HomeMy WebLinkAbout11/05/47 NOVEMBER 5, 1947 I The regular meeting of the City Council was held in the Council Chambers at the iCity Itall on Wednesday, November 5, 1947, at lO:00 o'clock a.m. Mayor Kean presiding, iCommissioner Haddon, Commissioner Gorst, City Attorney, City Treasurer and a number of ipersons re final assessment on L. I. D. No. 234, Erection of Church and on Sewage iControl being present. Motion by Mr. Kean ~d R[r~. ttaddon to approve minutes of previous meeting as written, carried. Mayor stated the final hearing on L. I. D. No. 234 had been postponed to this time. Clerk read letter from City Engineer re L.I.D. No. 234, Alley in Blocks 5 and i8, Phillips Addition, which states protest has been filed by nearly all the property !owners in Block 5. So far as the authority of the City Engineer is concerned the job imust be 100% or be removed. Nothing wrong with the cement and structure of pavement las it is standard. Workmanship on finishing is very poor, however, Engineer,s consider ithe main valUe exists and does not feel justified in removing and replacing the entire ijo0. Surface appearance is not good but maintenance cost will not be greater than that icl like jobs. Whatever maintenance work is necessary will have to be done by the City !after the L.I.D. is settled. City Council has the power to correct, change, lower, iraise or modify the assessment roll, which must correspond to the actual cost. Recom- imends Contractor be allowed 85% of contract price; also, fixed charges be lowered a ilike amount and the assessment roll as proposed be lowered exactly 15%. Signed E. S. iSeverance. City Engineer was present and stated ti~e letter is self-explanatory, that it iwould cost the contractor about three times the original cost to have it removed and !replaced, and further stated that he did not think a good job had been done, but that la car would go along the alley all right, but it would not be good business to remove ithe entire job and do it over. Better business to withhold the 15% and let the job go as is. ' Motion by ~ir. Gorst and Mr. Kean that the City Council concur in the recommenda- !tion of the City Engineer and withhold the 15%, and assessment roll cost be reduced the iproposed 15%, carried. Clerk read letter addressed to Keith 0. Branch, re above L.I.D., which stated iproject is not a 100~ job on account of improper surface and finish. Hecommends a ~proposal be submitted for a reduction of 15~. Total Contract price of $2,680.28. Signed E. S. Severance. ~,~r. Branch's reply to letter was also read by Clerk, submitting proposal on :Change Order No. 3, because of improper surface and finish. Agrees to give a credit icl 15% of total contract price or $472.99 credit, making a total contract price of ~i~2,680.28. Change will not require adjustment of time for completion of contract, and when accepted by Owner, shall be come part of contract, subject to all conditions ~thereof, except as modified by the proposal. Signed Keith 0. Branch, 2618 E. llth. Motion by Mr. Gorst ~d I..~rs. Haddon that the change order be approved as read, carried. Mayor stated this is the time set for appeal from the order of the Planning Com- ~mzss~on denying application by Reorganized Church of Jesus Christ of the Latter Day ~Saints for certificate of use. Mr. John ~.~erkel, Secretary of Planning & Zoning Commission was present, and re- viewed the action which has already taken place on this matter. Planning & Zoning Commission had denied application and the Church had appealed to the City Commission, who held a hearing on ~ep2~mber 24, 1947 and after some diwcussion the matter was re- ,referred to Planning Commission, who held a he,ring on October 15, 1947. At that time ~ just a bare quorum of the Planning Commission was present and three, of those present iwere City Employees, and they felt that no decision should be made until all members were ~resent. A meeting was held on October 23, 1947, at which nine members were pre- 'sent, an~ after some discussion the Certificate of Use was denied by a vote Of 5 to 3. Mr. Lundeen representing the Church was present at the meeting, and also re- viewed past action on the matter. Mr. Long who is selling the property on which they wish to build the church, was also present and spoke on the matter. Clerk reported a lette~ had been received from Planning & Zoning Commission con- taining copies of minutes of meetings which were reviewed by Secretary and which denied certificate of use. Motion by Mr. Kean and Mr. Gorst to sustain Planning & Zoning Commission's recom- mendation and deny the petition. NOVEMBER 5, 1947 (Cont'd) Cle~k'~ststed.i2~is timei~[set for hearing on revocation of taxi driver's license of Ray Lewis Thomas. Mr. Thomas was not present, but Captain Phillips of the Traffic Department was present with Mr. Thomas's past record with the Police Department. Notion by Mr. Kean mud Nr. Gorst to concur in Chief of Police's recommendation, and revolve the taxi driver's license, carried. Members of the Lions Club were oresent at the maeting with Mr. IMward McCain acting as spokesman, and asked that a ~evision be made in the ballot, as they feel that if the 4-mill levy for a swimming pool appears as Proposition No. 9, at the end of the ballot, it will more than likely be defeated. Stated the County Auditor had been called about the matter and he had stated that he would follow the wishes of the City Council. The matter was discussed by those present, and City Attorney dictated Resolution No. 627as follows: BE IT RESOLVED by the City Council of the City of Bremerton that Proposition No. 9, designated in Resolution No. 624, to be submitted to the electors of said city at a special election to be held