Clerk read Report of Separation for William Reynolds, Police Deps~tment. Motion by Mr. Gorst and Mrs. naddon to approve separation as read, carried. Taxicab stand application by Red Top Taxi at 4th & Pacific was presented by Clerk. Application had been referred to Chief of Police, and was returned disapproved. Motion by Mrs. Haddon and Mr. Gorst to sustain the Chief of Police's recommen- dation and disapprove the application, carried. Clerk presented copy of the report on the field activities of the Division of Sanitation for the month of August 1946, signed by Sam I. Reed, Chief Division of Sani- tation for Department of Public Health. It was suggested that contents be notedand the letter filed. Letter addressed to Mayor amd Commissioners, dated September 18, 1946, signed by Kitsap County Master Plumbers Association, was read by clerk, contained information that the critical shortage of 4" soil pipe has been temporarily alleviated. Therefore it will not be necessary for use of 3" vent stacks as applied for in recent letter, and should conditions change again, City will be advised and they will apply for fur- ther relief. Thanked Commissioners for consideration in the past. Letter signed by Harold H. Kemp. It was suggested that contents oi' letter be noted and letter be filed. Clerk read letter dated September 23, 1946, addressed to City Clerk, re adver- tisement in Bremerton Sun for concrete mixer. Writer had the following equipment for sale - i ?S Rex Mixer, with four steel wheels, weight about 2 ton, for sale at $100.00 f.o.b. Lynden, Washington. Mixer needs ~ome repairs. - i 6" Centrifugal water pump with foot valve, $50.00 - i l~"r automatic electric siphon pump, $40.00 - i surveyor's level with tripod, $100 - 2 concrete carts with steel wheels $20.00 each. Signed John W. Zevenbergen, 944 Pleasant Avenue. Mrs. haddon suggested that the letter be answered and Mr. Zevenberg~n be no- tified that the City already has similar equipment. Letter dated September 20, 1~46, addressed to Mayor, Chief of Police and Councilmen of the City of Bremerton, was read by Clerk, regarding business at Jack's Popcorn Stand at 6th and Pacific which has shown a rapid decline in recent weeks. The owner would like to sell popcorn at the 5 gates of the Navy Yard between the hours of 4:00 and 5:00 p.m. Would like to build 5 small portable stands about 2'xZ'x~' and at about 3:45 each weekday would like to take one of these stands to each gate along with fresh boxed popcorn, and then pick them up at 5:00 p.m. Asked permission to go ahead with the plan. Signed Ernie Stephens. City Attorney remarked that Mr. Stephens had been in to his office to talk a- bout this proposed plan at which time the City Attorney had informed him that such a plan was not in accordance with several ordinances of the City and that it could not be allowed. Motion by Mr. Gorst and Mrs. Haddon that the request be denied, carried. Clerk reported that Ellen Roberts and Mr. McCormick, owners of the Business Center Cafe, 522 Burwell, are interested in opening their b~nquet room for private parties, which parties would last until midnight, but that the public restaurant part closes at nine. They would like to serve parties their dinner and figured the parties would probably dance, as there is a piano in the banquet room, and wondered ii' there would be any objection on the part of the Council. It was agreed that there woulm be no objections if the parties in the banquet room were handled in a quiet and orderly manner, and that the Clerk should contact Mr. McCormick and Ellen Roberts. Clerk read copy of letter to J.W.Bryan, City Attorney, dated September 20, 1946, from State Examiner who reported that in auditing L.I.D. records discovery was made that at the time the State Highway Department condemned the Bremerton Bridge Co- mpany's properties, the City Treasurer of the City of Bremerton as trustee for the L.I.D.s, was not made a defendant to the suit and no mention is founm in the file on this case relative to the lien of these L.I.D. assessments, and Examiner has been un- able to find anything of record that extinguishes these liens. Two districts have been worked on in which there are outstanding assessments totaling more than $1000 and there are 4 other districts that affect this property although there may not be any unpaid and outstanding assessments on them. Enclosed with the letter superior court file on this condemnation for which examiner has signed at the court house, and requests the files return after it has been examined, also map showing property affected. Will be some segregation of the assessments as the City has accepted deed from the bridge com- pany