against the users.

After~ discussion of the matter Mayor Domstad asked that representatives of the
users meet with Mr. Wheaton in the Mayor's Office Friday morning at 10:00 A.M.
The Council meeting mas recessed for about five minutes at this time so that
Mr. Purvis of Purvis Construction Company and his attorney may have a few minutes
before presenting the matter of the new Manette reservoir before the City Council.
The City Council met after about five minutes of recess with the same persons
in attendance and Mr. Harold Tollefson of Tacoma, an attorney, spoke on behalf of
his client, Mr. Purvis. ~!
Mr. Tollefson asked that the City Council consider the payment to M~' Purvis
for the extra concrete used in the base of the Manette Reservoir, statin~ that it
was necessitated by soft and wet ground and that all work slips for the extra con-
crete were approved by the inspector who represented the consulting engineer, Mr.
Cunntngham, and ~he City itself.
After Mr. Tollefson had presented the case for Mr. Purvis, Mr. Cunningham sta-
ted he recommended that the City Attorney and Mr. Tollefson negotiate and see if
some agreement can be reached.
Both Mr. Cunningham and Mr. Casad stated they were not aware the extra cement
was being installed until after the base was completely p~nred, and Mr. Cunningham
stated he did not believe the extra concrete was necessary to have been placed.
Commissioner Clark reviewed his stand on the matter and referred to a number
of provisions in the contract.
Motion by Mr. Clark that the City follow the recommendation of the Engineer
and deny the payment of the extra concrete and follow the clearly written contract
and assess the penalty. Mayor Domstad annodnced after a few moments that the motion
had died for lack of a second.
Mayor Domstad called on Mr. Wheaton who reviewed the need for some extra con-
crete in both the walls and the base but that he did not know anything of the large
area where extra was put in.
Mr. Wheaton recommended that the contractor be paid for the extra Concrete at
the unit price of $20.00 per yard instead of the $66.80 on the premise~that extra
concreto had to be put in. Also, Mr. Wheaton recommended that the penalty of $50.00
per day not be assessed.
Discussion was held as to need for recessing until the afternoon so t!~at an a-
greement could be worked out between the parties.
