On January 10, 1951 request was made by the International Truck Agency in
Bremerton to sell them one of the axles, as there was an out of town t fuck
broken down here but no axle parts were available to repair it. In advance
of today's meeting, the Clerk received authorization from the City Commission-

this was a fair price.

Library Fund.
Mr. Wheaton suggested the car may be useable in the Sewage Treatment Div-

Mr. Wheaton stated he had some 6" and 4" wood pips out at Twin Lakes and
asked that it be declared surplus.

Letter was read by Clerk from City Engineer to the Council setting forth
the estimate of cost of a sanitary sewer on Lafayette Avenue fro~ First Street
to a point 2S0 feet north of the'centerline of Coontz Street, and stating that
an L.I.D. should be formed by the Council and'not by petition. This estimate
was made as a result of a complaidt letter read at last Council meeting from
a resident of that area, which letter was referred to the County-City Health
Board and in turn referred to the City Engineer. The total estimate was $1,
959.00, and for side sewers to be installed, if necessary, at property own-
ers' expense, $4~.25.
~r. Wheaton stated this piece of work is essential and useless to ~y to
build an L.I.D. by petition and the Health Department has recommended it be
done by resolution.
Jimmy Skirving was present and spoke in favor of ~he improvement, as
~is I'irm manages a house there Which is in need of sewer correction.
Question arose as to whether or not this improvement could be included
in the sewer district which has been underway near there and it was stated
that it was too late to do this.
Motion by Mr. Wheaton to do this job by Resolution and ma~e anL.I.D.
out oI' it.
Mayor questioned the cost of such a small district and ~r. Severance
was called in and discussed the cost, stating the property owners would have
to pay and there would be some objections because of charging some who may
already be connected.
Discussion was held as to the legal procedure in starting an L.I.D. by
resolution and the City Attorney stated he was not familiar with hhis method.
~ayor suggested in view of the fact there may be some complaints it would
be well to go a little slower and refer to the City Attorney to check the pro-
ced~ree
Engineer assurred the Council the cost of the LJ~.D. would not be exorb-
itant and stated this area was not included in the other district because there
are a lot of unknowns in the problem there and a sewer in the alley would have
done the property owners no good.
Mr. Wheaton withdrew his motion.
Notion by Mr. Kean and ~Ar. ~heaton that the recommendation of the City
Engineer be referred to the City Attorney and the City Engineer for consider-
ation and the preparation of any papers deemed necessary for Council action,
carried.

follows: Mr. Kean, Yes. Mrs. Haddon, Yes. Mr. Wheaton, Yes.
City Attorney stated he ha~ received a letter from Garland & Garland, law
firm, relative to the renewal of the Marin~ Drive Water District contract
which expired recently. A question is involved in re-writing the contract so
that the 20% now turned over to the District by the City would not go to the
School District in the event of dissolution of the District.
Attorney said in his opinion that under the p~esent S~ate Law any funds
left in a Water District, when dissolved, must go to the School District. City
Attorney questioned the reason for paying the water district the 20% ahd have
~he ~istrict accumulate funds.
Discussion followed and ~r. 'Nutter explained the reason for the refunds
was that the district had bonds ~ redeem but that now they have been redeemed.
City Attorney asked that the matter be referred to him and he would tale
up the matter with Mr. Casad.
Motion by mr. Wheaton and I~r. Kean to refer to the City Attorney, carried.
Attorney read a letter he had received from the City Engineer, dated Jan-
uary 17, 1951, setting forth the cost of complying with theconditions for an
easement from Mrs. Snyder for the laying of a sewer on a private drive connect-
ing the North end of Taft Avenue proposed sewer to the Snyder Avenue sewer.
The cos~ would be $2,9~7.~0, and would necessitate a chmuge order in the Lent,s
contract.
Mrs. Snyder's attorney has asked some question on restoration of the land
and the dsmage to ~he fruit trees there, and it is now agreeable t o give the
easement with some protection.
City Attorney said he would like to discuss thismatter further with Mr.
Severance.
Notion by Mr. Kean and Mr. Wheaton to note contents and refer the c ommuni-
cation back to the City Attorney and the Engineer for the preparation of any
papers in connection with this work, carried.
City Attorney stated he had checked the warranty deed which the City re-
ceived from Horn and Hike several years for the sum of $500.00 and ~hich states
there no exceptions; however, it has now been found that the property was en-
cumbered with an easement to the Bonneville Power Administration. This is pro-
perty used for gravel pit purposes.
January 16, 1951 (Con't)
Attorney stated if the City took the $500.00 back from the former owners
it wouldn't be much toward the moving of the power line and this is a matter
for the City Council to decide as to whether or not pressure should be brought
on the former owners to the extent of their liability.
Mr. Wheaton commented that Bonneville is going to put in another line near
there and they may be able to move this single line at that time. He suggested
that he might make a trip to Portland to see what is being done and check on
the matter as there seems to be some unreaso~ able costs in moving the line.
Motion by Mr. Kean and Mr. Wheaton to accept the progress report from the
City Attorney and City Engineer for further negotiation and settlement, carried.
Commissioner Haddon stated her department was having some difficulty giv-
ing garbage service and suggested reducing, by 25%, the bills which go out on
Febeuary 1st and February 15th.
City Attorney discussed the provisions of the ordinance and the question
oI~ legality of giving a reduction was also discussed.
Mrs. Haddon recommended the 25% reduction be appro~d and Mayor Kean stat-
ed he had no objections but suggested this should be done by resolution for a
future record and the City Attorney stated he would check the ordinance before

majority of the Commissioners, carried.
A lengthy discussion was held relative to the hearing held yesterday by
the Civil Service Commission on the discharges ibr cause of the Garbage De-
partment employees.
Strong exception was taken by the ~ayor to the fact that the Civil Ser-
vice continued the hearing and did not rule on whether the City Council acted
according to the Civil Service nules and ReEulations in effectingcthe separa-
tions.
Mayor discussed his activities at the State Legislative Session relative
to securing a current census bill so that a census board may b e set up and
mo~y apportioned each year on the current census instead of using the 1950
census until 1960.

relating to annexations; also, Mayor Kean commented that the cities should
