Motion by Mr. Wheaton and Mr. Domstad to pass Eesolution No. 921, carried. Clerk stated he had for reading an ordinance relating to second hand dealers and that several interested persons were present for the read~hg and possible ~s- cussion. Clerk then read Ordinance No. 2176, "An Ordinance defining and regulating sec- ond-hand dealers and the sale, trade, barter or exchange of second-hand goods, re- quiring second-hand dealers .to procure licenses and keep records, amending Ordinance No. 1S~l as amended by Ordinance No. 2029, and declaring an emergency." Three second-hand dealers were present, Richard Dalton, Ralph ~arling and F.O. McCuiston. City Attorney Holland explained the definition of a second-hand dealer and stated the s~ate lmw required the city to exercise police powers in their case be- cause of possible handling of stolen goods and that the state lmw did not extend the authority of the city over those firms selling new goods and not buying second- hand goods for resale or taking second-hand goods on consignment. I~ was the contention of ~r. Dalton that stores selling new merchandise and taking trade-ins should also be included but Mr. Holland reiterated the provisions of the state law. After discussion relatingtto the possibility of including any store whic~ took in used goods even as trade-ins, Mr. Holland advised the visitors that the place to take up any change in the law would be at the next session of the State Legislature because the city was required to exercise police enforcement of second-hand de~ers~ Mr. Darling spoke in favor of the ordinance; and he mentioned that this would stop chiselers so long as it was properly enforced. Motion by Mr. Domstad and Mr. Wheaton to pass Ordinance No. 1S~l, carried. Clerk read Ordinance No. 2177 "An Ordinance defining and prohibiting shooting galleries and penny arcades, defining and providing for the licensing of automatic vending machines and amusement devices, repealing Ordinances No. 1668, 1678, 1537, 1872 and 1889 and declaring an emergency." City Attorney explained the import of ~his change in the ordinance in that all ~usement devices would now be included and the fee for licenses would be more real- istic so there would be the avoiding of licensing certain amusement devices because of the former high fees; also, by repealing the former ordinances it would make it easier to read the provisions rather than have to refer to several ordinances. This ordinance would make it possible for operators to bring in machines that they former- ly wouldn't pay the high license fees for and thus the city should receive more rev- enue than under the old ordinances. June 27, 1956 (Con,t) Motion by Mr. Domstad and Mr. ~eaton to pass Ordinance No. 2177, carried.
