Clerk read letter dated December 30, 1949 to the Oouncil from B.A. Getschmann Company, offering temporary coverage while the City calls for bids setting forth his offer in detail. Also recommended the City place a special clause in the bid form in which it would be made impossible for a~company to cancel insurance coverage without giving the City sixty days written notice. This would give the City time to call for bids should a company carrying the City's insurance decide to cnacel the coverage. Clerk reaa a letter from Fred W. The City Attorney stated he did not see how this could be legally done that the City should require the writing agent to split the commissions.; therefore, the City Attorney saia he could not advise the City to place this in the specifications. There is a question raised as to whether or not. it was necessary to make an award to hold the money over and Mr. Vaa was asked relative to this point. Mr. Vaa explained that it was his belief that an award should be made, to comply with the State Budget Law. After further discussion it was aeciaed to ask State Examiner Lockwood for his view. Mr. Waggoner, Mr. Burwig and Mrs. Washburn, who live on Washington Ave- nue or ~ashington Beach, complained that since the sewage line was laid across their property that their sewer outfalls have not functioned properly and in some cases have backed up into their property and caused damage. They blamed the failures on the sewage contractor, Malasplna & Napoli, ana cited how the contractor did the work and laid his lines. Considerable discussion was held on this matter and finally the City Attorney stated that contact with the Consulting Engineer, James W. Carey, should be made by the City Engineer's Office as this appears to b e an engin- eering problem. Motion by Mr. Kean and ~rs. Haddon that this matter be referred to the Commissioner of Public Works, the Superintendent of Sewers, and the City Engineer, with directions to write to Mr. Carey that these matters be taken care of or the alternative that the City will do the work itself and charge the contractor, carried. Mr. Lockwood, State Examiner, came in the Council room and the Mayor explained that the City would like to know if the drill tower bid had to be awarded before the end of 1949 in order to hold over the appropriation. ~r. Lockwood stated he would like to call Olympia on this and suggest- ed the meeting be recessed at the call of ~he chair. 'Mr. Lockwood reported back that Mr. Hubble was busy in a meeting but that he would call on Saturday morning.
