Johnson, Captain, Officer in charge, Public Works Office, Puget Sound Naval Shipyard, regarding the contract sent to him for supplying of fresh water to the Naval Shipyard and the Ammunition De- pot, advising that the Navy Department is in agreement with the terms of the contract, with the exception of a clause of the contract under Section 4. Pay- ments. Due to a recent ruling of the Fiscal Director payments, under the con- tract are to be made directly by the Central Navy Disbursing Gffice at the U.S. Naval Station, Seattle 99, Washington, and are not chargeable to the Naval Stock Fund, making it necessary to delete that part of the contract. Captain John- son requested that the deletion be made and he be furnished ~with a letter in duplicate signed by the Mayor authorizing such deletion, and advising When this is done the City will be furnished with a fully executed copy of the Con- tract. City Attorney read letter he had written for the Mayor,s signature comply- ing with the requests of 2aptain Johnson. ~[otion by Mr. Gorst and I'~r. Kean to refer the matter to the City Clerk and the City Attorney with authorization for the Mayor to sign the letter as request- ed, carried all members voting Yes. The City Attorney announced~that Mr. Gorst had reported regarding the visit to Seattle at which time they met with Mr. Fraser with reference ~to the possible study of the City's finances and the City's ability to finance the construction of sewage treatment pl~ts. Attorney Johnsen introduced Mr. Fraser and ~lr. Sherman Elsworth of the Wm. P. Harper & Son & Company, Bonding Company of Seattle, and asked the City Coun- cil to listen to their proposal. Mr. Vaa, City Auditor and ~r. Severance, City Engineer, were called to the meeting in order that they ~ght hear the proposal. Mr. Fraser advised that the City no doubt feels that there were certain questions which would be desirable to have answered relative to outside assist- ance before going ahead and they feel confident to do so and offer their services. ~r. Fraser asked his associate, Mr. Elsworth, to outline their services which will be offered to the City. Mr. Elsworth stated that the study is not just compiling figures smd giving a resume' but really going in and gotting the facts; going into the past five years of water and sewer records and compiling therefrom conditions of actual expenditures made and would be prepared to discuss what would be required to sup- port a bond issue to leave plenty of leeway for the financing of future plants or projects. Is really making a study from a professional point of view. Fra- ser & Company has just done the same for the City of Chehalis. They would make a study in line with the wishes of thc City. The worth of the Study to the City is that it would enable the City to ob- tain the best possible competitive bids. I~r. Elsworth added that he would be glad to answer any questions or outline the general steps as they go through. He submitted copies of preliminary report of the City of Chehalis for the inspec- tion of the Council. Mr. Kean remarked that he could see the definite value to the City but how do they arrive at the fee charged. Mr. Elsworth advised the fee would be a0out ~ of l~ of the amount of the bonds to be involved. About .~l,O00.00 or ~1,500.00, or it may run a little more. Their finn is prepared to quote a flat fee but would like to reserve the right to be accepted or rejected on this and the use as a competitive basis. The City Attorney commented tRat the City may borrow and may make plans to borrow as much as $800,000.00. ~Ir. Johnsen explained that ~wo treatment plants are proposed and any study made should include both plant construction. Any plan they develope would have to take that into consideration. The Attorney advised that the City would want the study to look beyond the present and include plans for the future. I~r. Vaa co~nuented that we need financial assistance in this matter. Er. Severance co~muented that the data for the second plant should be built up for now but woul8 be a later consideration on a bond issue and be anticipat- ecl now. Mr. Wyckoff cormuented t~at the matter of bid calling should be gone into i~.0 W. The City Attorney advised the City could not expect professional people to bid for their services. April 28, 1948 (Cch't) Er. Wyckoff advised that he just wanted the matter of whether bids should be called for services or not made clear now. Tt~ City Charter was referred to and the City Attorney read that part which concerns bids, an~:i advised that it was not necessary to call for bids in this case. Mayor Kean recalled that bids had been called for some professional services in the past ~d only a few had responded. Mr. Kean asked Mr. Gorst what disposition should be made of