Kitsap County Sewer District No. l, and advising that the only plan which the Sewer
District has for sewage disposal is the working out of a cooperative plan with the City
of Bremerton at such time as the City constructs a sewage disposal plant on the west side
of town; that the matter has been discussed with the City Engineer and it appears that
through the cooperation of the City and the Sewer District, a mutually satisfactory method
of sewage disposal can be achieved; and that the Commissioners consider that a separate
sewage disposal plant for the sole use of the Sewer District would be uneconomical and
more expensive than the District could afford at the present time.
Mayor Kean stated contents to be noted and refer to the Pollution Control file.
Clerk read letter from Commander, U. S. Naval Base, Bremerton, dated April ll, 1949,
signed by N. W. Johnson, stating that the Navy Department plans to construct a ll5 KV

Clerk read minutes of the Investment Board~ of the City of Bremerton for meeting held
April 9, 1949 as follows:
The Investment Board of the City of Bremerton met in the Mayor's office in the
City Hall on Saturday, April 9, 1949 at 9:30A.M. Mayor Kean presiding with Commissioners
Wheaton and Haddon, City Treasurer Nutter, City Clerk McGowan, City Auditor Vaa present.
The minutes of the previous meetingwere read. Moved byers. Haddon that the
minutes be approved as written, seconded by ~. Nutter, carried u~animously.
Mr. Nutter explained .that at the last meeting held on January 18, 1949, he had
been authorized to invest $13,O00.00 1942 Water Bond Reserve Funds and $5000.00
Retire~nt funds in our own L.I.D. bonds but that this authorization does not fit in
with present recommendations. Ne moved that such authorization be rescinded, seconded
by Mr. Vaa and carried unanimously.
April 13, 1929 (cont)
FAr. Nutter then recommended that the following investments be authorized:
Fund: Frincipal Premium Interest
Cum.Res. for Acq. Site & Constn. City Hall 20,000.00 1023.98 333.33
1922 Water Bond Reserve 20,000.00 ~11.99 166.67
Retirement Fund 20,000.00 511.99 166.67
Discussion followed as to whether tying up City Hall acquisition funds by investment
would have any effect on the city,s program for this year. Discussion also ensued as to
who regularly constituted the Investment Board of the City of Bremerton inasmuch as State
law provides it shall be "composed of the Mayor, Comptroller, or Auditor, or if there be no
Comptroller, or Auditor, then the City Clerk~ and the City Treasurer." Everyone present
expressed themselves as feeling that the State law would not fit in with the situation of
the City of Bremerton as the City Treasurer and City Auditor are appointed.
Mr. Johnsen, City Attorney, then entered the meeting and stated that the composition
of this Board as well as the composition of the Firemen's Board could only be clarified
permanently by a court case. He was asked to render an opinion or get an opinion from the
Attorney General,s office as to just who constitutes the Investment Board and whether or
not the Council would have power to increase the membership of such board.
After some further discussion it was generally agreed that investing the Cumulative
~eserve Funds would not interfere with any program of the City and it was moved by ~s.
Haddon that the recce~mendation of the Treasurer for the investment of funds be approved,
seconded by Mr. Vaa and carried unanimously.
The Auditor, as Secretary of the Board, was directed to certify the action of this

however, there still will be a number who won't have granted the easements. City
Attorney asked that the Council to recess so that consideration may be given to accept-
ing the easements that have been received. Discussion was held on whether the City
would charge the $25.00 sewer tapping fee for those who have granted easements and
nothing definite was done on this question. ~. Wheaton said there will be quite an
expense for the city in making the connections along the waterfront and believe the
matter of connections should be considered by the City Engineer and Mr. Kramer.
City Attorney reported that butane-propane ordinance will be mailed out today to
those interested in it, and that the recent state legislation on transporting of such

parties and that the ordinance will be read for the first time on April 20th, after which
copies wlll be distributed to those interested.
Letter dated April lb, 19~, from City Attorney to Council was read by the Attorney
relative to the rock crusher bids, wherein one bidder did not submit a bid deposit. Letter
set forth general rule on bids taken from 23 American Jurisprudence 781, and stated that it
was his opinion t~at the failure of the bidder in this instance to enclose a bid bond is not
fatal to the bid, and that the City Council may, if it wishes, waive this requirement. On
the other hand if the City Council should wish to accept another bid, the bidder in this
case will have no cause for complaint inasmuch as the bid did not comply strictly with the
terms of the bid call. Attorney recommended that the committee sppointed to consider the
bids be authorized to include in their computation any bid even though it did not contain a
sufficient bid bond.
Motion by ~.~. Kean and Mr. Wheaton to concur in the reco~mnendation of the City Attorney
and refer to the committee studying the bids, carried.
Attorney read Permit granting U.S.A. permission to extend crossarms for an electrical

~. Mitchell or his attorney on receipt of sufficient conveyance of the premises.