for strip along the street that was used for widening the street, and the street fund will be obligated to pay a portion of the total assessment on Lots 8, 9 and l0 and the easterly 20 feet of Lot 7, Block 2, Bender's Addition to Decatur. Question on which State Examiner would like ruling is: Since neither the City of Bremerton as trustee for the local improvement districts, nor the City Treasurer as trustee for the 557 same, were made parties to the condemnation suit, are the assessment liens arising from local improvement districts that affected the above mentioned property, still alive and intact? Signed Ralph Davisson, State Examiner. Some discussion ensued on the matter, and City Attorney remarked that Mr. Davisson had mentioned the matter to him, and Attorney had suggested that State Examiner write a letter to him and request ruling, and that the Attorney's office was working on the matter. Motion by Mr. Gorst and Mrs. Haddon to refer the matter to the City Attorney and City Treasurer, carried. Letter was read by Clerk, dated September 18, 1~48, addressed to City Commissioner: from Mrs. H.R.Stone, whose address is 1911 loth Street, stated there is a piece of pro- perty adjoining theirs, extending in a triangle to 10th and Hewitt which they would like to acquire. Property is overgrown with weeds and collects the neighborhood trash, and at one time the accumulated trash was set on fire by children and endangered their house. They are planning on leveling off their lot and building a picket fence around it, and w o uld like to acquire this bit o~ land and build the fence all around it. Would use the land to good advantage for a garden. They are putting money and work in fixing up their place and do not like to have a neglected lot next door. Asked for advise as to the proper procedure in acquiring the property. Motion by Mr. Gorst and Mrs. Haddon to refer the matter to the Commissioner of Public Works and Utilities, City Engineer and City Treasurer, carried. Clerk reported that he had expected the Engineer who was making a survey of pro- perty at View Ridge for the proposed airport and golf course would be present, but in- asmuch as he was not present, Clerk reported that it would be necessary to acquire more Property to make a Class "2" Airport, and if more property could be acquired there, a beautiful golf course and airport could be built, and that the necessary land in that vicinity should not be expensive. Clerk suggested that a motion be made to rescind Resolution No. 538, establishing the population of City of Bremerton, which had an added resolution on the bottom to be passed by County Commissioners. Suggestion was made as the County Commissioners had already adopted a resolution establishing the population in excess of ~5,000. Motion by Mr. Gorst and Mrs. Haddon to rescind Resolution No. 5~8, carried as follows: Mrs. Haddon, yes; Mr. Goret, yes. Ordinance No. 1695, was read by Clerk, second reading, entitled as follows: AN ORDINANCE amending Ordinance No. 1Z3?, entitled: "An ordinance, relating to regular city employees of the City of Bremerton, who may become engaged in the mili- tary or naval services of the United States during the present national emergency or in time of war, and providing for the reinstatement of such persons as city employees after their release in good standing from the military and naval services of the United States," by adding Section 5 thereto, providing for the contribution by employees tak- ing authorized leave of absence and military leave to any established pension or re- tirement funds, and providing for the payment thereto. Attorney replied in answer to question that the ordinance made it mandatory to pay back the pension f~md for the amount that would have been deducted, in case anyone was absent on leave without pay. This amendment to original ordinance was prepared at the request of the Firemen's Pension Board. Discussion ensued, and it was stated that many of the veterans who were returning from militavy service did not feel that they should pay into the retirement fund for time they were gone. Motion by Mr. Gorst and Mrs. Haddon to continue the second reading of Ordinance 1595 to next Wednesday, and refer the proposed ordinance to the Firemen, Policemen, and Employees Pension Boards, carried. City Attorney read letter which he had written as instructed by City Council to the Housing Authority of the City of Bremerton, advising the Housing Authority that the City is desirous of purchasing, at a price to be negotiated and agreed upon, thetadmin-~ istrative building of the project known as the "Duration Dormitories" lying north of the Civic Recreation Center. Letter