the matter at this time. Mr. Gorst advised he saw no, reason why they could not go ~ead but if the May- or wished could meet 'this afternoon with the Committee of the Whole for discussion. Motion by Mr. Gorst and Mr. Kean that Wm. F. Harper & Sons & Company be em- ployed to make a bond study and proposition of the sewer contract, with the money to come from the Sewer Fund, carried as follows: ~r. Kean, Yes. Mrs. Haddon, Yes. Mr. Gorst, Yes. Mr. Elsworth advised the work would be done for $1250.O0 up to the first bond and would prepare a supplementary report for an additional $250.00. Mr. Elsworth anm Mr. Fraser were asked by the City Attorney to change their resolution to cor- respond with the rate quoted. Resolution was corrected and Attorney read Resolution No. 646 as follows: A RESOLUTION of the City of Bremerton employing Wm. P. Harper & Son & Company of Seattle, Washington to perform certain services in connection with the issuance and sale of approximately ~)300.000 Water and/or Sewer Revenue Bonds and establish- ing the charges for payment 'thereof. ~EREAS, the City of Bremerton, Washington is desirous of constructing cer- tain additions and betterments to the sewer system of s aid City which are to be paid for by the issuance and sale of appropriate Water and/or Sewer Revenue bond in the approximate amount of ~330,000; and ~EREAS, it has been determined by the City Commission that it is to the best interests of the City of Bremerton that a person or firm skilled in such matters be employed to assist and advise the City in the establishment of the maturity schedule for, and other features of, the Revenue Bonds to ~ ~ssued in order to assure the sale thereof at the most advautageous price possible, and WHEREAS, it is deemed to be to the best interest of the City that it employ Wm.P. Motion by Mr. Keau and Mr. Gorst to pass the resolution as read, carried as follows: Mr. Kean, Yes. Mrs. Haddon, Yes. Mr. Gorst, Yes. ~e City Attorney commented that in connection with action on the sewer ease-- ments for Carey and Associates, he is wondering if the Council wanted them to go ahead with the easements. Mr. Kean remarked that the study by Harper & Company is expected to take into consideration and to comply with all existing laws. The City Attorney requested authority to proceed with the action of the ease- ments. Notion by Mr. Gorst and Mr. Kean ~ authorize the City Attorney to proceed with the necessary easements, carried all members voting Yes. The City Attorney reported that he had met with D[r. Vaa and Mr. Casad and discussed the letter to Captain Johnson. Attorney read from notes: Re. S~nitation: The City would advise Captain Jo~mson that we would provide garbage service and the present rates would prevail; $1.00 being the fee for one can and eighty cents for the second can. The tenants would have to si?~ for the service. Would suggest that the City would require no deposit as this was billed in advance. Would advise Cap- tain Jotmson that Garbage collection in the City is required and all tenants would April 28, 1948 (Con't) be expected to subscribe for this service. Mr. Nutter suggested that ~ey be advised of the kind of can required. The City Attorney suggested sending excerpt from the Ordinance dealing with garbage and it's collection to Captain Johnson. Re: Water: The Committee thought they, the Navy Department, should be advised t~mt rates for the use of their water system be accepted by the City with two minor changes. One that the City be privileged to install meters at any time. The other would be the free use of their water system. The City will provide water at the present rates with a minimum charge of $[;25. The ordin- ance requires a deposit of $3.00 making the first payment ~4.25. The Committee, Mr. Johnsen, Mr. Vaa and~ Mr. Casad, would recommend sending someone up there to take the first subscriptions for water and concluded that each consumer should come to the City Hall to sign and be advised when the bills would be due and payable and also advised regarding the penalties if not paid and that the water will be turned off. Mrs. Haddon remarked that all payments and all kinds of service should be subscribed for at the City Hall and added that someone should be authozi zed to turn the water on in case of an emergency or in case new tenants move in on the week-end when the City Hall is c~osed. ~r. Kean remarked that everything should be handled at the City Hall. The City Attorney advised t[mt he thought Captain Johnson would like to know that the City would ~rovide all other services except that ths City would not provide any sewer or street maintenance or street lights. Mr. Kean en~nerated Police and Fire protection, Library and Park and Re- creation as services and facilities that