Mr. Mitchell was also present at the council meeting asking if it would be pos- sible to install two pipes to carry sewerage through the tunnel which is being dug in connection with the Capitol Hill Sewer District, and then close one off. Felt' two pipes should be put through the tunnel as the district will no doubt grow a good deal and necessitate the use of a larger, pipe. The additional pipe could be blocked off at both ends of the tunnel and when it became necessary to use it could be connected to the sewer. Commissioner Gorst explained that this was being done as an L.I.D. and there was no money for additional pip~ or work, but to see the City Engineer, and pos- sibly some arrangement could be worked out to use larger pipe than was planned. Letter states they have tried to cooperate, but that the transporta- tion company has broken faith and become unconcerned about bus service there even after being granted 33% fare increase, which is actually a 88% increase in that area. Feel the tria~ service was a farce, and furthermore an unfair reduction is being made effective July l, and feel city officials should exert influence to bring regular service to the Daly Area as they are tax payers of Bremerton. Feel they should have service comparable to that offered districts outside the city limits. Disregard of this problem will be regarded by the group as neglect of public responsibility. Signed Michael Gawenka. Also copy of letter to Paul Revelle, Director Washington Department of Transporta- tion, which states Daly area is confronted with new developments as follows: despite violation of order dated 4/15/47, Bremerton Charleston Transportation Company shall, beginning July l, 1947, further restrict service to Daly Area by discontinuing it entirely each day after 7:30 p.m., all day Sunda¥$~and holidays, and all that~part of the trial route west of Naval Avenue to the Callow Avenue shopping area. Attorney read his letter to Council relative to negotiations with owners of pro- perty at the intersection of Adelle Avenue and State Highway No. 21 for purchase of that property as right-of-way. Previous to negotiations an appraisal was secured from Mr. C. A. Fulmer, who certified the value as $3300.00, with estimated salvage value for the buildings of $300.00. Owners of property Kenneth, Paul and Jack Ninneman, have advised, through their attorneys, that the property's value is considerably in excess of that amount. Treasury Department placed value for inheritance tax purposes at $8,000.00, and their appraisers have advised them that the value of the property is around $5500.00. However, they will accept $3600.00, with salvage value for build- ings of $300.00. Attorney has been advised that the street improvement will be car- ried forward as soon as the right-of-way is acquired. City will be unable to secure property by condemnation until final Judgment is entered by Superior Court, which would be done after Jury has been impanelled to hear testimony and that would be im- possible until September or October of this year. Recommends considering the urgency of the matter, and possible result of jury trial, that City Council authorize Pur- chasing Agent to acquire parcel No. I described in the appraisal and to pay for the property the sum of $3600.00 with the salvage for the buildings of $300.00. Has referred to Attorney General's opinion dated March 21, 1947, and has had two conferences with Mr. F.W.Brunton, Administrator of the Kitsap County Welfare Department. Attorney general's opinion is that liability of the public to provide medical and surgical care for prisoners in county and city Jails is no different from the liability to provide ~edical and surgical care for other citizens, until such persons are indigent that type of care should be furnished as a matter of general assistance. If ~hey are not indigent, such care should be provided at their own JULY 9, 1947 (Cont'd) expense~ Since the opinion made it appear that the State of Washington was responslbl, for medical care of indigent prisoners in the city Jail, city auditor and city attor- ney made arrangements for conference with a~linistrator of the County Welfare Depart- ment. As a result of conference it has been proposed that County Welfare Department be held responsible for care of such indigent prisoners subject to certain conditions and rules which have been made by the administrator. Copy of rules is attached, and opinion is that they are reasonable and if followed will provide ample method for the care of prisoners in the city Jail. Recommends copy of these rules be transmitted to the Chief of Police and that he be instructed to comply with them to the best of his ability. Further reports that the City Clerk has received a number of claims in the last few months from hospitals and Ooctors and these have not been paid. At- torney will continue to confer with the administrator in hopes Welfare Department will assume liability for past accounts as well as those in.the future.
