Kean and Mr. Corst to concur in the recommendation and the matter be referred to 0ity Clerk for Compliance, carried. Clerk read letter addresse~ to Mayor and Commissioners, dated September 3,1946, signed by John C. ~erkel, reporting a careful review of Article XIII of City Charter on Initiative ~nd Heferendum, and particularly sections of 48, 50 and 52, in connection with proposed repeal oi' initiative ordinance setting salaries for policemen~ The charter provisions are somewhat inconsistent, but in order to give effect to all sec- tions on initiative an4 referendum, and it is attorney's office opinion that ordinance repealing or amending andlnitiative ordinance must be submitted to qualified electors for their approval or rejection. Ordinance, to be submitted, may originate either in City Council, or by initiative petition. If it originate~ in City Council should be prepared for the purpose of submitting it at the next general election. If ordinance originates by initiative, it must contain signatures of qualified electors equal to 25% of the number of votes cas~ for Mayor at last election. Must then be checked by City Clerk and referred to City Council, ii' it contains enough signatures, and if Council approves ordinance initiated, it may be approved and ordered placed on the ballot. Discussion ensued on procedure, as Police Department wishes to go under control of City Commissioners. Mayor remarked that the Police were willing tb,ci~¢~ate ~ties tion as Firemen had done, if that was the best way of hand~ing the matter. It was decided to have an ordinance prepared amending initiative and put it up to a vote by the people. Motion by ~r. The cost of moving the building will be more than originally planned and that is the reason for the raise in price, and Mr. Gorst wanted authorization to negotiate with the owner. It was ~greed that Mr. Gorst should continue negotiations ~or the pur- chase of the property. City Attorney read Resolution No. 533 as follows: WHEREAS, the City of Bremerton acquired title to the Northeast quarter of ~rsct 5, Block 4, Warren Smith,s Acre Tracts, by deed from Kitsap County at tax foreclosure sale, and WHEREAS, said property was thereafter sold to George G. Mayor commented there would be a Budget Meeting at l:O0 p.m. It was also remarked by the Mayor that a meeting would be held at 2:00 p.m. re- garding the waterfront near Evergreen Park. Discussion ensued on the matter, as to whether or not it would be ~ adv~tage to rezone the vicinity as a commercial zone, or leave it as residential zone, as there is a shortage on parks in Bremerton. Mayor enquired as to whether the Commissioners f~lt that there should again be residential qualifications for city employees. Mawr felt that employees should be no- tified of the possibili~ of this qualification being reinstated, as city residents would probably insist on it, and employees should be notified not to buy p~perty out- side the city limits, No action was t~en at this time. Mayor reported on the waterfront situation, that Mr. Anderson of the Black Ball Lines was to meet with Captain Peabody, who has returned from his vacation, and they woul~ discuss w~re the slips should be located, etc., and then the Commissioners could see what sort of deal could be worked out before spending so much money on repairs ~ the dock. This was the date set for t~e opening of bids on the property at Tracyton, but no bids were received. There had been few inquiries on this sale, and readvertising of ~e property was considered, but no action was taken. Assistant City Attorney remarked on the condition of streets in Bremerton early Sunday mornings, and commented that this gave a bad impression of the Ci~ to people who were passing through on trips to the canal. Mayor remarked if streets were clewed late Saturday or early Sunday that this would be over-time work as according to the Union rules all Saturday and Sunday work was on an overtime basis. Some ~iscusston took place on regular ferry service between Seabeck and Brennan as this would be an advantage to Bremerton. There is to be a bus servi~e from Port Townsend, but this will probably by-pass Bremerton and take loads directly into Shelto Mayor'~commented he would like to see something done to make Bremerton the "hub" for the entire penninsula, but that this was something should be handled by the Chamber of Commerce. Motion by Mr. Kean and Mr. Gorst to recess until Friday, September 6, at lO:O0 a.m., carried. ' Mayor SEPTEMBER 6, ].946 Recessed meeting of the City Council of the City oI~ Bremerton was held in the ~ayor,s Office, City Hall, at 10:00 a.m., Friday morning, September 6, 1946. Mayor Kean presiding, Commissioner Haddon, Commissioner Gorst and City Treasurer being prese~ Clerk reported on maintenance agreement with National Cash Register Company, which is to be raised in price to~59.35 or $61.13 including tax, for servicing the National Cash i~egister in the ~reasurer~s Office, and reported that the machine is not used much and could be done without altogether. Treasurer commented the machine was purchased in 1929 for about ~2500, and at that time was ~sed on everything, but since then water and garbage receipts bad increased to five numbers and so the machine was only used for general receipts and L.I.D.'s. Originally it had been used for something to be checked against, but now they have to ma~e a double check. It was suggested that the machine could be used to an advantage in the Traffic Violation cases. Clerk recom- 545 mended that arrangements be made to sell the machine to the Police Department where it would be used, and there was no use having a machine kept in repair when it was not used, and recommended when the service man came over again that an agreement be made with the Police Department. Matter was referred to City Clerk, City treasurer and City Auditor for recommendation. Inquiry was made by Clerk in regard to Gas Company collection, which should have been paid in February. One payment of $1,000.00 had been made, leaving a balance due of $1,941.96. Also they were supposed to have a $50,000.00 policy to protect the city, but none could be found, the last one the City has a record of was for the year 19&2, and that the franchise for the gas company requires such a policy. Motion by Mr. Kean and Mr. Gorst to refer We matter of the unpaid balance due the city from the gas company, also the matter of tbs insurance policy be referred to the City Attorney, City Treasurer and City Clerk, carried. Clerk read applications for location to install pinball machines from Nelson Thrifty Drug, oheridan Park; Lippert Drug, 401 Park; and Bremerton Drug, 403 Pacific, which had been approved by Chief of Police. Motion by Mr. Kean and Mr. horst to approve the applications, carried. DiscuSsion took place in regard to various obsolete ann ~mused equipment owned by the City, and the feasibility bi' disposing of it to the best advantage. Motion by Mr. Kean and Mr. Gorst that the City Clerk ~d Purchasing Agent be authorized to dispose of obsolete concrete mixer and roller, old truck owned by Sani- tation Department, and request Department heads to give him a list of obsolete e$~ip- merit, to be disposed of to the best interests of the City, carried. Clerk reported that when contract was awarded for the repair of heating and plumbing at City Hall, the burner ordered was too big, and now asked permission to change to next smaller size, as if the big one was used it would be fouled up all the time, and would have to be cleaned at least once a week. While repair man was study- ing the installation he found the firebox was smaller than thought, and the burner specified will floom and cause carbon to gather, and he would rather put in the next smaller burner, which will use less oil and be more effective, and the smaller burner would be about ~f0.00 cheaper. Motion by Mr. ~esn and ~r. Gorst to approve the recommendation of the City Clerk on change order on repair of heating and plumbing repair contract, carried. Various problems confronting the City were discussed'at some length by the council, such as an airport and golf course being constructed next to one another, purchasing some of the buildings offered for sale by the government, the waterfront problem, etc. Notion by Mr. Kean anm ~rs.