will be provided by the City for this area. Mr. Kean asXed for any suggestions or additions to the discussion. Mr. Mutter remarked ttmt there would be a complete turn-~ver of tenants every three months and was advised that the majority of tenants would be of a permanent status, from one and one half to 2 or three years occupancy. It was decided that the City Attorney would prepare the letter of under- s tandi ng. ~Ir. Vaa suggested that they be informed that after installation of the meters they remain the property of the City and that ordinarily a charge is made for installation of the meters but these will be installed free of charge. Motion by Mr. Gorst and I~Ir. Kean that the Attorney be instructed to pre- pare the letter of understanding, the ~ayor be aut2~orized to sign same and the letter be sent to Captain Johnson, carried as follows: [~Ir. Kean, Yes. ~.'Irs. Haddon, Yes. Mr. Gorst, Yes. The City Attomey advised t~at he had been requested by l~r. Vaa, City Aud- itor, to prepare an ordinance fixing the compensation of thepart-time leaders in the Recreation Department. The budget provides from, $1.25 to ~1.35 per hour and he ~dshes it changed from ninty cents to $1.35 per hr. Haddon to allow all bills presented at this meeting if approved by the majority of the Council, carried as follows: ~,ir. Kean, Yes. Mrs. Haddon, Yes. Mr. Gorst, Yes. ~r. Kem~ reported that on the letter to Homer Jones he had taken the mat- ter up with ~Ir. Searle of the Housing Authority and he would give ~he ~ayor in- formation pretaining to Bremerton to pass on to Homer Jones. Following inquiry by Mr. Kean regarding the progress of the oil ordinance the City Attorney advised that copies had been sent to dealers but to date he hadheard nothing from them. ~r. Kean asked if there was anything to justify a recessed meeting, if any emergency existed it should be brought up now while all the Commissioners were in attendance as they will not be here in full force for the next three weeks or so. Mr. Gorst suggested leaving time open on Friday for a recessed meeting and Mr. Kean suggested Tuesday, Nay 4th. Mr. Kean asked the City Attorney if provisions could be made for the chang- ing of the meeting date of the Council which is set by ordinance, in case some of the Commissioners do return sooner t~n expected. ~r. Johnsen advised that a weeks notice to the public would be sufficient notice of the change of date. ?drs. Haddon a~uaou~ced that she had been advised that the oo~mmunity of Gorst was contemplating a "clean-up" drive and had been asked if they would be allow- ed ~o dump the trash collected at the City fill. She added that Dr. Be~am was interested in this matter. ~r. Kean asked Dr. Benham if, in his opinion, the City could got permission from the County to burn at t~e fill during the clean-up drives. April 28, 1948 (Conmt) Dr. Benham advised he ~id not know just what the City would be burning. Mr. Kean commented that we would like to cooperate with the people in Gorst but would like to have permission to b~n the material which wo~ld not cover well. Dr. Be~ advised that the Cowry ordinanca prohibited burning of anything ~d was asked by the Mayor if a reco~endation could be ma~e by him to r~lax the ordinance for burnl~ on certain occasions. Mrs. Haddon remrked that all other d~ps in the Co~ty were burning except OU~S, Mr. K~ advised that he would like to recommend for ~. B~'s consider- ation the chang~ of the ordinanc~ that would p~rmit burning of certain typ~s of material on c~rtain occasions so that p~ople would know that rubbish was being bused and not garbage. ~otion by Nr. Ke~ and ~,~r. Gorst'that a reco~endation be mad~ to the Cowry ~ard of He~th that they discuss with the Cowry Co~issioners the ~ending of the presen~ ordin~ce that prohibits burning in such m~ner and on certain occas- ions burning will be permitted, carried all m~bers voting Yes. Dr. Be~a~ co~ented t~at there are better facilities at the head of the Bay for burning than ~here else. The advance agent for the Bailey Brothers Circus appeared before ~e Co~cil for permission to give their circus ~d ~as assured by the Co~cil that if their circus was in no way connected with a carnival he would be permitted to go through the recmlar channels and obtain a pe~it. ~[rs. Haddon anno~ced that she had received several complaints regarding the poor con, rich df and the ~o~t of caterpillars teeming on yacht lots in the City and asked if there were some way in which the City would be allowed to either clean them up or force the o~ers to do so, ~d was advised by the City Attorney that this would t~e an ordnance to have the desired effect. Mr. Kean co~ented tlmt they have discussed this eve~ year and have fo~d that nothing could be done ~thout an ordin~ce giving the City the