The Letter requested the Navy Base to prepare a preliminary report making use of one or both of the re~aining proposals, either in the City of Bremerton or in a separate navy plant. The Pollution Ccnt~ol Office prefers the former wherein the Navy Yard will share in the cost of construction and operation with the City of Bremerton. December 29, 1948 (Con't) The City Attorney stated this was the date, time and place fixed for the hear- ing of the revokation of taxicab driver's license of William Ralph Winger, who was. represented by Attorney John.Bowen, associated with Fred Cohen, Attorney. The City Clerk read.and reviewed the previous correspondence on this case and then rea~ the Police Department's record of Winger as follows: 3/20/43 No Operator's License & Faulty Equipment. $15.00 Bail forfeited. 10/23/44 Speeding 5.00 Bail forfeited. 11/2/46 Speeding 10.00 Bail forfeited. 4/3/~7 Cruelty to animal (J.C.~Warrant) 50.00 Bail forfeited. 6/10/47 DWD & Reckless, reduced ~ Negligent driv. fined $50.00 and Costs~.' 7/27/4? Negligent Driving. Fined $25.00 & Cost. 9~11/47 3rd Cab in Zone, B.F. $5.00. 5/5/48 Blocking Alley, B.F. $5.00 11/3/48 Violation Steele Act. Washington State Patrol Record: Port Orchard, charged with lewdness, no disposition. The City Attorney reported on the trial in Municipal Court of the charge of unlawful s~e of intoxicating liquor, that the sailor who originally signed a state- ment that he had purchased liquor from Mr. Winger testified in Court that he had not done so. His name is LeRoyal Temple, NE 3, U.S.S. Toledo. Mr. Winger had sign- ed a statement on the day of his arrest that he sold this sailor whiskey. Neverthe- less the Judge refused to find him either guilty or not guilty and dismissed the case because the evidence was unsatisfactory. Captain T.K, Phillips stated that the Police's recommendation was not hinged on this~alleged violation but was based on his previous record. He has ten or eleven arrests. The Police Department had felt sympathetic toward him before and had cut one arrest from DWD & Reckless to Negligent Driving. Captain Phillips then cited the difference in cases of arrest an~ discussed them. Attorney Bowen stated it was not clear to him whether all the alleged arrests were for traffic violations which would involve the license and Captain Phillips stated in the ordnance the arrests would have a bearing on the person's character. Mayor Kean asked Mr. Winger if he had m ything to say and Mr. Winger answered nothing other than that some of those I didn't understand to be arrests. For in- stance, the three cabs in a zone and parking.in an alley. Attorney Bowen said the last two on the list were ticket violations. Other than the two speeding and two negligent driving ~arges in addition to c~uelty to animals an~ three cabs in a zone and blocking the ~ley (those last two were tick- et violations), the last one I have in which there was a disposition, other than the questioned liquor violation where there was a dismissal by Judge Cart, and since that time have been no bail forfeitures or convictions. Believe most of the drivers in town pick up speeding tickets and parking tickets. During the War Mr. Winger worked in the shipyard as a shipfitter and consequently cmu,t go back to the yard. He has been driving cab for three years and only means of livelihood to support his family. In view of the fact that the last tic~et he had for blocking an alley was in May or this year, no convictions since then, despite the fact that there was a trial on liquor violation in the court in which the Judge saw fit to dismiss the case due to unsatisfactory nature of the evidence, an~ I think he shoul( be ~lowea to be continued ~ havehis license until something comes up when there is a conviction. Mayor Kean showe~ Mr. Winger a w~tten statement and asked him if it was his signature that appeared on it admitting the sale of intoxicating liquor. Mt. Wing- er answered that it was his signature an~ that part of the statement was his. Then Mr. Kean stated to N_r. Winger that his former attorney had stated at the time the DWD & Reckless charge was reduced to Negligent Driving that when the case was settled he would no longer interest himself in Winger as a client. Motion by Mr. Kean. and Mrs. Haddon ~ concur in the recommendation of the Police Department and revoke Mr. Winger's license carried. Motion by Mr. Kean and Mrs. Haddon to recess ~ 10:00 o'clock A.M. Monday carried. APPROVED: ~ · -- ~ Mayor '
