The City Clerk read Payroll Voucher for the period ending July 15, 1955 in the amount of $44,849.17. Motion by Miss Cullin and Mr. Wheaton to approve the voucher, carried. The City Clerk read a letter from the First Presbyterian Church of Bremerton in which they made an offer to purchase Lots ll, 12, 13, ~4~ l~ and 16, Shepherd,s Addition for the sum of $2,500~00 under the following terms: ~500.00 down and not less than $25.00 per month plus interest. A check in the amount of ~500.00 was enclosed. The City Clerk remarked that while there was no state law or charter provision which required the City to sell property by sealed bid or public auction, it had been the custom and any deviation from that custom'might establish a bad precedent. Reverend Wilbur Scale was present and stated that the Ohurch hoped to acquire the property for temporarY use as a parking lot and l~ter to construct a Christian Youth Center. Attorney Holland said that the City could either sell by public auction or draw a resolution authorizing the City Treasurer to dispose of the property by neg- otiated sale but that the resolution should set forth detailed reasons for such pro- cedure. Motion by Mr. Wheaton and Mr. Domstad that the City sell the lots by public auction and that a notice of such sale be published in ~he official newspaper, car- ried. Mr. Domstad read a letter from the United Stated Department of Justice, Fed- eral Bureau of Investigation, signed by Richard D. Aurbach, commending Police Chief Lewis and his traffic division for being one of the twelve cities of the United Stateg to receive the Traffic Safety Award. Mr. Domstad stated that he had received a letter from American Legion Post No. 68 relative to their request for a corrected deed to the property which they had purchased from the City several years ago. The deed as written provided that in the event the Post decided to sell the property the City would have first op- tion to purchase at the price at which it was sold, plus improvements, less de- preciation. They wished this restriction removed from the deed. The City Attorney stated that if the Council chose they could have a correct- ion deed drawn or could fail to exercise their priority and permit an unrestrict- ed sale by the Legion Post. Mr. James Skirving and his Attorney, James O. Arthur, were in attendance at the Meeding and stated that an error had been made in the vacation of a portion of Ninth Street adjacent to his property in Oyster Bay Addition to Port Orchard Navy Yard, and as a result he contends that he did not get all the property in- cluded in his petition to vacate. After some discussion it was suggested that he submit another petition cov- ering thepiece which had been excluded which he did before the close of the meeting. The petition was referred to the City Engineer for study and a report back to the Council at the next regular meeting. July 20, 1988 (Con't) The subject of the Watershed Contract was brought up for discussion and Mr. Casad spoke in favor of the agreement and urged the Council to approve a proposal contained in a letter from Taylor and Bruckart which.propqs~d renewal of the old contract with some changes which would give the City 53 1/3~ of the Proceeds of the sale of the log rafts and $10.00 instead of $~.00 for short logs. City Clerk McGowan stated that he felt that.the CoUncil should wait until the contract had been drawn and read in the customary manner before approval was given. City Attorney Holland said that the proposal as made in the letter could be approved at this time or the Council could approve it by resolution. Miss Cullin stated that she was opposed to the renewal of this contract because she did not think that the same company should be doing the forestry and the logging. She thought that we should have a forester go through the watershed and mark the trees to be cut and then put those trees up for bid. She also felt that the City would receive more money this way. Mr. Taylor took issue with Miss Cullin on several statements made in a news- paper interview relati~ to the logging operation and stated that he thought that the Council should accept his proposal. He further stated that he had made a full report of his opeation to each member of the Council except Miss Cullin and he felt that if he could explain it to her she would understand the situation batter. Mr. Ray Greenwood, Attorney, who had entered the Council Meeting was asked by Mr. Domstad if he had something to say to the Council. Mr. Greenwood stated that only an hour before he had found something in the R.C.W. $0.A80.10 which leads him to believe that the City is required to call for bids in a situation of this king and he proceeded to read from the Code. Mr. Domstad said that the agreement could have been approved at the last reg- ular meeting but he thought everyone should have an opportunity to be heard. He then called upon former Mayor L. "Hum" Kean and J.F. McGowan, who were also in at- tendance but they each stated that they had nothing to say. It was then moved by Mr. Wheaton and seconded by Mr. Domstad that the proposal of Taylor ~and Bruckart be accepted. The motion carried as follows: Mr. Domstad, Yes. Mr. Wheaton, Yes. Miss Cullin, No. Attorney Holland said he would have a contract prepared for signature at the next regular meeting.
