Present at the Council meeting were several members of the North Side Im- provement Club. Ralph Shenenberger said he had a petition for submissdon to the City Council with signatures from residents within BO0 feet of the area asked For re-zoning, whereas the last petition filed had signatures of those in the adjacent area as well. This petition contained 85 typewritten names and had a notarized statement attached that it is a certified copy of the original petition; also stated on an attached sheet that the petition represents approximately 85% of the property owners within a distance of 200 feet of the property known as Cohen's Addition. The petition protested the re-zoning of any part, or all of the area gener- ally known as Cohen's Addition to Bremerton, on the ~est side of Thompson Drive Ave. extending from 15th to 1Vth Streets. Ralph Shenenberger asked the City Council if they would consider denying the petition of Frank Cohen I'or re-zoning without any further action by the Planning and Zoning Commission. Mayor Kean explained the~ procedure which is followed in all re-zoning re- quests and stated that their request was premature and that the Council would take no action until a recommendation was received from the Commission. Mayor further informed Mr. Shenenberger that his group could come before the City Council on this re-zoning when the Planning and Zoning Commission had made their recommendation. Notion by Mr. Kean and Mr. Wheaton to note contents of communication and refer to the Committee of the Whole for.-consideration carried. Harold Wickland, 1512 Marguerite, asked if the Planning and Zoning Commis- sion had everheld a meeting with the City Council on holding of a hearing on this re-zoning request or had any correspondence on it, and Mayor stated he did not believe so and that the files of the City Clerk were available for a search for any communication and that the City Clerk woulm be glad to go over the files and see if any correspondence was on file. Haddon to approve the recommendation and in- struct the City Clerk to make the necessary change in inventory carried. Nayor stated that the Park and Recreation Department appreciated this gift. Clerk read letter dated April. 21, 19{9 from Department of Highways, Olympia stating that Chapter ~0, Laws of 19~ (H.B.S17) transfers the responsibility for construction and maintenance of the routes of all state highways through cities and towns to the State. ~Fnis transfer includes all Federal Aid routes in your city which are eligible for Federal Aide Urban projects under the pro- visions of the Federal Aid Act of 19~. For these reasons, all balances of Fed- eral Aid Urban Funds allotted to this City, which have not been obligated by being placed under contract, are hereby cancelled. Mayor Kean stated this letter should be referred to the City Engineer and Commissioner Wheaton and City Attorney to study carried. Letter was read by Clerk from Midwest Conference of Building Officials and Inspectors, written l~rom Springfield, Illinois, April 14, 19~9, stating the Third Annual School for Building Inspectors will be held at the Drake Hotel, Chicago, Illinois, June 19-~, 19~9, in two sections, one for Building Inspec- tors and one for Plumbing Inspectors. Wheaton to authorize the City Clerk and Purchas- ing Agent to call for bids for alterations to City Hall, carried. Attorney Ralph Put,is was present at the Council Neeting and stated he was representing Northwest Jobber Supply and Mr. Stanaway, representative (also pre- sent). Nr. Purvis stated he had placed with, the City Attorney a brief of law in connection with fire works; that Nr. Stanaway mesires a permit from the Fire Chief to sell fire works in the City. Nr. P~rvis reviewed the provisions of Ordinance ll~B anm then read quotation from the state law defining fire works. He stated that the fire crackers hand- led by Nr. Stanaway comply with the state law as to sise and do not contain any chlorate of potash, thereby not being a fire hazard, and believe the Fire Chief must issue a permit as these comply with the state law. Nr. Purvis pointed out that drug stores are sealing s~arklers and caps which are classified the s~ne as his client's fire crackers an~ that unmer the City ordinance they should be sold under permit from the Fire Chief and that if his client was arrested for selling his product, then these drug store owners would be subject to arrest also. A discussion ensued and as a result, the City Attorney stated it might be well for the Council to re-consider their previous action and not be arbitrary just because they have ruled out fire crackers before and sugilested the Fire Chief might test out these fire crackers and also investigate the other fire works sales being made now in Bremerton. Nayor commented that the Fire Chief should go out and enZ'orce the ordinance as there are firms violating the p~rmit provisions. ~ayor Kean asked if a ~ecision was held up for one week would it inconven- ience Ralph Purvis' client and it was agreed that it would be satisfactory to hold off for a week. Mr. Stanway left several packages of fire crackers with Fire Cheil Yett for test purposes and said t~at he had a chemical analysis from Olympic Junior College showing contents of the manufactured product. ~otion by ~Ir., Kean and ~r. Wheaton to refer the matter to the Fire Chief and the Committee of the Whole, including the City Attorney carried. Clerk read letter dated April 2V, 1949 from C.P. Keeble, of Keeble's Boat Service, and A.H. Parker, of Nanette Lumber Company, asking that the portion of the 1st class fire zone on the west side of ~hore Drive from the Nanette Bridge South to the end of the A.H. Parker property be re-zoned to a 2nd class fire zone. hThe reasons for the request are: (1) Type of construction required in 1st class zoning makes it prohibitive to construct structures; (2) A large portion of the property is over tidelands and there are no structures close to either the boat plant or the lumber yard that would be endangered by fires in either these plants; (~) If 1st class district is retained in this area, it will re- sult in increased deterioration and hazard as the years go bx. because oE the liability to improve buildings, while 2nd class zoning wo~uld allow the~property owners to make minor and major improvements as ~trey Saw fi~' a~ in accordance with recommendations of the Fire and Building i~epartment~. t59 April 27, 1949 (Con't) Motion by Mr. Kean and Mr. Wheaton to refer this communication to the Fire Chief for recommendation carried. Mayor said he had asked Mr. Grove to write him a letter setting forth the proposals of the corporation and that he had now received such a letter; further stated that some provision might be necessary in the 1950 budget for funds to take care of this problem. Mr. Grove spoke briefly regarding the cost or maintenance in Bremerton which last year was about $2800.00 and which was much higher than normal. He said this was probably due to the repairman as maintenance varied according t o the skill of those who maintain them. After covering the corporation's offers, the Mayor stated the City's concern now is with the financial setup and how the City is going to embark on this pro- gram. Mayor thanked Mr. Grove for the letter and~ated further consideration would be given to the entire problem. Clerk read Ordinance No. 1827, second reading, relating'to and regulating the location, storage, transportation, handling, and use of liquefied petroleum gases known as butane, propane and others; providing a permit therefore, pro- viding a penalty i'or the violation of this ordinance; and declaring an emer- gency. I~s. Haddon stated she thought it might be advisable to advertise for sale the land owned by the Sanitation Department back of Tracyton as will need money next year for purchasing packer trucks. Mayor suggested the Tracyton Water District may be interested in it. It was decided not to state any minimum price in the call. Notion by Mrs. Haddon an~ Mr. Kean that the City Clerk and Purchasing Agent be authorized to advertise for sale carried. Motion by Mr. Kean and Mrs. Haddon to allow the bills presented ii' approved by the majority or the Commissioners carried. Mayor asked about caterpillar spraying and the Clerk advised he had ordered the Cemetery trees around the Sexton's house to be sprayed as the neighbors a- round there had their trees sprayed and requested the City take care of their trees. ~e Parc Department has not yet determined whether they want to go to the expense or spraying or can take care oi' it themselves. Mr. Wheaton stated that ii' a pumping station could be put in at the en~ of Snyder Avenue at an expense of f rom $50,000.00 to $60,000.00 that the sewage could be taken care of for the entire area out there at the point.
