It was stated by City C±erk that on June l?, Mr. George DeC£oedt renewed his restaurant license at the Labor Center not knowing that a Tacoma real estate firm had sold the business to Mr. M. ~. Parrish and on June 29, Mr. Parrish took out a license, and now Mr. DeCloedt wants to know if his money can be refunded. State Examiner said his money can be refunded by warrant as an erroneous payment oI~ license fee, as the license was not to take effect until July 1. Motion by Mrs. Haddon ant Mr. Kean to concur in the recommendation ant instruct the City C±erk and City Treasurer to refund the license payment made in error, carried as follows: Mr. Keen, yes; Mrs. Haddon, yes; Mr. Gorst, yes. Clerk read letter dated July 6, 1~46, addressed to City Clerk, signed by Army SeiJas, regarding application of George Lippert, 401 Park for a pinball location li- cense, and stating Mr. Llppert has a beer and wine license. Letter reviewed the ap- proval of location license at meeting at which question was discussed as to whether or not drug stores shoulC be licensed and three drug stores were denied licenses while one was issued to King Pharmacy. Mr. SelJas remarked that since then he had discovered that Lippert has beer license by Federal Government, end by State, both beer and wine. Asked that this be called to the attention of the Chief of Police and stated a copy was being sent to Chief of Police. Discussion ensued and itwas remarked that King Pharmacy was actually two separate parts, as there was a partition ana tavern on one side, where the pinballs were located. Request for pinball location license was dis- approved~by Chief of Police. Motioh by Mr. Keen and Mrs. Haddon to note contents of letter, an~ the applica- tion be denied in concurrence with ~he disapproval of the Chief of Police, carried. Letter addressed to City Clerk, was read by ~lerk, ~ated July 8, 1B46, signed by J. L. Warme, resident vice-president or Aetna Casualty and Surety Company, in regard to Pool Room License Bond ~ S 181~, Pete Dadivas, ~ ~acific Avenue, Bremerton, Washing ton, in which the insurance company notified the City of their intention to cancel bond on above effective in the shortest period oI~ time prescribed by law. Asked that receipt or letter be acknowledged on duplicate of letter attached and returned to them. Clerk commented receipt had not been acknowledged as it was decided to wait until a decision was made by City Council, so that the legal bond is still good until receipt is acknowledged of the cancellation. City Treasurer remarked bond required by ordinance was in the amount or St00.00. City Clerk stated the entire bond file was missing. Motion by Mr. ~tean and Mrs. naddon that the letter of cancellation of Pool Room License Bona ol' Fete Dadivas as required by card room ordinance be referred ~o the City Attorney, carried. Clerk read letter addressed to Mayor and City ~ouncil, dated July l, 1~,8, signed by Jack Taylor in reply to letter of June 28th regarding sewage treatment in Bremerton and vicinity. Commission recommended that City go ahead on engineering study of problem as it relates to the city only. Navy Yard and Housing Authority have been notified of the situation, and letter stated the parties concerned must work it out as to whether each party makes analysis with own engineers or go Jointly with the city. Stated Office of Pollution felt there should be no delay on the part of the City in retaining an engineer for starting preliminary studies. Mr. Gorst commented that he and the City Engineer were going to Olympia tomorrow to see Mr. Taylor and would pro- bably have some information for the ne~t meeting. Mayor commented that the Clerk should acknowledge receipt of the letter and inform Mr. Taylor that ~r. Gorst and Severance would be down to take the matter up with him, providing the date could be made. Clerk read letter dated July 9, 1946, addressed to the Mayor and City Council si~ned by City Auditor, in regard to a refund from the Berry Engineering Company, or 40% of engineering contract fee for Unit B, Sewer Construction Project Wash 45-17~, in the amount or $55~.08. Letter stated ~nit B was not completed due to the fact that the Government took over land over which proposed Sewer was to be built. Contract with Berry Engineering Co. was entered into on January 14, 1942,. and provided that 20% was to have been paid upon completion of preliminary plans, 40% upon completion of final plans and the remaining 40% to be paid as construction progressed. Also provides that in case any part of project was a0andoned the engineering firm was to be paid accord- ing to the amount of work completed. No construction was done on this part of project and contractor sold supply of pipe on hand to the City. City Auditor attached letter from Attorney Ray Greenwood regarding overpayment, and stated City Attorney received copy. City Auditor referred to Council for action. Letter from Ray Greenwood ad- dressed to City Auditor, in regard to above, and mr. Greenwood s~id he had the matter under consideration for some time with a view to advising Mr. Berry whether or not he i liable to pay the amount back, and that Mr. Berry feels that he is entitled to the money. Mr. Greenwood quoted opinion on contract or liability, expressed or implied, which is not in writing, that action City might have against Mr. Berry started to run in1942, and the period within which suit might have been brought ended three years hence or during the year 194§. If it were argued that the City's claim does not come under the three year statue because there was a written contract for the engineering work, Mr. Greenwood cited a case in which a city had made an unlaw2ul overpayment and neither two year statute or six year statute would apply, which left three year