Department, John V. O'Connor and Hazel Reems, effective at close of work July l, 1946.
It has come to the attention of Mr. Davisson that vacation slips for ten days each
have been sent to Clerk's OI'fice for inclusion in current payroll. Vacation allow-
ances for employees dismissed from the service or who are no longer in the employ of
the city is unlawful and contrary to a deciaion of the supreme court of the State of
Washington. Mr. Davisson cited case. State Examiner requested that City Clerk re-
frain from making vacation allowances to the two persons named above, and in the
future on similar requests to please follow rule laid down in case. Suggestion was
made by Mayor that contents of the letter be noted and the letter riled.

Street to llth Street; Eleventh Street from Olympic Avenue to Rainier Avenue; Vandalia
Avenue from E. llth to E. 1Zth; and from E. 13th to E. 16th, as above petitions have
not been signed by.~ecessary majority of property owners. City Engineer recommended
that petitions be r~ferred back to the property owners rot more signatures. Discus-
sion ensued, and Mr. Gorst commented that so many people were buying on contract, and
property had changed hands, but that people buying on contract were signing the peti-
tions. According to L.I.D. laws the petition must be signed by property owners them-
selves as record owner, and ~hat in these certain petitions only ~0 to 25% were the
actual property owners.
Motion by Mr. Gorst and Mr. Kean that the City Engineer be instructed to return
the petitions for further signatures and give necessary information to people signing
the petitions.
City Treasurer suggested it would be a good idea to have the newspaper carry
the information.

Per~y Avenue from lath to 16th by putting in curbing, gutters and sidewalks, signed
by 12 property owners, first signature Harry Tincall.

tabulation and report, carried.
Discussion ensued on some plan by which a number oI' petitions could be carried
under one L.I.D. so that the overhead cost would not be so high.

AN ORDINANCE declaring an emergency to exist on account of the necessity to
repair the boiler at ~'ire Station No. 3, appropriating funds to meet such emergency,
and declaring an emergency.
Motion by Nr. Kean and Nr. Gorst to pass 0rdin~nce No. 1~88 on second reading,
carried as follows: ~r. Kean, yes; Nfs. Haddon, yes; Nr. Gor~t, yes.
Clerk commented that ~hen the boiler was inspected and torn do~n it was dis-
covered that it could not be repaired. ~ayor remarked that a little smaller boiler,
but a better type, could be purchased for about the s~me amount that the old one could
be repaired for, and that he thought the City ~ngineer woul~ recommend the change
order as soon as he got the necessary approval from the proper governmental authority.

ing that Ordinance No. 168~ provided for the acquisition of the Sewer System, but did
not appropriate funds for expenses in connection ~ith such acquisition and for opera-
tion, and that it was evidently the intention to pass emergency ordinance appro~
such funds, but that it had never been done. Itemized list of appropriation required

referred to Division of Municipal Corporations to ~e~f~r to Attorney General, as to how
he feels on the outcome of this case, and ii' this is satisfactory to settle the case
for $1,000.O0. City Attorney remarked that Attorney's office recommende~ as above in
view of the remarks of Judge Sutton at time oi' hearing, and from Supreme Court Decision
and in view of the fact that Attorney General has not given an opinion since the last
two cases of Supreme Court. City Attorney also remarked that Mr. Amende had been con-
sulted and he was willing to wait for the opinion of the Attorney General. City Trea-
surer enquired as to what bearing a settlement of this sort would have on similar

Letter dated July 18, 1948, signed by City Engineer, re: Change Order No. l,
Fire Station No. 5, Bremerton, Washington, was read by Clerk. City Engineer stated
that contract had been executed to Lents,'Inc. for repair of cast iron boiler for $1Z50
and that now it had been ascertained that the existing boiler is not worth repairing,
and that a cast iron boiler cannot be procured for several months. The bid submitted