on December 6, 1947, which proposition submits for ap- proval or rejection a four-mill levy for the purpose of constructing a public swimming pool, be designated as Proposition A, and BE IT FURTHER RESOLVED, that the County Auditor and County Supervisor of elec- tions be authorized to place said proposition at the head of the ballot to be sub- mitted at said election, within his discretion. BE IT FURTHER RESOLVED ~hat the City Clerk certify a copy of this rewolution and transmit said copy forthwith to the County Supervisor of Elections and County Elec- tion Board. Passed by the City Council, signed by the Mayor and attested by the City Clerk in authentication of such passage this 5th day of November, 194~. ~otion by Mr. Kean and Mrs. Haddon to pass Resolution No. 627, carried as fol- lows: Mr. Kean, yes; ~rs. Haddon, yes; Mr. Gorst, yes. A delegation of persons interested in pollution control were present at the meeting, with Mrs. Sarah Shutes acting as spokesman. Nfs. Shutes enquired as to the action taken since the last meeting on pollution control. Mayor Kean reported that following the meeting he had called Captain Keating who had made a report to Admiral Christie, but that Admiral Forte had not been contacted as yet. Mrs. Shutes felt that a letter should be written to Admiral Forte, and the City Council felt that the best approach to the problem would be from Admiral Christie, Commandant of the local Yard, to contact Admiral Forte, in charge of the 1Zth Naval District. It was agreed that the three city commissioners and the City Engineer would go down to the Navy Yard and talk to Captain Keating and Admiral Christie so that they will be able to make the request. Attorney reported he had received a call from the legal advisor to the Comman- dant who is gathering information legal and otherwise to submit the proper request to Admiral Forte on the sewage treatment. Clork read Reports of Separation for the following: William E. Dew, Engineering; M. Catherine Patterson, Library; and Frank A. Johnson, Water. ~otion by Mr. Gorst and Mr. Kean to approve separations, carried. Notices of ~ployment were read by Clerk for Kirk A. Aldrich, Sanitation and Charles L. Wells, Water. ~otion by Mr. Gorst and Mr. Kean to approve temporary non-civil service appoin- tments, carried. Clerk read Change in Pay Status for Leroy R. ~atthews, Recreation. Motion by Mr. Kean and Nr. Gorst to approve Change in Pay Status, carried. Report was made by Clerk that the plan for operation of switchboard calls for placing board on night connections at the close of City Hall office hours, 5:00 p.m., and when this is done the services of one operator may be dispensed with. Recommends two week's notice of termination of employment be given by Civil Service to one opera- tor. Notion by Mr. Kean and Mrs. Haddon to concur in the recommendation, carried. Clerk presented Requisition from Park & Recreation Department for $25 feet of Cyclone Fence to be used at Warren Avenue Field, with a total estimated cost of $850.0(~/ It was stated there is sufficient money in the budget to cover cost of fence. ~otion by Mr. Kean and ~r. Gorst to approve requisition and direct the City Clerk and Purchasing Agent to call for bids, carried. Clerk presented application for transfer of 5 taxicabs, known as Blue & Gold Taxi Company, to Harry C. Lane from Loren J. Surdam. Also letter signed by Loren J. Surdam stating said Taxi Company has been sold subject to the approval of the City of Bremerton. Company was sold to Surdam by Lane under Conditional Sales Contract, and Lane has started foreclosure of contract. Transfer is made to facilitate foreclosure, and requests City Council makes transfer of licenses. Signed Loren J. Surdam. Motion by Mr. Kean and Mr. Gorst that the communication be referred to the Po- lice Department in accordance with the ordinance, carried. NOVEMBER 5, l~4V (Cont'd) Letter from H. H. Roberts, Superintendent of Parks & Recreation, was read by Clerk, proposing a change in lighting structure in Roosevelt Field be made at this time and charged against 1947 budget. Light poles adjacent to dugouts are improperly placed and cause considerable hazard to play of game. Poles on playing surface are in the way of players and are a problem in handling foul balls. Poles eliminate ap- proximately 25 seats from proper vision of field, reducing revenue to ball team and to the City. Recommends poles be replaced by 6" steel poles, tapering to 4" at the top, and set within stands where present supports are located. Pole to be 90' high, 15' higher than present pole and will support roof of grandstand as well as provide support for the light fixture. At present time wires extend from pole to pole in the air. Under new arrangement wires adjacent to grandstand will be fastened by brackets on face of grandstand and enter steel poles at junction of the pole and roof and run inside steel pole up to light fixtures. This is a step forward in improvement of Roosevelt Field facilities in an attempt to bring Recreation facilities up to stand- ard. Signed H. H. Roberts. Mayor commented the budget has been checked and there is money available. Further remarked that when the lights were originally installed the steel, etc., was not available, but now it can be obtained. Motion by Mr. Kean and Mr. Gorst to concur in the recommendation and refer the matter o£ the preparation of specifications and plans to the City Engineer, and author- ize the City Clerk and Purchasing Agent to call for bids, carried. Clerk read letter from United Association of Journeymen & Apprentices, Local 631, which stated members of Local Union attending football games at new Memorial Stadium have praised the field but attest that