The. Letter set forth several items that had not been completed in the
Hoagland-Findlay Engineering Company contract for Unit 1, Manette Sewage Treat-
merit Plant and Pmmp s~ations 1 to. 6, inclusive, and asked that the City accept
the work performed as oeing complete with certain reservations. Letter stated
there would be a second final inspection before the retained percentage is paid;
also, that the City would receive protection from the performance 0onds which
extend for a period oi' one year from the da~e of acceptance in the amount of
10% oI' the contract sum. The City is thereI'ore protected in this amount, should
failures occur in the material or work as covereG by the guarsmtee in the con-
tract documents.
Mr. Kramer stated the items menhioned in the letter amounteG to less than
$1,o00.00 and the City would be protected by retaining the percentage withheld
for a period of 30 days, said percentage retained amounting to about
He said that at the end of 30 days if there were items yet robe completed, then
the City coula wlthhole enough I'rom the last payment to cover said items. Mr.
Kramer saiG it is normal practice anG complies with the contract documents for
the above mentioned letter to be written and the system be accepted aug turned
over to the City I'or operation and, therefore, recommend to the City that it
accepts his recommendation for acceptance along with the conGitions contained
in their IF~'tter. The date oi' acceptance would be this~ date.
Mr. Hoagland state~ that oi' tile items listen, almost all have been taken

City Clerk stated he believed there should be another letter written to the
City to bring the items not completed up to date.
~ir. StoGdard, engineer for Hoagland-Findlay Engineering Company, stated
their firm had aperated the system for ten ~lays at which time the City took it
over. If the City had not operated it, his firm could have turned the sewage
into ohs bay, as they had complied with their contract. Then on October 24,
1949, the 30-day period could have commenced and they could have taken care of
the it ems of work; however, now there are items coming up because they are
still here, which items would normally have come up aI'ter the City had accepted
the system. He further stated his firm is. guaranteeing the. system I'or one
year on all normal wear and t~ar; and that he came back from CaliI'ornia and
took care of the items listed in the letter to the best oi' their ability..
~,lr. Casad asked about the proGuction oi' gas Lrom the sewage and Mr. Stod-
dard stated they have nothing to do with manufacturing gas but Just build the
plant according to speciI'ications.
I~ir. Caaad asked about pump stations and Mr. Stoddard stated that lift
stations are designed in Bremerton around a very dirficult problem; due to
storm water anm nature oi' flow anc they will require maintena~ ce all along.
He saidhis firm.'s responsibility was to operate them for three days, which they
did, an~ then shut them off.
Mr. Wheaton commented there should be a final report from City Water Sup-
erintendent, City Engineer and James W. Carey to see where things are now and
Clerk agreed with this, and Mr. ~heaton saiG something should be done as soon
as possible to know where the City stands on uhe system.
Mr. Hoagland reaG from the contract documents that all controversies which
may arise should be referred to the engineer whose word is to ~e final and con-
clusive to both parties.
City Attorney stated he believed the City can accept the work o~nditionally
when a letter has been received stating what has been done or what has not been
done.