highway right-of-way which is not required for those purposes and has no v~ue whatever
either to the city or to the general public but which may be of some value to Mr. Mitchell.
Motion by Mr. Kean and Mr. Wheaton to concur in the recon~aendations, carried.
Clerk reported that he had received prices on pumps and tanks for the proposed
installation at Manette Fire Station. Wayne Pump gave new equipment figures and C. Jack
Jones and Bob Lursen of Bremerton gave used and/or new figures. Discussion followed

Motion by Mrs. Haddon and Mr. Kean that the resignation be accepted, carried.
Clerk read letter from Motorola Inc., addressed to the Water Department, attention
Mr. Casad, dated April 5, 1949, enclosing a new Application for Radio Station License and
asking that Mayor Kean sign the application and return to the Motorola Inc. who will
forward them to the Federal Communi~ations Commission.
Motion by Mr. Kean and Mr. Wheaton that the Mayor be authorized to sign the
application, carried.
Clerk read letter dated April 13, 1949, from Department of public Health, City of
Brenmrton - Kitsap County, signed by Sam I. Reed, Chief, Division of Sanitation, asking
that serious consideration be given the installation of a sanitary sewer system to serve
the entire portion bounded by Pc~t Washington Narrows on the north, Naval Avenue on the
east, 15th Street on the south, and Lafayette Avenue on the west, all of which is at the
present time using septic tanks; that there is a health hazard there at the present time.
Recommended further that such a system might be connected with the present sewer system
in Anderson Cove housing area.
Mayor Kean stated this letter was a step in the right direction and asked if it
should be referred to the City Engineer or committee on pollution. Mr. Wheaton said
that the City Engineer has been working on this and the letter is largely the request of
the Engineer. We are hoping to put in a storm sewer on Snyder and hook up to Anderson
Cove. There is no use putting in a sanitary sewer until a storm sewer is in. Mr.
Wheaton said further he thought ~messure sho~]d be put on to form a large sewer district
over and let the people pay for the sewer but get it in as soon as we can.
City Treasurer stated that the Council could under this ]stter from the Health
Department institute a local improvement district for sewer. Mr. Wheaton recommended
that ~nything that can be done be started in order to get something done.
Motion by }.~r. Kean and Mr. Wheaten to acknowledge receipt of the letter and refer to
the Commissior~r of Public Works & Utilities and City Engineer f~r reconmaendationa,
carried.
Clerk read letter dated April 15, 1949, from City Engineer, regarding the petition
requesting the vacation cf an alley running between E. 13th Street and ~. ]4th Street
and located 102 feet West of Perry Avenue, and presented a second petition protesting the
closure of the alley signed by Mrs. Ada May Williams, and containing 32 others. City
Engineer recommended that, inasmuch as strong objection to the vacation has been presented,
the request cf the first petition be denied and the alley be continued as a public
thoroughfare.
Motion by ~lr. Kean and ~. Wheaton to concur in the recommendation and deny the
petition to vacate, carried.
Clerk read telegram from R. R. Hausmann, U. S. Pipe and Foundry Company, addressed
to ~. Casad, Water Superintendent, offering their facilities in the event there is a
need in Bremerton due to the earthquake.
Mayor asked if there is any report on the bids still not awarded and Clerk stated
the bid on MC-2 Road oil is awaiting further advice from the county. Mr. Wheaton said
that the county had saved $1.OO per barrel since putting in their own facilities and are
now $16,000.00 over their initial outlay. Further, stated that he and City Clerk will
talk to the county on getting oil through their facilities, and if this can be done then
the City will have to buy a tank truck. ~
Mr. Kean stated that last night the Housing Facts and Goals Committee met and
discussed the disposition program in length. City Clerk read a letter dated March 17,
1949, from R. A. Oraker, Technical Adviser, Disposition Dept., of the Bremerton Housing
Authority, relative to Anderson Cove Housing project, Wash.-45111, that he has been
advised by Mr. Kearny of the Regional Field office, that according to a recent directive,
all priorities for the purchase of properties in the classification under which this
property will be sold, have been abolished. However, the Regional office has the right
April 1~, 19~9 (cent)
to sell at the fixed appraised ~rice to those that were formerly top priority holders
providing that the offer is made prior to the period of advertising for bids. Inasmuch as
they have not advertised this property to bidders, the City has the right to submit their
Offer to purchase at the fixed appraised valuation at this time. Should the appr&isal be
considered too high, the City could bid on a competitive bid basis and take its chances
along with other bidders. The figure set by Public Housing Administration for this sale is
not for publication at this time, but it may be obtained by the City by contacting the
Housing Authority, s Sales Office.
Mayor Kean stated some Mroperty is going to be needed of this kind at this time and
that there is 20{ acres and some waterfront property there for disposal. There is land
needed for street department equipment and Mrs. Haddon stated she needed a location for a
modern incinerator. Mr. Kean said that the Housing Facts and Goals Committee last night
recommended that the City acquire the land there. Mr. Wheaten suggested perhaps enough
land could be disposed of by the City to pay for the City,s outlay and discussion was held
on this point. It was pointed out by City Auditor and City Attorney that the City could
not purchase land with intention of re-selling but must purchase for municipal purposes;
however, if it was found later that it could not be used for the original purpose then the
City could dispose of ~hat is not needed.
Motion by M~r. Wheaten that if the City can possibly do it, to acquire Anderson Cove.
Discussion was held on ~here money could be made available. City Auditor stated the
cash reserves for a purchase of this kind are pretty well depleted. Clerk commented that
perhaps the City should try to interest some industry to come in and purchase the property
as that is actually our goal. Mayor mentioned that the Housi~ Authority is going to turn
over to the City an area in Sheridan for park purposes and another small area at the water-
front at Sheridan Park for general municipal purposes. Mayor stated that he was advised
last night the property couldn,t be purchased piecemeal and suggested this matter be brought
up at next Wednesday, s Council meeting and check to see if the City is going to buy the land.
The motion made by ~{r. Wheaten did not receive a second.
Mayor discussed Sinclair Heights property and reported that the City could not acquire
the ~operty udder Public Law 829. City Attorney stated there was a quirk in the law tt~t
would not allow the City to receive that property.
Discussion of the contemplated changes in the City Hall was had and Mayor Kean stated
he felt it desirable to retain an office for a Judge. Mr. Wheaten said that the only thing
being done to the former Judge,s office was to cut a doorway into it. It was felt that
call for bids should be made as soon as possible to get the ~roject under way. ~r. Wheaten
said that the City Engineer is making ready to call for bids now. Clerk stated he had
discussed the matter with City Auditor and does not believe the expense of changing the
Clerk's office could be justified.
~ayor Kean reported that next TuSsday afternoon, Mr. Wheaten, City Attorney~ City
Engineer and himself are going to discuss sewage treatment with Admiral Bledsoe.
City Attorney read a letter dated April l~, 19h9, from himself to the Council~ handing
the City an easement executed by Mr. J. W. Bryan and wife for tract No. ~. This easement
provides that the grantor may .hays a connection with the interceptor sewer without payment
of any fees or charges. City Attorney has discussed this matter with the city engineer and
he is of the opinion that no fee or charge shonqd be collected from owners of lands within
the city limits. Attorney concurs in the Engineer's recommendation and reco~ends that
this easement be accepted by the City Council subject to the conditions stated therein and
that the Clerk be directed to file same for recording by the County Auditor.
A lengthy discussion was held on whether or not this type of sewer connection was
subject to the $2~.OO fee and v~ether the ordinance would have to be amended to clarify the
question. ~r. Bryan stated the connection would be on his oWn land and not on city streets
and that the sewer goes across his private property and the easement is worth a thousand
dollars. The question arose if those who do not give an easement willingly but are necess-
itating going to court should be charged. The Mayor stated whatever was don~ shoula be
uniform and consistent and all should be traated alike. The question was not settled but
it was decided to recess until the afternoon for further discussion.
Motion by Mr. Kean and Mrs. Haddon to recess until l:~O P.M., carrisd.