limita- tion. Stated in his opinion the city could not successfuly maintain an action at this late date to recover the money. City Attorney commented he had not had time to check on this matter as yet, but it woul~ seem that it was too late for any action on account of the statute of limitations, but that City Attorney's office would check on the matter. Motion by Mr. Kean ant Mr. Gorst to note contents and refer to City Attorney, carried. Some discussion ensued on the master, and City Clsrk remarked that in the future such mistakes should not occur. Mayor commented that in fairness to Mr. Berry, it should be stated that Mr. Berry ~elt that he did the work and was entitled to pay- ment, even though the Government took over the work. Mr. Gorst remarked that he could not have completed the work and he was not entitled to the last 40% u_util the contract ~was completed. City Clerk asked permission to advertise for bids for the I'urnishing of fuel oil, ~iessl oil and stove oil for the various City Departments for the ensuing year. Motion by Mr. Kean and ~r. Gorst to approve the request and direct the City Clerk and Purchasing Agent to call for bids, carried. Permission was asked by the ~ity Ulerk to call for bids on the improvement of R~inier Avenue between 13th and 18th, L.I.D. 227. Motion by Mr. Gorst and ~r. ~ean to instruct City Clerk to call for bids on the improvement of Rainier Avenue between 13th and 15th, L.I.D. 227, carried. Clerk read letter signed by E. S. Severance, dated July 9, 19~6, addressed to Mayor and City Council, in regard to nearing System, Fire Station No. 3, Bremerton, in which City E~gineer stated bids were received ~ay 15 from LenDs for the project. Bid price oI~ $1,~80.00 seemed excessive, but lower price is not obtainable so it was recormmended that award be made to Lents for the work. City Engineer stated Fire Chief is agreeable to above procedure. Motion by ~r. ~ean and Mr. Gorst to concur in the recommendation o~' the City Endin~er and award the bid on Fire Station No. 3 to Lents, carried. City Attorney read Ordinance No. 1888, entitled as follows: AN ORDINANCE decl.aring an emergency to exist on account of the necessit~ to repair the boiler at ~'ire Station No. Z, appropriating funds to meet such emergency, and declaring an emergency. Motion by Mr. Kean and Mr. Gorst to approve Ordinance No. 1888 on ~'irst read- ing, carried as i'ollows: Mr. Keen, yes; Mrs. nacdon, yes; Mr. Gorst, yes. Motion by mr. ~ean and Mr. Gorst to direct the City Clerk and Purchasing Agent to call for bids I'or recreation center, returnable July 2A, 19~8, carried. Resolutions were read by CLerk urging the construction of a new bridge across Port Washington Narrows. Resolutions from Local 512, of Operative Plasters and Cement Finishers international Association, Builcing & ~onstruction Trades Council, Bremerton Chamber of Commerce and Central Labor Council. Mayor commented the C~ty did not wish to delay on the building of the bridge, but the position of a new bridge as reco~ended by the State Department of ~ighways would entail a great ~eal of expense to acquire the property designated as approaches to the bridge, and that some ~iscussion had taken place as to the advisibility of constructing a. bridge across from Warren Avenue, as the property which ehe City would purchase woulo be much cheaper, and the bridge span woulo be 7~0 lineal feet less in length, and that City already owned a substantial portion of property which would have to be acquired at this location. Some discussion ensued as to the advisibility of the City building the bridge at Warren Avenue and letting the State keep up the present bridge, but it was decided that the state would proOably condemn the bridge, when the upkeep become expensive and Just take over the bridge built by the City as a part of the State Highway system. Mr. Gorst remarked that the State seemed willing to allow $750,000 toward the construction of a new bridge, but probably would not give this amount if another site was decided upon in- stead of the one recommended by the Department oi' Highways. Mayor commented that the matter should be brought before the people and let them decide what to do. City Ate torney suggested that the City should state a specified amount it would be willing to spendon a new bridge, just as the state had cone. ~ayor commented that if the bridge were built across from Warren Avenue that the Manette si~e could be used as an indus- trial site around the sanitary fill at Sheridan Park. It was remarked that it might be wise to have costs of both sites estimated for comparison. Mayor suggested that ~ group consisting of representatives of the various organizations presenting resolutions as well as someone from the city go to Olympia to consult with the state on the matter of a new bridge. Motion by Mr. Kean ano Mrs. ~addon to note contents of the resolution and file and that a meeting be arranged with Mr. Shaln, Director of Highways, and members of the r~o~ ~, d~ ~ ~t~ · Highways Committee to discuss the brid~e situation Clerk read letter from Civil Service Commission, dated July 9, 1946, addressed to City Council, signed by John J. McPherson, in regard to operating buaget of Civil SerEice, in which letter it was stated that the budget listed ~150.00 for advertising examinations, ann that very few examinations were given during the last half or 1945, holding off until as many service men as possible could have a chance at city positions and that beginning in January more examinations were given in a few weeks than for the whole of 1945, thus ~epleting budget accordingly. Secretary Examiner pointed out that action of Council combining Civil Service and Retirement System budgets, gave over $400.00 for Office Expense, and,Secretary-Examiner suggested that $150.00 