proper auth- ority. ~otion by Mr. Ke~ and ~,~r. Gorst to recess ~til 10:00 A.M., Monday, May 3, 1948, carried. Parcel #1 valued at approximately $V5.00 plus the cost to the City of a condemnation suit. Parcel #2 valued at ~25.00 plus the cost to the City of a condemnation suit. The City Attorney advised that the people concerned had hoped to get enough money from the City for this land to pay their assessments and this amount would come a long way from doing so, and suggested that the City Council authorize the City Clerk to pay $150.00 for Parcel #1 and $100.00 for Parcel #2. ~dayor Kean suggested that the City Attorney and the City Clerk discuss the matter with the property owners and the Attorney advised he would inform the pro- perty owners of the appraisal as made by ~r. Kean and Mr. Gorst to concur'in the recommendation of the City Engineer and deny the petition, carried as follows: Mr. Kean, Yes. ~Irs. Haddon, Yes. Mr. Gorst, Yes. May 3, 1948 (eon't) 1,~r. Kean announced that following the agreement with Captain Coleman of the Naval Base concerning the furnishing of services for Eastpark and the decision to have the tenants come into the City Hall to sign for ~heir Water and Garbage service someone had made a proposal that an employee of the Water Department be sent to the Eastpark Community Hall to sign the tenants a~ they came into the office for the signing of their new contracts with the Navy and in his opinion this would not be a good idea due to the fact that everyone had come, to an agreement on having the tenants come into the City Hall and changes would have to be made all the way around. Mr. Casad explained that this was done to assure the tenants si~gning prompt- ly so that the necessary office work could be completed. down to I,~r. Kean expressed the opinion that the quicker they began csming , '~ sign and doing things the way they should be dor~. the better things would be arfd he suggested going along as planned in the first place. Mr. Gorst advise~] that at first the whole group was not considered and they hadn't taken into consideration that maybe one or two hundred persons would be in daily. It was decided that the City would proceed with the first plan and have the tenants come into the City Hall to sign for water and garbage service. A discussion took place on the matter of the trash boxes which are attached to each unit in Eastpark and the fact t~at the Sanitation Department would probab- ly be expected to collect the trash as well as the garbage in the cans. Nr. Kean suggested that someone contact Captain Johnson regarding the matter and come to an understanding now. Mr. Gorst suggested having ~.~r. Walker, Sanitation Superintendent, check on the boxes. L~rs. Haddon advised she aaw no need of having trash boxes. ~,~r. Kean was of the opinion that the use of the boxes might be abused and people dump garbage into them, instead of using the cans. Mr. Walker ~as called in and after ~r. Kean explained the discussion to him he advised he had been informed that the Navy had their own maintenance crew to pick up trash from the boxes, but he would suggest discontinuing the use of them entirely. D~rs. Haddon suggested notifying the Navy Department that the boxes should not be used. Nr. Kean offered to reach Captain Johnson and work out a deal whereby they would either maintain them or take them out and the matter rested there. Nr. Kes. n advised Mr. Walker that the matter of burning trash at the Sanitary Fill was being taken car~ of by Dr. Benham and not to burn until permission had been received from the County Commissioners. ~i~he City Attorney announced that the City Clerk had handed him a writ of garnishment against James 0. Mr. Casad announced that the contract with Jensen Water District expired in February, 1948 and as there was a discripancy between this contract and the one with Kitsap Lake Water District he felt they should be the same before renewing. The amount of the rates for the Kitsap District has not yet been decided but he feels they should be much the same with the seine services offered in both contracts. Mayor Kean advised that changing the contract with Jensen District now and then changing it again when the Kitsap District is oompleted would ohly tea~ to confusion and as they had been running without a contract since February he saw no reason why they could not contiuue to do so until such time as the Kitsap Dis- trict was ready for a contract. City Attorney read proposed agreements with Mr. Porter for the use of the Recreation Center for boxing matches and with ~r. May Z, 1948 (Con't) Clerk read letter from Ernest Yett, Fire Chief, listing oil burners,.barrels, tanks, electric hot water heaters ~nd circulating water pump as needed for the different fire stations.
