Mayor Kean commented that Attorney Jim Arthur has pointed 'out that the present water ordinance discriminates between the Bremerton Gardens and other similar places and that the city may be faced with a lawsuit because of this. City Attorney explained the differences as now being charged, citing the cases of the low income ~nits at Westpark, the So~h Cou~t Apartments end Bremerton Gardens and that the ordinance could be changed so that South Court is handled Just 1N~t~er similar places. Mr. ,Casad stated that Bremerton Gardens is difi'erent than any other ~lace in the water system and the ordinance should be amended to take care of this exception. Mayor Kean asked Mr. Cook if he had any solution I~or finances and he said he did not but was trying to ta~e care of the finances oI' their member- ship. ~ayor Kean explained the financial outlook and said that most depart- ments have been advised to recognize present inequa£ities.end to continue all other salaries at the present scale and then the council will check against the expenditures and r eceipts and if there is any increase it will be general or any decrease will be general. Also, saic it might be nec- essary to get along with a decrease in the number oI' employees and the City needed more money to meet the present salaries. Mr. Cook remarked that he Oelieved there is justification for the re- quest ih comparison with other cities an~ work done in civilian plan~s and that las~ year no raise was received and the wages are inadequate, not only in the ~epartments he represents but in other departments. This ordinance was passed in 1908 and Treasurer Nutter suggested it be corrected and brought up to date to allow full oper- ation and a lesser fee. Mayor stated he had suggested that Mr. Steinhart might use the site near Evergreen Park and asked that Mr. Nutter and the City Attorney get to- gether on the two ordinances which apply to such an operation and bring in a recommendation. City Attorney discussed the matter of codification of city oPdinances and suggested that the matter be taken up at Friday's recessed meeting. City Attorney stated he had looked into the matter of deposit of pub- lic funds and saic he felt that ii' any substantial f~ds are raised for Pol- ice or Fim~men~ th~..money should go through the Treasurer. Mayor Kean stated he had heard the community fund was going to ~onate a sum o~ money for operation of the Fire Department first aid car and won- ~ered how the City can legally db this. City Attorney said the money could go through the City Treasurer and then put an expenditure in the budget to cover the receipt. Nayor Kean discussed the operation o~ the various ambulance services in the County and stated that if money were accepte~ for the City's first aid car, then the City would have less control over its operation a~d as Commissioner over that department he did not want to have people giving money f~r the first aid car because of th~ reason. Montgomery, submitting a partial bid on 40 acres of City p~operty near Kitsap Lake. Thief bid was $60.00 per acre for the five to ten acres w~re the spring they use is located, and for the balance of 30 to 38 acres, in which they are not specifically interested, they bid not more than $2§.00 per acre. Also, if this bid is not acceptable, they desired to know how much per acre the City desires for the few acres where the' spring is located. Enclosed was check for $100.00 as security on the bid. City Attorney stated he had been checking on a request for information on submitting to the City petitions for initiative ordinance. Mr. Wallace then read the charter provisions and stated that he rendered an opinion in 1948 when the City Manager Form of Government came up and that was to the effect that petitions must be submitted in accordance with the general pro- vision of the State Law which states that a petition must be certified by the governing body of a city to the election board' at least 4B days before the date of election. Mayor stated that the Lion's Club and other service organizations have raised about $33,000.00 for the Memorial Swimming Pool and are short about $80,000.00 and are stymied in their efforts to build the pool. There is a possibility that the Lion's Club may desire to place a special levy before the people to raise this money and the Council can discuss this further at Friday's recessed meeting after the Lion's Club takes action as to whether they would like to place a levy on the ballot. It was commented upon that the group for dancing and entertainment in taverns is proposing to put an initiative ordinance on the ballot. City Attorney stated that the November election would give ample time to conI'orm to the State Law on pet~itions. Mrs. Haddon commented that at the last Friday afternoon recessed Coun- cil meeting she had reported on the recommendation made by Dr. Benham to request an extension oi~ the use of the present dump from the Superior Court Judge. Mrs. Haddon then asXed the City Attorney to explain further relative to this matter. City Attorney stated that he did not believe it is possible under any legal matter to go back to the Court when more than ~0 days have elapsed. Mrs. Haddon stated that Dr. Benham and Sam Reed have been very coop- erative but under the provisions of the State Law shich provides that a dump must be one-half mile from homes she said she didn't know of a place in Kitsap County that could comply in every way, because Kitsap County is thick- ly populated. Mrs. Haddon stated she didn't know what success the City would have to buy a piece of 1And for this purpose; however, she said the matter of garbage disposal is s~ill being worked on. Mo~ion by Mr. Kean and Mrs. Haddon to allow all bills if approved by a majority oI~ the Comm~iss~toners, carried. Motion by Mr. Kean and Mrs. Haddon to recess until 2:30 P.M. Mayor Kean presiding and Commissioner Haddon, Commissioner Wharton, City Clerk McGowan, City Treasurer