a building permit by the Building Inspector to build a house on 10th Street

inance.

lumber order~ but would like to know what he should do.
The City Attorney stated that the neighbor, J.A. Smith, had questioned
Mr. McLeod's authority bo issue a building permit to Mr. White, allo~ng
him to have a side yard of three feet. Mr. McLeod had issued the permit on
the basis that more than 50% of the block was built up woth structures hav-
ing less than five feet side yard; however, Mr. Smith has stated that more
than 50% of the block is built up with structures having more than three
feet side yard.
City Attorney stated that Mr. Smith is entitled to some protectionif
he wishes to squeeze the new structure down to 20 feet, or there needs to
be a change in the ordinance.
Attorney said that Mr. McLeod had been following his usual course of
allowing a building with a three foot side yard but the ordinance does not
back him up on this.
Hr. White stated he had purchased his lot about a month ago after he
had talked with Mr. McLeod.
The City Attorney commented that perhaps the ordinance should be changed
to provide for a building like this man wants to ~ut up.
Mayor Kean explained to Mr. White that the City Council can only follow
the provisions of the ordinance and NY. Wallace has referred it back to the
ones who originally drew up the ordinance and asked them if they think they
made a mistake and if they feel it should be' corrected, then the City Coun-
cil may correct the ordinance.
Mayor suggested that Mr. White that he mark time a little longer and
see what ~he Planning and Zoning Commission is going to submit to the Coun-
cil, an~ the Mayor said further he assumed the Council would act favorably
because there are 30 foot lots all over town.
Adrian VanElten and his wife were present smd said they read in the ~
papers where there is to be a new sanitation dump up near Sinclair Park or
Kitsap Lake. They want to know the exact location due to the fact that
water is' draining down from that area and they are concerned over their
water source.
Mr. Robin L. Harris was present on the same issue.

and discussing the matter further~ that time. /

that the Planning and Zoning Commission had thought that in Ordinance 1792
they had taken care of sideyards in 30 foot lots but have now recognized that
this was not a correct assumption.
Mrs. Haddon said she felt this was poor legislation;-however, it was ex-
plained that the trouble stems from the platting done years ago when lots were
set out 30 feet wide and although buildings on such lots crowd each other, yet
nothing can be done to correct the plats now.

City of Bremerton Ordinance No. 212. He said that Spokane had, by ordinance,
adopted rat prooI'ing rules and regulations, which are contained in a resolu-
tion anm are very lengthy; however, he said he did not favor this method but
would like to have the rules and regulations contained in the ordinance itself.
Mr. Wheaton stated he would tame the study of rat prooI'ing as set forth
in the Spokane ordinance and resolution up with the Building Inspector, and
also could include Mr. Reed, the Health Department Chief Sanitarian, and
Walker~ Sanitation Superintendent.

and in the agreement.
John Short, Chief Water Accountan$, stated that Mr. Casad could not be
present for further consideration on the proposed water ordinance and would
like t o have the ordinance helm over until another time so that he could be
heard on the section to do with multiple users.
~ayor sta~ed that ~he ordinance has been held up for a long time and
would like to have it go through; however, Mr. Casad could ask for an amend-
ment later, providing he could persuade'the Council to pass it.

Mayor co~mmented that ~r. Peterson ham asked ii' the building permit fee
would have to be pai~ anm vhe Mayor ~d ini'ormed him this was the practice in
all cases whether or not the City is doing any work.
Mr. McGowan stated he ham been asked to serve on the Lions Club Swimming
Pool Conm~ittee but has asked them to ~nsider someone else as he does no~ de-
sire to act as liaison between the committee and the City, which was what they
desired.
'Mr. Wheaton saim he has been informed the Lions CluO is going to call for
0ids for everything and then only put in Ohe pool and not the bath house.
February 17, 1950 (Con't)
The school property in the Fatland Addition which is being used for a
neighborhood playgroun~ came up for discussion.
Mayor Kean recommended that the Council go on record that the City does
not want this area due to its size. II~ it was twice the size or half as big,
the City might be interested; but not interested in view of the tremendous
expense of improving and equiping it, and would rather work with the school
board on the Lulu D. Haddon school playground in providing a summer program
on school property; that the property should be made available f or anyone
who wants to buy and, also, ir the community intends to acquire i~ from the
school board the City still holds to the original stand that the City does
not want to acquire it either at the present time or at a future time. This
is residential property, having a beautiI'ul view, the Mayor said.