be trans- ferred to the advertising account it should carry through the year and not damage Offic Expense Account. Motion by ~r. ~ean and Mr. Gorst to refer the matter to the City Clerk and City Au itor for further recommendation as to the preparation or the necessary resolution, carried. Letter was read by ClerK, addressed to Mayor, dated July 8, 1946, signed by Glen Buettgenbach, Csptqin, Fire Department, Chairman of Grounds & Equipment Committee, in which Fire Department requested that the small building, known as the waiting room for the Port Orchard Ferry, located at the First Otreet L~ck, be turned over to them for use during convention. Letter stated building is unsightly and a fire hazard and is well suited for their purpose. Mayor commented that Mrs. Lieseke had given permission to take the 0uilaing off, and the Firemen want it to burn to demonstrate control of fires. Motion by Mrs. Haddon and Mr. Kean that the Firemen be allowed to use this building as requested, carried. Clerk read letter I'rom Civil Service Commission addressed to City ~ouncil, dated July 9, 1946, signed by Secretary-Examiner, in which report was made on discussion by Civil Service Commission in meeting July 8, 1946, and recommendation made that provi- sion be made in 1947 Budget for full coverage for all employees in view oI' the small cost and possible benefits. Letter stated at present practically all employees are covered except a few special categories and orfice workers, and that even though likli- hood of occupational illness or injury to members or this group is remote, that one such case woula probably cost much more than a year's premium for all. Including Library, there would be about 50 additional employees covered. Present rates would be about 32~ per month per person. Initiative 159, if passed would increase cost somewhat but estimates are not expected to cost more than 50~ per person per month, $300.00 a year for the whole group. Motion by ~r. ~ean and ~r. Gorst to note contents and refer to City Clerk to bring up at budget making time[ carried. City ~lerk read letter dated July 8, 1996, addressed to ~ayor and City Coun- cil, signed Dy ~alph ~avisson, State Examiner, in which reference was made to minutes of ~ouncil Meeting oI'.July 3, 1948, in particular to the part of the minutes that had to do with City Attorney's report on suit in connection with L.I.D. #42. According to minutes City Attorney.made statement that matter had been taken up w~th State Examiner, and it ~ad been decided the best way to handle would be to prepare an ordin- ance appropriating necessary funds an~ explain the case, and submit to the Division of Municipal Corporation. State Examiner advised Council that City Attorney nor as- siltant had discussed the manner of settlement with himself, and that only conversa- tion he had with either attorney on the subject had been several days ago in which the State ~xaminer had eddeavored to point out that there were two attorney general's opinions that would indicate the city was not liable to the holders of bonds of B.I.D. #4~ and that Mr. DaEisson was hopel'ul that the attorneys would develop the case along the lines outlined in the attorney general's opinions. Letter asked that this statement be entered in council minutes as a matter o~' record. Letter in reply i'rom Assistant City Attorney was read in which it was stated that ~r. Davisson's exception arises out of an apparent ambiguity in the minutes. Assistant City Attorney suggested that the minutes shoulc show that the City Attorney reported that the City Attorney's ~ffice has discussed the case with the State Examiner, Mr. Davisson, and that in view of that discussion, the City Attorney's office had decided (without the advice of the State Examiner) to prepare an ordinance setting forth all the facts connected with the case and to submit that ordinance to the City Council with the recommendation that it be transmitted to the State Examiner as a proposed ordinance with the request that he secure the advice of the Division of Municipal Corporations as to the validity of such ordinance. N~. Davisson is correct in his statement that this procedure was not discussed with him by either City Attorney, nor was it discussed with any State Ex- aminer. Corrected minutes should show this course is recommend6d.?by City Attorney's office in view of the Supreme Court decisions which Judge H~ G. Sutton indicated he would follow at the time this case came on for hearing on the City's return to the writ of ~andamus, and in view of certain opinions oI' the Attorney General's office. City Attorney's office believes this procedure will be one most likely to avoid an appeal to the Supreme Court in this case. Motion by Mr. Aean and ~r. Gorst to note con~ents of letters and correction of minutes of July 5, be made as follows: "City Attorney reported on suit in connec- tion with LID #4~ in Charleston, ane it seems the case can be settled for around a thousand dollars. City Attorney stated the matter had been taken up with '~he Otate Examiner, and that Mr. Davlsson had objected to the proposed settlement on account of two attorney general's opinions and the City Attorney's office would probably suggest preparation o~' an ordinance appropriating necessary i~nds for settlement setting for%h all facts and submission o~' same to the Division of Municipal Corporations ~'or any up to date opinion of the Attorney General in order that the Council can be fully advised before taking steps to settle the case," carried. City Clerk remarked he had the lease I'rom ~rs. Lieseke, and the only changes he coul~ see between the new and old lease was that the plural had been used on the floats, that Mr. Garland had made because the other lease coule not be used as a bond was required on it.
