also protest it's passage. Telegram as follows: "We wish to register a strong pro-
test against House Bill 3756 because of the provision limiting payments in lieu of
taxes. The effect here would be to completely eliminate what is a fair and reasonable
charge for furnishing of municipal services. The revenue is badly needed by this City.

Clerk read letter addressed to Mayor and City Council from the City Clerk re bid
icl Standard 0il on diesel oil which was to have been awarded to them. Letter stated
!Standard 0il had notified clerk that the price of .09~ was in error and correct posted
I price Was .090. Recommendation had been ~ade on award of contract to them on the
Ibasis of quoted figure of .092, and therefore suggested Standard's bid be dlsquali-
!fled, and that the Council reconsider awarding of bid on diesel oil. Listed Lofthus
~0il, Shell 0il, General Petroleum, and Associated Oil who had submitted bids of .095
posted price, time and place of delivery. Also that a firm tim had been submitted of
.095 by Lent's.
Motion by Mrs. Haddon and Mr. Gorst to rescind motion on awarding contract for

Clerk read letter from City Attorney re licensing of automatic music~achines
an~ license fee to be collected by the city, which had been referred to 0ity Attorney
City Clerk, Chief of Police and City Treasurer. Suggestion had been made that some
operators were being discriminated against as they were required to pay license of
i~5.00 as required by Section ~ of Ordinance No. 1~88, whereas, other operators need
only pay $1~.50 per year in accordance with Section ~ of Ordinance No. l~. 0rdin-
ance 1668 provides it shall be unlawful to operate automatic amusement mevices with-
out a license, and that the fee for 8~ operated machines will be $~S.00 per year.
Ordinance No. 144~ states it shall be unlawful to allow playing of records by mechani-
cal means for fee to be charged patron d~siring music w~$hout first~having obZained a
."For Hire" license, anm section ~ of the ordinance provides annual license fee of
'~l~.~0 per year. Attorney's opinion is that any automatic amusement music Sachine is
covered by Ordinance No. l~, and license fee is only $1B.OO. Ordinance does not
ilimit operation to coin-operated musical devices which require the assistance of an
~operator or telephone connection. Believes that City Council, when ordinance was
iadopted, intended to include within its scope all automatic music machines, trres-
~pective of how they were operated. Believes Ordinance No. 1868 was adopted to license
i automatic amusement devices of type commonly found in penny arcades, and was not in-
tended to apply to places of business where only one automatic musick machine was
operated. If the ordinances are construed in the manner suggested, it should not be
necessary to adopt amendment of type suggested. Reasonable interpretation of both
ordinances will achieve the desired result without the amendment. Signed 01ur Johnsen.
City Treasurer and City Clerk concurred in the opinion.
Notion by Mrs. Haddon and Mr. Gorst to note contents and file, carried.

Project WASH. O-l, which stated in accordance with national policy, it is necessary
to convert project in accordance with declaration made by the President of United
States effective ~/~8/~8, which covers similar projects throughout entire country.
Have set up ~8 months program for removing ineligibles, as it is evident that there is
a lack of suitable private housing accommodations for rent within financial reach of
ineligible families, therefore transition should be gradual. Regional Office of
Federal Public Housing Authority has asked Ibr supporting evidence to lack of private
!housing, and ask that City write letter concurring in resolution which adopts policy
of gradual change, rather than evicting all ineligibles immediately, which they feel
would seriously effect program of Navy Yard. Signed E.C.Searle, Executive Director.

about hydrants owned by the Water Department to be removed from Fire Stations Nos. 1

view of the fact that quite a bunch of the hydrants are not being used, that they might
Just as well get rid of them, as a number of small fire districts wished to secure
hyd rant s.
Notion by Mr. Gorst and Mrs. Haddon that the hydrants not in use be declared sur-
plus, and the City Clerk and Purchasing Agent be instructed to dispose of them to the
best advantage of the City, carried.
Commissioner Gorst reported that there is $20,000.00 in the 1947 budget for Imp-
rovement at Gorst Creek Pumping Station, and that they would like to get as much work
as possible done this year, however being the type job it is, they will not be able to
go straight through the job and will try to work it out from a mantenance Job stand-
point, and they want to take care of the construction with city labor. Have contacted
the Union to work out a plan so that it will not be necessary to call for bids on the
job. If the job is done on contract, may have to hold the contractor up several days
or weeks at a time in case of rain or something similar. Wished to call for bids for
material, and will make arrangements with the Union to get anyone the Union suggests
as a supervisor in the construction of the wall.
Notion by Mr. Gorst and Mrs. Haddon that the City Clerk and Purchasing Agent be
instructed to call for bids for 750 bbls. Portland Cement, 20,000 lbs. reinforcing
steel and 600 cu.yds, sand and gravel, carried.

opinion was that it would be in order.
