The Mayor and the ~ity Clerk thereupon signed the deed, inasmuch as the trans-
fer of the property was approved by motion of the City Council on August 29, 1956.
Mrs. Clarence C. Bressie, 1044 ~urwell, appeared before the ~ouncil relative
to the sidewalk improvement program and stated there was a wide difference between
two estimates to repair her sidewalk.
After, discussion of her problem Mayor Domstad asked Asst. City Engineer Bill
Engler to go over the matter with Mrs. Bressie.
Mr. Elmer Herreid, 603 Eleventh, stated he had repaired his sidewalk and then
it had settled too far and then he had done the work over and one square had settled
down about 5/8" and he doubted that anyone woul~.~ stub his tow on this sq~are.
~e was advised by the City Engineer that an inspection would be made of all re-
pairs before the ordinance is drawn wherein the City would do the work through its
contractor and that those who haven't passed inspection or haven't done the work
would be put in the ordinance.
Discussion was held as to liability of cit and property owners when claim is
made for accident occuring on sidewalks and it was pointed out that people have
claimed damages for falling on very minute sidewalk failures.
Mr. Mosbarger, 811 Park Avenue, stated he had received two different estimates
of sidewalk repairs; also wondered if citizens could use blacktop material to fill
in on their walks and save the expense of putting in concrete and said the City had
~one this in the past.
Mr. Wheaton explained the material was not blacktop but a special preparation
but ~h~t it was necessary to use concrete in order to bring the walks up to proper
standards.
Ben Bledsoe, lO18 - 9th, stated the only persons who use the sidewalk that runs
by his place are those going to the Warren Avenue Playfield and he didn't feel it ',,
was his responsibility to maintain a piece of property when us~d ,exclusively by
t~ose who patronize the City playfield. Mr. Bledsoe also claimSd that the, sidewalk
damage was caused by maple trees and thao around 1932 he had purchased the property
and lated had asked City Officials if the trees could be removed but they would not
grant him permission although later on he was allowed to remove one tree at his own
expense. Mr. Bledsoe asked the Council to consider his problem.
Mr. C.C. Baer, 1535 - 5th, discussed estimate'of repairs for sidewalk at some
property he own on Burwell Street and stated there appeared to be two different:':~
estimates.
Assistant City Engineer Engler went over the matter with l,'~r. Baer and it seem-
ed that there was a question of ownership on part of the sidewalk. Mr. Engler was
going to check further into the matter.
Mr. McGowan pointed out that the ordinance covering sidewalk repairs was passed
several years ago but it is ~ust now being implemented.

tion with several persons, including the Police Department and Teamsters Union,
and that the Police Department does not know where to locate you and the Union

not accept a place below the YMCA as he might just as well be out at 6th & Callow.

that he t ought the unions have nothing to do with the matter and it was his op-
inion it is coersion between the Union and the ~ity Officiala.