Clerk remarked a resolution would be necessary on this Change Order transfer-
ring from Capital Outlay, Oil Ourners, Stations 2 & 5 to supplement emergency appropri-
ation under Ordinance No. 1888, and was instructed to turn the matter over to City
Attorney for preparation of resolution, with necessary information.
Mayor again commented about The employment of new employees at a higher rate
of pay than persons already employed, and felt that positions paying higher salaries
should be open to competitive examinations amonEdthose already employed.
Clerk read letter dated July 18, 1~46, addressed to Mayor and signed by E.E.
Riddell, Secretary of Kitsap County Good Roads Association, reporting on meeting of
the association at which a resolution was passed requesting that the City and State
Highway Department do something to eliminate the "S" curve at the entrance to Roose-
velt Hospital. Stated that the ~atter has been under consideration for some time, and
nothing has been accomplished. Organization also passed resolution endorsing the
building of new bridge at Manette to be located where State Highway Department recom-
mended. It was brought to their attention by the Highway Department that one thing
holding up Federal Government's participation was lack of united approval or all con-
cerned in location of bridge, and therefore the association is asking concerted action
toward this necessary project.
Mr. Gorst reported on the entrance to Roosevelt Hospital, and that some time
ago this had been all set up, and the City was to buy the property at the entrance,
and the State was to do a portion of the work, but the County could not spend the
necessary half inside the City limits, then there was practically a complete turnover
in personnel of the State Highway Department, and the new men knew nothing about the
a~reements which had been made, and therefore the City had held off on the purchase
of property at the entrance. ~r. Gorst remarked that he wou~d be going down to
Olympia next week, and would see the proper parties about going ahead with the work
before purchasing the property which had been formerly priced at $~,000.00, and the
State was to move the house.
Motion by Mr. Gorst and Mrs. Haddon to refer the letter to the Mayor to answer
the portion in regard to the Manette Bridge, and then referred to Mr. Gorst for an
answer on the entrance to Roosevelt Hospital, carried.
Letter was read by Clerk, dated July 18, 1948, addressed to Mayor, signed by
Wm. G. Craft, Marine Inspector and R. E. McFarland, Construction Inspector, of Depart-
ment of Labor and Industries, reviewing action on inspection of City Dock at which
time the Dock was declared defective and unsafe and City was to notify Department as
to when repairs would start, which was done, but letter was not clear as to when work
would commence. Following receipt of letter, they were compelled to go in and barri-
cade traffic orr dock until conditions were safe for operations. They agreed that l~
ton deliveries could be made over designated lane l'or a limited time, but now find tha
advantage is being taken of this situation and other traffic than that originally
allowed is going over dock. Letter also stated not$ing ha~ been done other than land
fill on approach to dock, leaving main under structure in same defective condit$on.
Stated stand as follows, unless City oI' Bremerton gives prompt assurance that repair
work on under structure of dock will start immediately, the Department will be Justi-
fied in taking such action as it sees fit for the cormmon safety oI' all.
Mayor commented that in regard to this matter, he had left word that when any
of the representatives'from the Department of Labor and Industries were in to the l~ca
office, that the Mayor wanted to see them, and Mr. Craft came in about ten days ago,
and the Mayor went down ana explained that the City had called for bids, which would
be returnable July 17 or July 24 (they are returnable the 24th), end that as soon as
the bids were opened, he would write the Department and tell tham what the bids are,
and what the City plans. Mayor remarked that the City had kept its obligations, but
it did not seem like a good idea to keep repairing the present structure as it would
probably not last over three years. Council reviewed the entire matter ol' the Wharf
anc its condemnation, but no action was t~ken on the letter at this time.
Clerk asked permission to sign Contract with Kitsap County Medical Service
Bureau for the City.
Motion by Mr. Kean and Mr. Gorst that the City Clerk be authorized to sign
the Kitsap County Medical'Service Bureau Contract, carried.
Mayor commented that Harold Lebo and Sam Norrison had been in to see him yes-
terday, and suggested that he fly back to Washington, D.C. to try and arrange to have
the government do something about building the Manette Bridge. Mayor informed them
that ~e would call Senator Magnusson to see if such action would be of any help, but
so far had been unable to contact the Senator.
Clerk reported that he and Water Superintendent had been over to Tacoma Ord-
nance Depot, aud that they had been able to ma~e a substantial saving on small stuff,
but there were no large pieces of equipment. They had also been to the Mt. Rainier
Ordnance Depot, and had seen some "Dolly" for the trailer to be purchased by the Water
Department, Dolly to cost about $300.~]0, but had done nothing about it as first they
would have to go to Seattle to sign up, but that they would be going back over to a
sale there next week. ~r. Gorst remarked that someone from the Garage was to go over
and look again at the one at Edmonds, but that one would cost five or six hundred dol-
lars, and that it would be a nice piece of equipment to have. Mr. Gorst at this time
mentioned that there had been a substantial saving on the big truck that had been pur-
chased, as they got 40% off the price, which woule b~in~ the cost to down around
$1700.O0, and purchased elsewhere it would cost around $7000.00, and that there would
also be a substantial saving on the bull dozer.
Clerk reported that one of the Water Employee,s salary checks had been at-
tached, and the Clerk's Department was holding the check.
Motion by Mr. Keen and Mr. Gorst to adjourn the meeting, carried.