Nutter and City ~ttorney Wallace being present. City Attorney reported that the Mayor, Commissioner Wheaton~ Mr. Casad and himself met and discussed the conflict in the water ordinance between the rates charged for the South Court Apartments and the rates for the Brem- erton Gardens. City Attorney stated that in order to end the charge of discrimination, separate meters should be installed for each apartment building in Bremer- ton Gardens which wbul~then bring them into the same category as the South Court Apmrtments. City Clerk suggested that the meters be place~ up close to the build- ings. Motion by Mr. Kean ant Mrs. Haddon to accept the progress report and rei~er the matter to the City Attorney to ~lscuss with the Bremerton Gardens, carried. City Attorney stated that he and Mr. Nutter had discusse~ and studied the ordinance relative to merry-ge-rounds and recommen~ that Ordinance No. l~ be ~epealed an~ Ordinance No. 200~ Sections 1E and ~, be amended re- lative to penalties. Motion by Mr. Kean and Mr. Wheaton to approve the proposal an~ refer to the City Attorney for the preparation of the necessary ordinances~ car- ried. Mayor Kean stated that the backers of the Memorial Swimming Pool would like to have the Council more or less sponsor a special levy to raise needed funds; however,· the Mayor said that the city needs money for operating the City government and he didn't know whether the City should carry this propo- sition to the people, and there is ample time to refer to the Lions Club to circulate a petition and have it pure, on the ballot. Clerk pointed out that if the levy was approved by the voters that themoney would not be received until 198~ and registered warrants would have ~o be issued, which would in- volve interest. Mr. Wheaton agreed that the City has need of additional funds for oper- ation and said he believed the pool would cost more than the present figures indicate. Mayor Kea~ remarked that he didn't think the Council should take the re- quested action but should let it go to the people for signatures on a petition. Mr. Wheaton and Mrs. Had~ n s.tated they did not favor sponsoring the swimming pool levy. Motion by ~r. Kean and ~rs. Haddon that in view of the financial circum- stances of the City of Bremerton that the City Council take no action on the swimming pool and neither sponsor nor endorse it, but if the people w~t it they can elect an~ the costs should be displayed, carried. City Clerk stated the letter which E.W. Holb~ook, Central Labor Council, had promised to write had been received, relative to recommended increases in pay in the Fire and Police Departments, adding a clothing allowance for the police officers and adding additional vacation to the firemen for holi- days. Motion by Mr. Kean and Mrs. Haddon to note contents and in noting the contents, where the letter mentions "Council" it should be pointed out that Dhey are referring to the Central Labor Council, and refer the letter to the Committee of the Whole for study at budget making time, carried. Clerk said he had received a requisition from the Fire Department for a number of items on which bids should be called. Mayor stated this is for a smoke eradicator which might be needed in an emergency. Motion by Mr. Kean and Mr. Wheaton that the Cler~ be directed t o c all for bids on these items, carried. Mayor brought up the subject of finances and budgets. Discussion followed relative to methods of raising additional revenue for 1951; also, discussed was the subject of decreases of personnel and the results which would be obtained, such as increased fire insurance rates. The Water Department was mentioned as a possible source of revenue and the City Attorney stated he had requested an Attorney General's opinion as to whether the City can take money from the Water Department to aid in the operation of the general fund. Also discussed was the matter of water department system improvements and the proposed purchase of state lands for watershed enlargement,, Mr. Casad, who was present, commented that the Stat~ lands which the City had made application for purchase, would not be available as the State Forestry Department was taking them over; however, the City could purchase a number of acres from private owners and then could exchange with the state. 4;3O July ~8, 1980 (Con't) q It was stated that the city will be needing $200,000.00 additional rev- enue in 1951o Mr. Wheaton told of the need for finances for repairing two reservoir roofs and of their plans for impounding water by a dam. City Clerk pointed out that money for these purposes could be taken from the Water System Improvement Fund, instead of Current Water Funds, there- by making funds available for transfer to the General Fund. Clerk stated he had talked with Mr. Taylor regarding the' log dump loc- ated by the Sanitation Dump. This is the dump that Mcdonald & Taylor re- ceived f~om Buchanan Lumber Company and paid one month's rent and the City has now received an offer of $~0.00 per month for its use ~from Forrest 0. Jansen. Clerk stated there is no written lease between the City and NcDonald & Taylor; also, that he felt NcDonald & Tayl?r should meet the offer made by Jensen as to the rental fee. Clerk stated that Mr. Taylor had informed him they would need this log dump if it became necessary for them to manufacture their own boom sticks. Nayor commented that McDonald &TTaylor should pay up the two months past rent ana they should have the log dump if they want it, as he wouldn,t want to see their operation slowed down in. future years because of not having the dump. Mr. Wheaton said he felt they should ma~e a statem~n.t as to whether or not they want it. Notion by Mr. Kean and Mr. Wheaton that the City Clerk communicate with McDonald & Taylor, offering them a lease at the price offered by Jansen, or that they inform the City what they tant, ctrried. Motion by Mr. Kean and mrs. Haddon to adjourn, carried. City Clerk
