Present at this meeting were Commissioner Wheaton, City Clerk McGowan, City Attorney Holland and City~Engineer Severance, Absent was Com- missioner Cullin. Also in attendance were representatives of the press and radio and several interested persons in the establishment of a L.I.D. on Marguerite Avenue. Motion by Mr. Wheaton and Mr. Domstad to approve the minutes of the previous regular meeting and recessed meeting as written, carried. City Clerk announced this was time and place for he,ring on proposed local im- provement district on Marguerite Avenue for sidewalks, curbs and gutters and stated he had received a protest bearing eleven signatures, first signer Charles D. Larson, protesting cost as excessive and grade unsatisfactory. City Engineer stated contract holders cannot sign protest and two signers, Schu- bert and Green, could not be counted on the protest petition; also, stated the pet- ition had been checked by his office and there were 63.4%, barring the two erroneous signatures. If these two were deed holders the protest Would be 45.?6% and it re- quires 60% to nullify an improvement. City Engineer stated he believes that there were sufficient written protests and that according to law the improvement would have to continue as originally petitioned, and therefore, he recommended the adopt- ion of the ordinance ordering the formation of the district. Motion by Mr. Wheaton to accept the Engineer's recommendation and order the im- provement. Mr. Dommtad stated the meeting was open for discussion and a Mrs. Kelly spoke, stating she lived on l~th Street, was notified her assessment would be nearl~ $~00. and said she was not in favor of the improvement because it would not improve her property. She~was informed by Mr. McGowan that the people on Marguerite helped pay for her sidewalks when 18th Street was improved. Charles Larson, 1920 15th Street, corner of 15th and Marguerite, wanted assur- ance the sidewalk would not wash out because would be built on fill and no bulkheads; also, protested fact that his bulkhead would be removed and not rebuilt; also, com- plained that he wouldn't be able to get out of his garage because of the sidewalk grade. Mr. ~heaton assured him that sidewalk would not wash out due t o manner it is to be constructed; and also stated that as the construction proceeds the grade may be altered if feasible; and the City Engineer, through questioning, brought out the point that the bulkhead referred to is on street right of way. Mrs. W.F. Lawrence, 1550 Marguerite, stated she was in favor of the improvement in order to correct swampy condition in her yard due to rain water drainage. Mr. Severance stated that the improvement had to meet the 18th Street grade but adjustments to grade as possible when const~uction is underway. Mr.E.C. Best, 1524 Marguerite, stated was protesting on the grade and that be- lieved the petition establishing the desire for an improvement was misleading be- cause he said he thought the petition s tared the Job wouldn't go over $5.00 front foot and if over $4.80 the L.ID. wouldn't go through. Mr. Severance answered that no estimate would be given out until the notices are mailed out. Mr. Best also complained about drainage because sidewalk would be put in above property and Mr. V~heaton pointed out that the engineers would see that the Job was done to the best advantage; als, Mr. Wheaton pointed out that the city would do quite a bit of extra work in connection with bhe job which wouldn't be charged to the property owners, including blacktopping. Mr. Forbes, lB11 Marguerite, spoke in favor of the L.I.D. in that the sidewalk would help to protect children by providing a boundry line between private property and the street. Mr. Ireland, 1S20 Marguerite~ stated that Mr. Severance had told him cost would be $4.85 a foot but that he didn't think anybody was protesting the cost but the grade and if this canbe worked out that the L.I.D. will be satisfactory to every- body. Mr. Severance stated bids can't go over estimate which is ~5.80 front foot, and Mr. Wheaton pointed out that if the bids are over the estimate that it automatically knocks out the Jo0 unless the property owners came in and wanted the Job done and would agree to pay the extra. ~ , . Mr. Wheaton assured the people he and Mt. Severance woul~ ~ersonally. g~ to the job and would raise and lower sidewalks wherever it can be done but stated that due to the way the streets were put in originally it has made it hard to put in im- provements. Mr. Severance explained to Mrs. Kelly the method of assessing according to zone method. Motion was seconded by Mr. Domstad and carried.
