Letter asked that certain modifications 0e made to the system so that this will not occur. Clerk read letter from Puget Sounders, Inc., addressed ~o the ~ayor and Council urging them to attend the Srd Puget-Sound-Pacific ~evelopment Congress. to be held in Seattle December 7, 1950. Motion by M~ Kean and ~r. Wheaton to note contents and tel'er to anyone concerned and particularly the press, carried. City Attorney read "An Ordinance relating to regulating and Licensing cer- tain punchboards, spindle games, and similar devices whether used as "trade stimulants" or otherwise; fixing fees; providing for enforcement, and for the issuance and revocation of licenses, by the City Treasurer andprescribing pen- alties." Motion by Mr. Kean and Mr. ~heaton to approve the ordinance on I'irst read- ing, carried as follows: Mr. Kean, Yes. Mrs. Had~n, Yes. Mr. Wheaton, Yes. City Attorney stated he had discussed the taxi cab ordinance with Captain Phillips over the question oY whether or not the ordinance precludes the right of one cab owner to park other cabs than the one approved i~or the Oaxi cab stand and a review ti~ the ordinance reveals that pe~aission to park in a de- signated zone is for a designated cab having a designated trade name. This had been challenged by Garland and Garland, and Purvis and Sanchez, and the question is whether, pending this survey, the Council wants to reconsider its intention to have the ordinance enforced. 541 November 24, 1950 (Con't) Two local ~ttorneys have invited arrest. The ordinance has not been en- forced and the cab owners don't want it observed; however, certain cab owners had this ordinance drawn ~p'by a private attorney. City Attorney stated it is up to the Council to decide as to whether this is a good or bad ordinance and whether it is to be enforced at this time. Captain Phillips commented that in asking the City Attorney I'or advice this morning, it was decided to ask the Council on the question. Further discussion was held and it was the Commissioners opinion that they are bound ~ enforce the ordinance. Mrs. Lane asked ii' it was going to be necessary to put in another post in order to mark the zones at both ends and aI'ter discussion, Captain Phillips recommended that the section of the ordinance governing marking of the zones be referred to the cbmmittee for study. Mrs. Lane made further remarks regarding the operation of their cabs and said that if they could not operate their cabs alternately in their stands they ~ould take a financial loss of about $V5.00 per day. She asked that the enforce- ment of the ordinance be suspended until the committee study has been made, and pointed out the ordinance has 0een violated for a year and a half. Mayor stated the Council isnot in position to authorize a violation of the ordinance. City Attorney stated that he did not believe any particular taxpayers would be incensed because the ordinance was not enforced while the study was being made. Captain Phillips stated there were enough ordinances left to ~nbrol the taxi cabs iz' the whole ordinance was repealed. After discussion he stated he was referring to police control and not licensing. City Attorney stated he was not prepared at this time to say whether o~ not the ordinance should be repealed, and he would like ~ go slow on this par- ticular ordinance. Mayor commented that the Council should recess until 9:30 A.M., Monday so that the Attorney may have some time to make a study of Or~ nance 1631. Mayor asked what should be done on the marking of the stands and Captaih Phillips recommended this not be considered until the committee stuff has been ma de. Mayor Kean mentioned that Harry Hatch had been appointed to the committee but the newspaper had printed the name oI' Tony Hatch and that he wanted Harry Hatch to serve because he was a bus operator. City Clerk stated he had notiI'ied Harry Hatch and he had stated that either himself or Tony Hatch would serve. Mayor asked the Clerk to contact Harry Hatch and ask him to take this of- lice himself. Mayor Kean stated someone hadmade some comment about his picking up a City car and going to Washington, D.C. and that he proposed, unless the Council has some objection or unless someone wants to do something different, to pick up the new car in Detroit and drive East to Washington, D.C., then to New York for a brief visit with his daughter and son-in-law and then drive west to Bremerton. Motion by Mr. Kean and Mr. Wheaton that the Mayor of the City oF Bremerton be authorized to pick up a car at Detroit, drive east to Washington, D.%, then drive to New York and then drive west to Bremerton, carried, all members voting Yes. Motion ~y Mr. Kean and Mr. Wheaton to recess until 9:30 A.M. Monday morn- ing for the purpose of further considering the ordinance relative to taxis, carried. APPHOVED: City Clerk Mayo~ 542 November 27, 1950 Recessed meeting of the City Council of the City of Bremerton, Washing- ton, was held Monday, November 27, 1950 at 9:30 A.M. in the Mayorts Office, City Hall, Bremerton. MayoP Kean presiding and Commissioner Haddon, Commis- sioner liheaton, City Clerk McGowan, City Treasurer Nutter, City Attorney Wallace, ChieI' oI' Police Lewis, Captain of Traffic Phillips, Attorney Bill Garland, bus and taxi operator George Swanson, Taxi operator Claudia Lane, taxi operator V.R. Farkhurst, Vincent Benbennic~ and Paul Ryan, Associate Editor of the Bremerton Suu. City Attorney advised the Council that he had made a study oI' state law and the City ordinances and it would seem to him that it will confuse the situation in an attempt is made to do anything hurriedly. The citizens com- mittee was appointed as an advisory group who will represent those who use the streets, and this committee should be heard. The ordinance that was drawn up by a private attorney for the cab operators has not worked out too well and the City Attorney then read from the State Law a list of prohibitions in the regulation of cars on public highways. He wasid he was not sure if this list applied to streets in the city other than the state highway. Mr. Wallace stated that amending the ordinance in one or two sections. would add to the confusion. The section to do with alternating cabs has not been enI~orced and ~r. Wallace advised it would seem to him to be a waste of time to change this while the committee is making a study. Mr. Wallace recommended to hold up any action on the ordinance until the committee has made their study and recommendation or report, which should be within 90 days. He said that ha presumed the cab companies will want their exclusive parking stands and will want to alternate cabs in the stands. Whe- ther the other four operators feel differently about alternating cabs is an- other question. Mr. Wallace discussed the matter of arresting violators and testing the ordinance. Mayor Kean explained that one oi' the minor violations being permitted in the'City was to do with loading and unloading zones wherein they are plac- ed on a corner. This was done to take care of traffic and to allow circu- lation o£ traffic in this section of town. Mayor asked what will happen to these areas when the committee ma~es their survey and City Attorney stated he hadn't determined what local regu- lations might be allowed in the State Law. City Attorney again recommehded that no change ~ made until after the study. Motion by Mr. Kean and Mr. Wheaten to boncur:~ini~the reco~nendation of the City Attorney and make no changes in the City ordinance pending the re- port and recommendation I'rom the survey committee, carried. Mayor stated The ordinance is still in effect and is going ~ as~ com- mon sense operation of the ca0 companies until the committee comes in with a recommendation. City Attorney suggested further that the business ~ operated as they have for the past year and a half, until the comm~tte~ has an opportunity to study. ~lso, suggested no arrests should 0e made on marking of cab stands. Mayor said that was his thinking, also. Chief Lewis stated that in the years he ~as been on the Department there have been many engineers and traffic experts come to Bremerton and they have all given up trying to solve the problem here. This town is laid out a littlm different than any in the United States. Mayor pbinted out that due to the bottleneck oz' going east and west, the MX plates oI' the City and Housing Authority are noticed a great deal more ohan in a city allowing a flow of t~aI'fic. Motion by Mr. Kean and ~rs. Haddon to adjourn, carried. APPROVED: Ci y C1 r~
