Clare Fulmer presented petitions asking for repeal of business and occu- pation tax ordinance by the Council and if not repealed then it be referred to the qualified voters. Mr. Fulmer said the committee had hoped the ordinance might have been repealed and not make it necessary to go to a vote; also, it had been hoped to have had the ordinance referred in the November election and because it was not there has been a delay in getting the petitions in. 550 December 13, 1950 (Con't) He said the petitions had Peen signed by well over 2000 persons mud that by eliminating those living outside the City, the net result would be 1918 sig- natures. Mrs. Haddon stated the. petitions would be referred to the Clerk for fur- ther checking. Jack Rogers asked when the ~lection might be held and i~irs, liaddon stated it was hoped to hold it February 3rd at the same time as the school election; however, it depends on checking the petitions and the result, as to whether more signatures are needed, and the time necessary to close the books and advertise the election. Mr. Steve Kerr said he regretted very much that the election ~as to. be de- layed until after the date on which this tax was set to take efi'ect and asked how the ordinance would be affected at the first of the year. City Attorney stated the ordinance would be suspended due to the charter provisions. Also, he said, there were two views as to whether the tax would be retroactove in the event of a vote in favor of the tax, and he could not say de- finitely whether the tax would be retroactive or whether it would be effective after the election. Haddon that the I~lugineer's recommendation be concurred in, carried. Clerk read a letter from himself to the City Council dated December 12, 1950 stating an error was made when ordering fire extinguishers recently in that the quanti, ties of two types of extinguishers had been figured incorrectly aM there should have been seven C02 Extinguishers instead o~' three, and 18 Foam exting- uishers instead of 22, total addition in price to ohe contract of $162.00, plus sales tax, and Clerk recommended a change order for the increase. Eotion by Nr. Wheaton and Mrs. Haddon to approve the recommendation, car- ried. Clerk stated he had been informed that in the recent call z'or Oids for printing there was one item of garbage bills in two colors and this particular paper stock is becoming increasingly difficul.t to obtain and that Ooth ~r. Cas- ad and ~r. Short have informed him this was extremely difficult to obtain in the last war and it appears to be advisable to ma~e a change order ~o either double the order or purchase what would be an additional year~s supply. ~[otion by Mrs. Haddoh ~d Mr. ~eaton that the change order he approved, carried. Clerk read a letter, dated December 11, 1950, £'rom Mr. Searle of the local Housing Authority addressed to Mr. Wheaton stating the housing authority has had numerous requests ~'or installation of a street light at the corner of Clare Ave- nue and Lebo, ~he location of a bus stop, and those requests have always been referred to the power company or the City ~nglneer's Office but no action has been taken. Now that the project is filling up again, the i'oot traffic in this area is quite heavy. Mr. ~eaton asked to have this referred to him I'or study. Motion by ~rs. Haddon and Mr. Wheaton to refer to. the Commissioner of Pub- lic Works and Utilities for study, carried. Mr. Wheaton stated it has been reported to him that the cost to remove the Bonneville power line from the gravel pit would be $12,000.00. He said this fig- ure did not make sense to him and he was going to investigate how the power line was permitted to be on that particular piece.of property. Mr. Wheaton stated last Wednesday morning he had sent in City equipment on Snyder Avende and worked there Wednesday, Thursday, Friday, Saturday until noon and part of Monday and the costs have been $823.1B which amount should be billed to Lent's. The Lent partners are willing to sign in favor of paying the bill. Some of the property owners have been questioning the City's right to do this work when a contractor is doing the job. 55i December 13, 1~50 (Con't) Mr. Wallace stated this amount should be a deduction in the final esti- mate and this is a charge for services and not a modificzation in the contract and the specifications allows the City to do this work. Mr. Wallace stated further he could write a letter in accordance with the termsof the contract that they waive the notice which was required. Mr. Nutter submitted suggested rules governing trade stimulants or devices in connection with Ordinance 1909 and asked for the approval of the Council. Motion by Mrs. Haddon and Mr. Wheaton to approve the regulations, carried. City Attorney reported he had corresponded with Pacific Indemnity Insurance Company in connection with the wreck involving Herb Conners and that he hoped to get a draft Lrom them but was not surehow the claim would come out. City Attorney stated Helen Graham Greear, Attorney for the Housing Author- ity, has given him a tentative draft for a cooperative agreement for the a rea which has been turned over to the Housing ~uthority, known as Westpark Addition. This must be signed prior to the transfer or the property to the local authority and in any event prior to June 30, l~51. Mrs. Greear is asking for a tentative approval of the tentative agreement and '"r. Wallace stated he is not in any pos- ition to approve it yet. Discussion was 0fought up by Merrill Wallace in connection with the moving or the D.A.R. monument at the east end of the ~anette Bridge, as he had receiv- ed a letter from the City Auditor, who had stated there was a bill received for $200.00 for moving the monument when the street widening was performed but that the City had not received a deed for the former D.A.R. property. This matter was discussed thoroughly and it appeared that L.A. Bender had deeded a small piece of property to the D.A.R. for the monument, which property was now ~ing used I'or right-of-way and the monument is now on City property. In order to ap- prove the bill rot moving it would be necessary rot the former property to M deeded to the City for right-of-way purposes and as a consideration rot the trans- fer of property, the City to stand the expense of moving the monument. City Attorney stated he would check the deeds in which the right-of-ways were received at the east end of the brid~e and ii' necessary he would draw up a proper deed. ~r. Wheaten stated he had been trying all summer to obtain permission to hook-up to the Navy 10" line which runs into the ammunition d~pot and has fin- ally received such permission. Mr. McGowan stated no award has yet been made on the purchase of two new trucks for the Street ~epartment and it is apparently the concensus of opinion that the GMC would be the best truck I~r the job, although it was the highest bid. ~r. ~heaton explained that actually the price of the GMC is a little less than the International but that the International has allowed more for the trade- ins; however, the reason the City is turning in these particular trucks is be- cause riley have not stoop up snd ii' International trucks were purchased they would have to be built up in order to s~and the heavy work required of this particular type of dump truck. This would raise the cost until it actually would be more expensive to purchase the Internationals. City Attorney explained that according to the charter the lowest bid is not the only one to be considered and other factors enter into this and he said that the bid could be awarded to GNC, and in his opinion ii' the GMC meets all the specifications then he would say the International truc~ is not the lowest responsible hid. Mr. McGowan then reported that as a result of the committee meeting the bid on trucks will be awarded to Gal0raith Motors for two GMC trucks. City Cleric asked Mr. Wallace if he had a report to make,on official publi- cations. Mr. Wallace stated there is nothing in the S~ate Law to prohibit a City of the first class rrom placing official publications in a weekly paper like the Kitsap County News; however, there is an old ordinance which requires that of- ficial pu01ications be published in a paper which is printed and published in the City. This ordinance could be changed but not in time for this year's con- tract. Mr. McGowan stated bid would be awarded to the Bremerton Sun. Mrs. Haddon stated She had attended a meeting or the Civilian Defense last night and said further she felt that the Commissioners should wait until Mayor Kean.gets back before taking up the matter of appropriating money ror the Civ- ilian Defense.. Motion by Mrs. Haddon and M~. Wheaten to adjourn, carried. APPROVED: City Clerk ~- ' Actln~'Mayor