Recessed meeting of the City Council of the City of Bremerton was held April 15, 1949,

Wheaton, City Engineer, City Attorney, City Auditor and J. W. Bryan, Sr. being present.
5iayor explained to the City Engineer about the sewer charge question and asked what
was to be the policy of the city of these connections to be made within the city.
Mr. Severance stated he was not in favor of charging the $25.00 in the city. Mayor
asked if we are conflicting with our sewer ordinance and if there is to be charge in the
city and Engineer stated that ~ is his understanding and that he did not believe the
ordinauce applies to this sewer line; that he believed the way the city obtained the sewage
treatment money made it so that the fee could not be made. He said that after the s~ie sewer
is brought to a person's property there is not further charge to be made at any time.
City Attorney stated he did not believe there would be ~ny criticism from state
examiners for not collecti~g the $25.00.
A discussion was held on connections of those outside the city but no definite action
was taken.
Motion by Mr. Kean and Mrs. Haddon to concur in the City Attorney and City Engineer's
recommendation and accep5 the easement of J. W. Bryan, Carried.
Mayor Kean stated he had just received a telephone call from Mr. Oraker of the
Housing Authority and he has talked with l~r. Kearny of Public Rousing Administration. Mr.
Kearny informed ~. Orak~r that if we wished to make a request over the Mayor's signature
that a certain section of Anderson Cove be sold separate from the rest, he would recommend
it and see how far it goes. Mayor said he would like to see the group go out and estimate
the size of the property and the location the city wo~11~ like to acquire and see if we
can,t buy that area and then waive any right ar interest in the other so that the Housing
Authority could dispose of the rest.
Discussion held on ~e sewers in Anderson Cove because it is anticipated that the
City will use the sewers there.
It was decided to leave the City Hall at 3:00 o,clock to view the site at Anderson
Cove.
Motion by ~[r. Kean and ~s. Haddon to adjourn, carried.
