Mr. Fulmer called to the attention of the Council the fact that no petition to rezone that area is pending before the Planning Commission. Mayor Kean expressed the opinion that the letter is self-explanatory and is in order and if anyone wishes to protest it is up to the. June. 30, 1948 (Con't) Clerk read petition signed by 32 residents of Taft Avenue protesting the changing of the name of Taft Avenue to Bloomington Avenue as proposed by the City Engineer. Mayor Kean explained that owing to the way the City was platted the streets within the City were not in a straight llne with the area annexed and this was an attempt by the~ City Engineer to straighten out the streets in the new annexations; Mayor Kean further added that now would be a good chance for the City to ~ake a stand wheni t is necessary to make the changes. Mr. Gorst advised the petition should be held and a general study of some over-all changes of street names made. Following a general discussion regarding the location of Taft the City At- torney advised referring the petition and the matter back to the City Engineer. Mayor Kean asked the opinion of James W. Bryan, Sr., who was~in attendance, his opinion as a~senior citizen in renaming the Street. Mr. Bryan advised that he had named the street'in the beginning but had no objections whatever to it's being changed. Attorney Johnsen read proposed ordinance, first reading, changing the name of Whitney Avenue to Bloomington Avenue, Taft to Bloomington, Cedar Way to 19th Street, Edward Street to 25th Street and Clay Street to 26th Street. She advised that her establishment does not serve beer or wine and she is interested in providing a place for teen-agers to congregate for their en- Joyment and the dancing would not be conducted as a public dance hall. The City Attorney read written opinion, by him, to the Mayor regarding dance places and it was his opinion that any dance open to the public may be operated only by permit. Mayor Kean asked Mrs. Williams ii' she still wanted to apply for a license under the City Ordinance and Mrs. Williams replied that s h~ would as other per- sons besides teen-agers liked to dance while dining. Mayor Kean gave Mrs. Williams a copy of the letter from Attorney Johnsen and advised her she would be able to apply for a pro-rated quarterly license. Mrs. Williams withdrew. James W. Bryan, Sr., asked if the zoning law would be up for passage this morning and was advised by Mr. Johnsen that the only thing he had was a resolution from the Planning Commission asking that the 'Council re-zone a part of the down- town district for loading zones. Mr. Bryan advised he was interested in the new zoning ordinance which was scheduled to come up soon as a client of his has an apartment for rent in his basement and this client might be subjected to a loss by the changes to be made in the zoning ordinance. Mr. Bryan advised he was also interested in the hearing on L.I D. 23§ scheduled for 11:00 A.M. todsy. The City Attorney advised M~. Bryan that there would be exceptions for non- conforming users under the new ordinance. The City Attorney read ResolutiOn from the Planning Commission that the City Council of the City of Bremerton be requested to ~mend Section ? of Ordinance No. 1553 of the City of Bremerton. The City Attorney read Emergency Ordinance No. 1786 amending Section 7 of Ordinance No. 1553, entitled: An ordinance to regulate and restrict the location and use of buildings and the use of land within the City of Bremerton; to limit the height of buildings; to prescribe building lines and the size of yards and other open spaces and for these purposes to divide the City into districts, and declaring an emergency. Mr. Gorst advised that this change hag come up because of the fact~that enough room for off the street parking is not allowed along Pacific Avenue for loading anG unloading of large trucks just as in the case of the new building next to the City Hall. Motion by Mr. Gorst and Mr. Kean to pass the emergency ordinance, carried as follows: Mr. Kean, Yes. Mrs. Haddon, Yes. Mr. Gorst, Yes. Mr. Bryan objected to the ordinance being passed as an emergency ordinance and advised there will be objections to it. The City Engineer explained to Mr. Bryan that it will be providing for off the street parking and loading zones and will help the property owners to improve existing loading zones. June 30, 1948 (Con't) Mr. Bryan advised there should be hearings on zoning ordinances and not b e passed as emergencies. The City Attorney explained that this ordinance is a ~t6p in the right dir- ection in eliminating the space needed for buildings. Mayor Kean advised that the Zoning Commission has been discussing this for months and there has been a lot of study as they recognized the need of amending the existing zoning ordinance. The City Clerk announced this as the date and time for the hearing on L.I.D. 235 and there being such a large delegation the meeting was Continued in the Coun- cil Chambers on the second floor of the City Hall. Clerk read proposed ordinance approving and' adopting the maps, plans and specifications for the improvement of Unit 1 - Callow Avenue between Ninth Street and Fifteenth Street; Unit 2 - Montgomery Avenue Between Ninth Street and Sixth Street by clearing, grubbing, grading for and construction of 5 ft. concrete side- walks, concrete curbs and gutters and providing for drainage. Mayor Kean informed the delegation that each one would be heard-and as they arose to give their names to the Clerk for recording. Mrs. C.L. Fraser, Montgomery Avenue, expressed the opinion that she is for the improvements but thinks the estimate too high by comparison with figures fur- nished by local contractors on a private, basis. Mayor Kean asked Commissioner Gorst or Engineer Severance to outline the pro- cedure of securing estimates on the cost of the project. Mr. Severance explained that the estimate was based on the highest figure furnished by any contractor but the City hopes to get bids on the estimate below this figure of at least 10%. ~ Treasurer Nutter explained the method of payment of L.I.D.'s assessments and length of time allowed I'or final payment. Mayor Kean explained that in making this district the Engineer estimates what the job will cost and protects the City in estimating high. The City acts as an agent to have the Job done as it should be done at the most saying to the people. Gerald Keesin asked why one side of the street should be assessed higher than the other for the same frontage and was told that the assessment is based on the length and depth of the property, and also that an extra charge is made for drive- ways. Mayor Kean recited the benefits to the property owners to!be gained ~y the improvement district, and advised that the actual cost will be less than the es- timate made now and asked the group whether they favored or were against the im- provements being made. The group advised they were generally in favor of the improvements but object- ed to the high cost of the work to b e done. Mrs. Stineman asked about the sidewalk in front of her property and if any- one would get credit for the wor~ they had done on a private basis. Mr. Coffman, from the City Engineer's office, advised that in most cases ex- isting sidewalks would be torn out. Following a general discussion of the conditions of the streets in and around that vicinity the delegation was advised by the Mayor that each property owner could call at the Engineer's office for answers to individual questions and sug- gested postponing the hearing until next Wednesday, to allow time for the proper- ty owners to get answers to their questions and prepare written protests to be turned in to the Council, in the event they wished to protest the improvements. Mr. C.J. Ritchie advised that his assessments are around $400.00 and he does not want the improvements as he already has streets. Mr. Mack advised that ~e sidewalks are already in on his property and he la heartily in favor of the improvements.. George Roberts remarked that the estimate of Mrs. Frasers' of $5.00 per foot is higher than any he had been able to procure but he is definitely against the improvement district, at the present prices. Motion by Mr. Kean and Mrs. Haddon to postpone the meeting until ll A.M. Wed- nesday, July V, 1948 carried, all members voting Yes. Attorney Johnsen reported that he had been asked to take up the question of sewer connections, when the property was outside the City but has been annexed to the City. He explained that there is a monthly charge for the connection assess- ed to residents of the County connected to City Sewers and these people in annex- ed districts would like to know when this charge will be dropped. Mayor Kean asked if it was necessary to say yes or no to this in view of the fact that we will be charging more for sewage ~mnder the sewage treatment plant. Commissioner Gorst advised thatthe charge should be dropped when the property is annexed to the City. Attorney Johnsen commen~ed that the operation Should cease some day and not run on indefinitely, and advised that it costs the City at least twenty-five cents per person to bill the extra dollar.
