Attorney reported the matter of pay for acting lieutenants had been referred to
iCity Auditor and himself for ~ecommendation, and stated that although the Auditor had
inot signed the recommendation he was sure Auditor would concur in the opinion. At-
Council re
!torney read letter addressed to City compensation to Anthony W. Balazic
land three others as lieutenants in the Fire Department from August lO to August 31,
il 47. The men were appointed as lieutenants on July 25 to replace others demoted as
of that date. Action was instituted by those demoted to require Civil Service Commis-
!sion to reinstate them as lieutenants. Superior Court granted relief requested, and
!as there have been no appeals, the Judgment has now become final and all parties'
irights determined. Court held Civil Service was without power to promote the men in-
~volved to lieutenant, and Attorney's opinion is that the City of Bremerton cannot pay
ithem for additional duties even though those duties were performed. Recommend there-
!fore the request be denied, as if the city has no right to make appointments has no
iri~t to compensate those appointed. Further suggests Civil Service Commission and
ICity Council review provisions of city charter, ordinances of the city and the state