plumbing facilities are highly inade- quate and overtaxed at all times. Seems planning of field would take care of trouble with sufficient plumbing facilities to handle large crowds. Present facilities are only adequate to handle 48 people and violate plumbing codes of City, County and State. Local Union is interested in having Bremerton's Stadium brought up to standard of other city's stadiums with proper facilities installed. Signed R. M. Tallman, Secretary. Mayor commented this is really a problem for the School Board, but they had dif- ficulty getting the stadium ready for the season and the City should not clamp down IiOW. Notion by Mr. Gorst an~ Mr. Kean to acknowledge receipt of the letter and send a copy to the School Board, and refer the letter to the Building and Plumbing Depart- ments, carried. Letter from City Engineer was read by Clerk tabulating bids received on Concrete iBlock Retaining Wall SW Corner of Sixth Street and Marion Avenue. Bids received I'rom Hunsaker Brothers, $741.00, and Sam Linden, $990.00. Recommends bid of Hunsaker Bro- ithers, which is under estimated cost, be accepted and contract executed. Signed E. S. iSeveranoe. Motion by Mr. Gorst and Mr. Kean that the recommendation be approved and con- [tract executed, carried. Clerk reported a bulletin has been received from Association of Washington iCities re meetings on highways, streets and bridges, but no definite dates have been set for such meetings. However, they are to be held in various cities in the state. Mayor co~aented that the Engineer's office should accumulate the necessary information as far as Bremerton is concerned, and prepare written statement on such matters. Clerk remarked that the Engineer's oI'fice is already working on such report. City Treasurer reported that he had been requested for information regarding the south 15 feet of Lot 9 and all of Lots 10, ll and 12, Block 16, Charleston, which was formerly occupied by Fire Station No. 2. in Junes, 1946, the City sold 135 feet north of this property, and on that sale the front foot price was $57.58. At euch valuation the property would be worth approximately $5,200.00. In 1932 Council authorized the demolition of the old Charleston Otty Hall and the present structure was built from that lumber, ~d an emergency appropriation of $2,600.00 was also used. In view of the above facts Treasurer Felt that a fair price on the property would be ~10,OOO.OO including the building and all appurtenances. Mayor remarked he had asked for such report so that the Commissioners could dis- cuss the situation with a view to possibly selli~g the property. Stated each new tenant who rented the building added various improvements, and that at present two concerns are interested in the property. Felt that the Committee of the ~hole should meet on the matte~. Attorney reported he had been instructed to prepare a supplementary lease on Lot 38, Waterworks Tract 2, between the City and H. A. Brigham. Further commented that Mr. Brigham already leased Lots 36 and 37, and the supplemental lease was to be pre- ipared at the ss~e rental, and to expire at the same time. The lease has now been pre- ipared to expire May l, 1948, at a rental of $37.50. Attorney read lease. Motion by Mr. Kean and Mr. Gorst to approve the lease, carried. Attorney commented that he understands Mr. Hagermann has moved in at the dock, land suggested some sort of lease should be prepared. It was stated that the first imonth's rent has already been received. Motion by Mr. Kean and Mrs. Haddon that the matter be referred to Commissioner of Finance and Accounting and City Attorney, carried. NOVEMBER 5, 1947 (Cont'5) Some discussion ensued on shelter for persons waiting for the Port Orchard Ferry on the dock, but no definite action was taken. Attorney reported progress on agreement between the City an~ District Health Board Council suggested the Attorney contact County Officials to see if they had passed resolution re Health Board, and that the Attorney make arrangements to get the groups together. Attorney suggested copies be made of the proposed agreement and it be discussed here, and copies sent to Port Orchard for discuesion and revision if desired, and when all are in accord a meeting can be held at which the agreement can be approved and executed. Mayor reported that Jack Rogers had contacted him in regard to the Council author- izing his paper advertising proposed charter amendments. Asked what authority the Council would have to authorize such publication. Attorney remarked that the City had no authority to spend money for such purpose only for necessary legal publications in the paper authorized for such publication. Council agreed since there is no money and they have no authority for such adver- tising that the City Clerk should notify Jack Rogers to that effect. There was some discussion re purchase of refrigerators and stoves now on loan from' the Government anm being used at various fire stations. Clerk had ~ontacted F.W.A., and had been informed that the property could not be sold, would have to be declared surplus, and turned over to the War Assets, but that nothing had been done. Mayor commented there is money in the budget this year for the acquisition of such equipment, and if it cannot be secured from the Housing Authority it should be secured elsewhere. Motion by Mr. Kean and Mr. Gorst that the acquisition of certain replacements at present on loan to the City of Bremerton in the Fire Stations be referred to the City Clerk and Purchasing Agent and Fire Chief, carried. Motion by Mr. Kean and Mrs. Haddon to allow all bills if approved by a majority of the commissioners, carried. Motion by Mr. Gorst ~d Mr. Kean to adjourn, carried. Mayor
