AN ORDINANCE approving the Development Agreement of
Olympic Property Group, LLC for the West Hills Project pursuant
to RCW 36.70B170 and BMC Section 21.02.900
WHEREAS, the West Hills Preliminary Plat and Planned Unit Development (West Hills
Project) was approved by the City of Bremerton May 14, 1997, under Resolution No. 2599;
and
WHEREAS, the West Hills Project may take several years to market and develop; and
WHEREAS, the West Hills Project embodies a project which may take several years to
market and develop; and
WHEREAS, the time limits for completing the West Hills Project do not provide adequate
time for large projects like the West Hills Project to be planned and developed; and
WHEREAS, a Development Agreement (DA) can incorporate all of the provisions and
conditions of approval contained in Resolution No. 2599 and make it part of the DA; and
WHEREAS, the West Hills DA meets all of the applicable cdteria set forth in BMC Section
21.02.900(c); and
WHEREAS, the West Hills DA incorporates all of the conditions of approval, financial and
property improvement arrangements and the necessary mitigations for the project's
development including the State Environmental Policy Act (SEPA) mitigations found in
Resolution No. 2599; and
WHEREAS, the West Hills Development Agreement was reviewed in light of the
requirements of SEPA, and a Determination of Non-Significance (DNS) was duly issued; and
WHEREAS, the Bremerton Planning Commission held a public meeting on
Apdl 18, 2000, and after considering the staff report and the public comments received
recommended approval of the proposed West Hills Development Agreement; and
WHEREAS, the City Council has received the report of the Planning Commission and
additional public comments, the City Council finds the following:
1. The West Hills DA meets the intent and incorporates the provisions of Resolution No.
2599; and
2. The West Hills DA complies with all City plans, regulations, standards including the
requirements set forth in BMC Section 21.02.900(c); and

3. The West Hills DA provides for requirements presently needed to implement the project
(both on and off-site) and also procedures to implement additional requirements as the
need arises; now therefore
THE CITY OF BREMERTON DOES ORDAIN:
Section 1. The West Hills DA be approved and the Mayor is authorized to sign said
agreement on behalf of the City.
Section 2. Resolution No. 2599 is incorporated herein and all terms and conditions therein
are extended in conformance with the terms and conditions contained in the Development
Agreement.
Section 3. The effective date of this ordinance shall be ten (10) days from the date of
passage and publication.
