tracyton Water District, and waive the provisions of BMC 15.02.040 as it
applies to that agreement.
WHEREAS, the City of Bremerton (CITY) and the Tracyton Water District
(DISTRICT), by agreement dated June 29, 1966 provide water services to customers
within the DISTRICT's water service area, and
WItEREAS, the CITY and the DISTRICT entered into an agreement dated
February 29, 2000 for the Design, Construction and Financing of Water System Upgrades
within Tracyton Water District in Anticipation of District Dissolution, and
WHEREAS, the CITY and the DISTRICT successfully secured a Public Works
Trust Fund loan for the design and a State Revolving Fund loan for the construction of
the project, and
WHEREAS, the CITY and the DISTRICT have negotiated the attached interlocal
agreement Regarding Financing the Design and Construction of Water System Upgrades
within Tracyton Water District, and
WHEREAS, the CITY will assume the DISTRICT's water service area upon the
DISTRICT's dissolution, and
WHEREAS, properties served by the District prior to dissolution of the District
will be considered customers of the CITY at the time of dissolution, and
WHEREAS, the provisions of BMC 15.02.040, SERVICE BEYOND CITY
LIMITS, should not apply to such existing service prior to dissolution; now therefore:
THE CITY OF BREMERTON DOES HEREBY ORDAIN:
SECTION 1. lnterlocal Agreement. The attached interlocal agreement Regarding
Financing the Design and Construction of Water System Upgrades within Tracyton
Water District is hereby approved and adopted.
SECTION 2. Application of BMC 15.02.040 to Existing Water Service. The
provisions of BMC 15.02.040, SERVICE BEYOND CITY LIMITS, shall not apply to
properties served by the District prior to dissolution of the DISTRICT.
SECTION 3. Application of BMC 15.02.040 to New Water Service. The provisions of
BMC 15.02.040, SERVICE BEYOND CITY LIMITS, shall apply to all properties within
the Tracyton Water District service area requesting utility service from the CITY after the
effective date of dissolution of the DISTRICT.