from Housing Authority date~ September l?, 1946, in reply was read, which acknowledged receipt of Attorney's letter of September 13, 1946 and advised that the Housing Authority of the City of Bremerton is initiating action to have this building declared surplus. Negotiations for its purchase must follow with representatives of the Federal Public Housing. From present information, the above process will take about two months before actual purchase by the City can be completed. Duration Dormitory Project is almost vacated and until all tenants have vacated it will be necessary that the Housing Authority retain use of management and shop sections of the building. However, the activity section is now vacant and may be used immediately by the City, upon assuming routine maintenance and utility costs and so advising the Housing Authority. Motion by Mrs. haddon and Mr. Gorst to refer the matter to the Mayor, carried. Resolution No. 538 was read by Attorney as follows: WHEREAS, the City Engineer has recommended that C.M. Phifer, 109 Shore Drive, Brem- erton, Washington, remove an overhead foot bridge over part of Lower Shore Drive in Bremerton, Washington, and that a temporary easement be granted said Phifer to use two feet of Lower Shore Drive along the Northeasterly end of his house at the above address for a stairway, upon the removal of said overhead foot bridge, now therefore, 558 BE IT RESOLVED by the City Council of the City of Bremerton, that C.M.Phifer be, and he is hereby requested to remove the overhead passageway above referred to; be it further RESOLVED, that in the event the said C.M.Phifer removes said passageway, he shall be, and is hereby granted a temporary easement, to be terminated whenever it shall be determined by the City Council of the City of Bremerton that the full width of Lower Shore Drive is necessary for use as a street or for the public convenience, over and across two feet of Lower Shore Drive along the Northeasterly end of the house of said C.M.Phifer for the purpose of installing a stairway. Further planning on program is dependent upon receipt of this information. ~sked that the writer would be advised of the opinion of the officials of Bremerton in this matter. Signed C.F.Christian, City Clerk. Mayor commented that perhaps the evening session would be more agreeable for of- ficials in Cities where their duties were only part time, but thought that Bremerton should announce preference for the afternoon meeting, around 2 o'clock, council a- greed with the Mayor's suggestion, and Mayor remarked that he would write to Christian and pass that information on to him. Letter dated September 25, 1946, addressed to ~ayor and City Council was read by Clerk, regarding unofficial offer to the Water Department of trade-in allowance of $90.00 for the old Monroe Calculator now being used in their accounting department on a new Marchant Calculator. Offer is approximately one-third the cost of the Monroe machine when it was new, and it is now about 20 or 25 years old, so it would be advis- able to turn it in while such a price is available. New Marchant will cost around $~f50.OO for 10-bank machine and delivery can be expected soon after the first of the year. Water Department has funds in 1946 budget for the purchase and in case contract was awarded the appropriation can be carried for ward to 1947. Therefore, recommended that the City Clerk be instructed to call for bids; Signed C.C.Casad, Water Superin- tendent. Treasurer remarked they would like to secure the old electric Monroe and trade in the hand operated machine that was now being used in the Treasurer's Office. Ate torney suggested that the Treasurer could pay $90.00 out of his budget and make the transfer for that amount, less the value of the hand machine, which could then be traded in. Motion by Mr. Got'st and Mr. Kean that the City Clerk be instructed to call for bids for calculator, for the Water Department, with trade-in of the hand operated machine, carried. Clerk read copy of letter addressed to Board of Library Trustees of the City of Bremerton, dated September 26, 1946, signed by Frederick B. Cohen, re Board of Librar Trustees of Kitsap County, Washington, Rural Library District, which is exercising Option given by Paragraph 9 of Agreement dated January l, 1945, providing for library service throughout Kitsap County to terminate agreement at the end of the present fiscal year, December 31, 1946. Mr. Cohen is legal advisor for both the Board of 560 Library Trustees of Kitsap County, Washington, Rural Library District and Board of County Commissioners of Kitsap County and has been directed by them to terminate said contract. Further