City giving preliminary 1960 population figure for Bremerton, received from the U.S.
Bureau of Census, of 26,564.
Clerk read letter dated August 9, 1960 to City Council from Ronald Danielson,
Municipal Judge, which stated the bank deposits, picked up by an employee of ?eoples
National Bank of Wash., are not covered by the bank by its insurance until the money
reaches the bank's teller; that if the City wishes to continue this pick-up and de-
livery service, the bank has asked the City to execute the attached hold harmless
a~reement.~
Mr. McGowan read a clause from the City's insurance policy wht(~h showed the City
was covered for any messenger loss whether an employee of the city or not.
The City Attorney co:~mented that this concerns an error in the City's deposit
rather than theft or loss and the bank was responsible for the amount of t~he deposit
when picked up; that an error occurred and the bank got caught for $100.00. Mr.
Holland suggested the matter shoul(! be discussed with the bank manager and obtain de-
tails.
Motion by Mr. Domstad and Mr. Clark to table the matter for the time being and

Clerk read proposed contract for furnishing water and services to Marine Drive
Water District by the City of Bremerton.
City Attorney explained there are three changes in this revision of the contract:
(1) District may have certain work performed by a private contractor, if it can ob-
tain this at lower cost than by the City; (2) the City will'!not charge a different
rate than any other consumer in the same classification out2ide the City Limits; (3)
that any funds acquired by the City as a result of the annexation of a part or of
the whole ti' the district, shall be placed in a special fund by the City and shall
be used for maintenance and betterment of the water system within the area annexed.
Mr. Clark suggested to eliminate any misunderstanding in the future about the
funds mentioned that the agreement state t!~ese would constitute assets of the dis-
trict only. This would then make it positive that the funds would not include those
received from taxes, etc. of the annexed area.
Mr. Htumble suggested that it might be desirable to add at the point where pri-
vate contractor is mentioned, that the work ~o done must be to city specifications
and conform to the standards of the city and should be inspected by the city.
City Attorney stated he believed this was covered in the agreement but he can
get together with ~'Ir. Humble to make certain it properly covers the matter.

changes being made, carried.

$450.00 per month from the present $413.00 with corresponding raises for the other
members of the departments.
MayQr Domstad assured Capt. Balazic that the Commissioners will give every con-
sideration and will meet with the. co-ch~irmen at the proper time.
Clerk read ~An Ordinance providing for the vacation, removal, repair, or demoli-
tion of any building or structure which, is, or threatens to be, a public nuisance
dangerous to the health, morals, safety, or general welfare of the people of the City
of Bremerton or which might threaten to constitute a fire menace; and for the assess-
ment of the cost of vacation, removal, or demolition thereof as a lien or assessment
against such premises; and to provide for the recovery of such costs in an action at
law; and imposing penalties for the vkiation thereof."
Commissioner Clare stated he was in favor of this ordinance but asked that a
]light amendment be made, due to fact the ordinancescarries a lot of power. Mr. Clark
requested a change be made to Section V, on page 4, that the five members to compose
the "Commission" be appointed.by the Mayor and the City Council, and any replacement
(page 5) be appointed by the Mayor and City Council, rather than in each case by Mayor
with the approval of the City Council.
Motion by Mr. Clark and Mr. Domstad to approve the ordinance on first reading with
those changes, carried.
Motion by Mr. Domstad and Mr. Clark to pay all bills that are approved by a maj-
ority of the Commissioners, Carried.
Commissioner Clark stated that in recent Council meetings discussion and refer-
ence has been made of a memorandum decision of Judge Johnsen with reference to the
reservoir case and up to yesterday he had nOt seen a copy of this decision; that the
City Attorney yesterday furnished him a copy and due to the fact it has been referred
to but not read up to yesterday, Mr. Clark asked that the City Clerk read the memo-
randum dec'ision into the minutes.
Clerk read the memorandum decision of Judge Johnsen.
City Attorney reported that Judge Johnsen stood by his decision in the Kuphal
case. Two weeks ago Monday the c.se was argued and the Judge refused to change his
mind and last Monday Findings of Fact, Conclusions of Law and Judgement entered and
the Judge agreed to change one line more favorable to Kuphal. City Attorney stated
he asstm~ed they will appeal within 30 days.
City Attorney stated there had been a lot of criticism placed on the answer filed
by the City in the Purvis Const. Co. case and it looked like the City ~as answering
for Purvis; that the only reason was to advise the court the city had certain claims
and Put vis had certain claims and the City was not saying the Purvis claims were true
but the City's claims were true; and Purvis claims just used as a basis of making the
City,s claims; that they were shown to set forth the conflicting claims of the two
parties. Mr. Holland stated he hadn't heard from Attorney Tollefson although he was
notified Thursc~ afternoon that there would be no hearing Monday and tiLat he was ord-
ered t~ strike the proceedings then before Court.
Mr. Humble asked for authorization for the Water Department to call for bids for
4~ yards of conc~ete and B,O00 feet of form lumber to be used to build a small wall
behind Reservoir No. ~ to keep silt and leaves out of the reservoir; and stated money
is in the budget for this work.
Notion by Mr. Oomstad and Mr. Clark to give this authority, carried.
Mayor Domstad stated that Mr. Champers was here this morning at the meeting and
was representing the state highway department at the bid opening, and he will have a
report back by next Wednesday on the bids.
City Engineer explained that the bids have to be submitted to the State but it
is anticipated that the award will be recommended to the low bidder.
Discussion was held on the Marine Drive Water District agreement and the propos-
ed ordinance on inspecting and removing unsafe and insanitary buildings.
It was pointed out by Mayor Domstad that Tacoma has used this ordinance satis-
factorily for a number of years; also, City Attorney Holland stated that Tacoma had
used the ordinance and it had never been tested in court.
~r. Holland stated that inspections would be made of apparent violations by the
~ealth Dept., Bldg. Dept. or Fire Dept.; that they have power under present ordinances
to do so or may do this under this proposed ordina~ce.
Meeting adjourned.
