Kenneth C. Nason, 2~18 East 18th, stated their street had been disrupt- ed by the improvement and said she had heard conflicting reports as to Just what oiling or blacktopping the city would do. Mr. Wheaton gave the gighlights of the type of blacktopping that is done un- til a permanent improvement district is put in at their district which is adjacent to L.I.D. 264, and stated that the City was going to do some work where the street was disrupted. July 11, 1956 (Con't) Mr. W.B. Staerwaite, 2315 Cascade Trail, made same protest as at a prior Council meeting on this same improvement district, in that he did not agree with the zone and termini method of figuring 'assessments and that he felt the assess- ments went too great a distance away from the actual improvement. Mr. Saterwaite filed a copy of his complaint at this time with the Clerk and stated he might event- ually make a court test case and in the meantime probably pay the assessments under protest. Mr. Charley Miller, 2322 Terrace, wanted the street to 0e made passable and further discussion was held on Just exactly what the City intended to do to put the street back into shape. He complained that no work has previously been done on his street. Mr. Wheaton pointed out that now the improvement was in there would be mainten- ance work done on the street; however, he made it clear that the City hasn't enough funds to do street work and that iw as recommended by Municipal League last ~ ar that the City do no work on the streets unless property owners paid for their wwn work. Mr. McGowan made it known that the concrete streets were paid for by property owners through local improvement districts and did not come out of tax dollars. The protests being insufficient to hold up the assessment, the Mayor asked for the reading of the ordinance. Clerk read Ordinance No. 2181, "An Ordinance adopting a~ confirming k~e Assess- ment roll for Local Improvement District No. 28A, providing for the improvement of Nipsic Avenue from East 17th Street to Cascade Trail and East 18th Street from Nip- sic Avenue to 332.58 feet West, as in said Ordinance desc~bed; providing for the levying and assessing of the costs and expenses thereof against the parcels and lots of land between the termini and within the boundaries of said improvement district, providing for~the collection thereof; creating and establishing a special fund there- Fore, and Fixing the date of the issuance of the bonds in payment thereof." Wheaton recommended the City Council approve the ac- tion of the Planning Board. July 11, 1956 (Con't) Clerk read the letter which stated that the proposed ordinance would be a ~uplicate of present state statute which imposes higher penalties for convictions than the proposed ordinance but that he would defer in his objection to the new proposal which is also before the County Commissioners if Judge Ryan, Juvenile Court Judge, felt that the additional ordinance would mend anything at all. The letter further stated that he had discussed this matter with Judge Ryan and the Judge ~oncurred in the Prosecuting Attorney's opinion that existing laws are su~- £1cient a~d that while he and the ~udge had no particular objection to the City ~rdinance, they felt the matter already amply covered by State Law. Mayor Domstad stated he had talked with Judge Ruan this morning and he is not opposed to the ordinan e but the ordinance would be tabled for one week until we can meet with Judge Ryan. Mayor stated the Chief of Police was in accord to wait one week. Commissioner ~ullin stated she hated to see the ordinance tabled and Mr. Wheaton stated he would be absent next Council meeting but he wanted it on record that he is in favor of passing the ordinance but would agree to tabling for one week. Mr. Holland pointed out that the attitude of Judge Ryan as shown in the news- paper is not the same as given out by the Judge and that Judge Ryan was invited to meet on the ordinance but was unable to attend at the time. Miss Cullin stated that ~he City Treasurer had shown her some trade stimulant boards used for cigarettes and the boards have a typed slip on them which covers a printed statement about cash payments for certain punches. She said the slip of pa~er is attached by celophane and would be easily removed and it is difficult to inspect places where boards are used. Miss Cullin suggested that consideration be given to returning to the ~% rate on cigarette boards. MrA McGowan agreed with Miss Cullin that the percentage should be returned to 4% and Mayor Domstad stated the matter would receive further investigation.