advised this action is being taken upon initiative of county boards and not at the suggestion of the Chairman of Bremerton Public Library Board of Trus- tees, contained in his letter dated August 12, 1946, addressed to John C. Lindberg, Chairman of the County Library Board. Do not agree to payment of any expenses incident to the termination of the contract other than that which is required by the agreement i t~elf. Vaa, City Auditor, dated September 26, 1946, ad- dressed to R.S. Hayward Company, was read by Clerk, re request in letter of July 3 for "Statement of Adjusted Premiums" on CLP-128V0 to'be checked. Auditor found statement correct except for payroll figures under Manufacturers or Contractors and itemized differences and according to Auditor's records the additional premium due at this time is $481.B1 instead of $1146.07 as shown on ~nsurance company's statement. Of- feted to go over figures prior to payment of the additional premium if desired. Clerk commented that several checks had already been received on returned premium~ and that money was being saved by close checking. Over-charges were usually due to the 6ity giving out wrong figures. Notion by ~r. aean and ~r. Gorst to note contents and file, carried. Attorney ~ead Resolution No. $40, as follows: BE IT RESOLVED by the City Council of the City of Bremerton, that James W. City Attorney reported that attorneys for Klinefelter Pinball Suit have suggested dismissal of the suit in the Supreme Court, and that all parties handle their own court costs. Attorney remarked his office would be glad to see the end of the litiga- tion. Some discussion occurred on this matter, and City Attorney stated the attornies had agreed to the dismissal if all parties bear their own court costs. Notion by ~r. Kean and ~r. Gorst to instruct City Attorney to sign the necessary papers to have the suit dismissed, with all parties bearing their own court costs, carried. Nayor reported that he had been asked to appoint two members for the draft board, and that the office was to be moved to Bremerton from Fort Orchard, but that he did not feel such an sppointment should be made by him, as the Draft Board is not a part of the City Government. Pollack Brothers had requested permission to put on ~heir circus here on Septembe~ 29, ~0 and October l, 1~6. Notion by ~r. Kean and ~irs. Haddon to allow the circus to be held on above dates, carried as follows: ~r. Kean, yes; ~rs. Haddon, yes; ~r. Gorst, yes. Clerk read recommendation on the purchase of Concrete Ntxer, from Water Superin- tendent, and commissioner of Public Works and Utilities and City Clerk and Purchasing Agent, concurred in recommendation, that the bid be awarde~ t~ A.~.Co~_fgr a 8S mixer at $13~5.00. Letter stated that arrangements have been mame xor ~mmem~a~e delivery from Seattle instead of having to wait 45 days as stated in the proposal. Mr. Gorst c~mmented that Nr. Casad was over and had seen the miser that the con- crete mixer the city was to receive had originally been intended for another customer, but that the other buyer had been willing to wait as they did not require immediate delivery, and so the city could get the mixer immediately. Motion by ~r. Gorst and ~r. Kean that the bid of A. H. Cox for 6S Concrete ~txer be accepteS, carried. Les ~alters and Mr. Davis were in the audience, representing the Navy Yard Emp- loyees, and they have set up a system in the Yard to take care of all utility bills, they had discussed the matter with the City Treasurer and he had suggested that they appear before the City Council. Treasurer reported that Mr. Davis had been in to see him, an~ they had consulted Mr. Bartlett, State Examiner for the Water Department, who had said it would be all right, but that no official receipt could be given unless a Deputy Treasurer, who war bonded, took the money, and that the City could not afford to hire another Deputy Treasurer Just to take payments in the yard. It was suggested that Mr. Davis be bonded and made Deputy Treasurer, without pay, but that solution was not considered satisfactory. Mayor commented that if some plan could be worked out it would sin~lify things for yard employees as they could pay all bills fcr utilities in one place right in the yard, but that the State Examiner should be consulted, and if he approved it could be set up by a resolution, and possibl~ those involved could meet today, and the matter could be acted on at next Wednesday's meeting. Motion by ~r. Kean and Mrs. Had~on to refer the matter to Commissioner of Finance City Treasurer and Mr. Walters and Mr. Davis to finm out the proper procedure after consulting with the State Examiner, carried.
