Clerk read Resolution No. 1129, adop.ting rules and regulations for the operation of Ivy Green Cemetery and rescinding Res. No. 863. Mr. Clark briefed the effect of the resolution, stating it was designed to bring prices up to present day costs but still lower than commercial cemeteries; also, the major part of the receipts will not go into the perpetual care fund since the fund can never grow up into a completely sovent fund for perpetual care. Motion by Mr. Clark and Mr. Domstad to pass Resolution No. 1129, carried. Clerk read an ordinance, first reading, "An Ordinance relating to perpetual care by the City of Bremerton in the Ivy Green Cemetery and amending Sections 2, 3, 4 and 5 of Ordinance No. 804." Motion by Mr. Clark and Mr. Schoneman to approve the ordinance, carried. Clerk read letter dated April 24, 1961 from Austin Clark to the City Council re- commending to the City Council that a call for b ids be authorized emboydlng, in gen- eral, a number of provis~ions which were set out fully in the letter. Briefly, the recommendations covered a slight upward revision in rates to the consumer; cost-of- living factor for future rate adjustments; ten-year term, with bid opening date pro- bably June lst; extension of time on present contract to give continuous service (agreeable with present contractor, Mr. Morelli); a franchise tax of 6%; provide the City upon request with data on the accounts being serviced and allowing City to in- spect the company's books; providing for rate schedule for the Housing Authority; providing for dump-site to be obtained by the contractor except the city may elect on proper notice to use Lebo Field for sanitary fill and thereafter a progression of sanitary-fills if desired by the City; and the bidder to offer an additional percent- age to be specified by him from the gross receipts wi~t~ and without doing the billing work themselves; and the city to reserve the right to reconsider the question of going back into municipal garbage operation if bids rejected due to insufficiency of the bids. Mr. McGowan then read the proposed garbage rate schedules. A new rate would cover over 60 ft (15 steps), which would fit such new areas as now being annexed where the possih[ity exists of a long haul. The letter recommendation also stated that the extra receipts to be paid to the City would be set aside into an accumulative street improvement fund to match State funds under Senate Bill #4. Mr. Clark implemented his recommendations with a statement concerning the fact that the rates would be set as ~ar as the customer is concerned but it would be up to the bidder to determine how much he could give the City over the franchise tax which would be a determining factor in making the award. Mr. Clark also disaussed the reserve fund which would be set up for street im- provement matching. Motion by Mr. Clark an~ Mr. Domstad to authorize the c all for bids, carried. April 28, 1981 (CON'T) Mr. J.K. Greenwood, 120 Bloomington, asked questions concerning what would hap- pen to the funds set aside in the cumulative reserve which funds woul~ be derived from the garbage contractor. Mr. Cla~k suggested clesing out the Austin Cain appeal on his rejection for a taxi driver's permit by approving his application. Mr. Clark stated that under the terms of the ordinance an application may not be rejected but a taxi driver's permit may be taken away after issuance upon certain violations. Mr. Clark's feeling was that to leave the decision as presently stands, it might do injustice to Mr. Cain in the future. Mayor Domstad stated he was presently working but did want to submit his three reference letters and that the Mayor had contacted Mr. cain's wife who gave this in- formation. Mr. Clark stated he did not feel the letters had any bearing on the matter. City Clerk McCowan suggested extending the hearing until next week which wa~ agreeable to the Mayor and Mr. Clark. Motion by Mt. Clark and Mr. Schoneman that the Council postpone the hearing until next Wednesday at which time the Council will make decision with or without the let- ters, carried. commissioner Schoneman asked for authorization to obtain the services o? a con- sulting engineer in connection with re-roofing Reservoir No. ll. Motion by Mr. Domstad and Mr. Clark to authorize Mr. Schoneman to obtain the ser- vices of a consulting engineer in connection with re-roofing Res. #il, carried. Commissioner Schoneman stated that clean-up week was next week; that Mr. Skirving ~as opened his dump site May 5, 8 & 7 for free to any of those who would like to a- vail themselves of the free dumping privilege. Commissioner Schoneman extended than~s to Mr. Skirvtng for this courtesy. Mr. Schoneman stated that during the week some portion of Lebo Field will be a- vailable for this purpose; also, the Street ~ept. equipment will be available for home pickups upon receiving a call at the Street Dept. office. Mrs. Gawenka stated she was present concerning obscene literature regulations; that she understood the City Ordinance No. 325 was to be amended ~o bring it up to date with State Law; that she had referred Mr. Holland's letter to Prosecuting At- torney Walgren and it meets with his approval; also, she said she understood that any finances received from enforcement on this ordinance within the City would be turned over to the City. Mayor Domstad stated he had been gone from the City and Just returned last night and had not gotten this matter on the agenda; however, he felt that action could be taken today if agreeable with the Commissioners. Motion by Mr. Clark and Mr. Dommtad that this matter be referred to the City At- torney for drafting the amendment, carried. Joe Weiget, Health Dept. Sanitarian, stated his department has a proposition for an amendment to the milk ordinance to bring it up to the Stat~ Law.~ Mr. Holland suggested adopting the State Law but Mr. Bennett, also of the Health Dept., stated there were complications by doin~ it that way and suggested an amend- ment only. Mr. Bennett then gave his readon for the request, stating that this is a No. 2 area on bidding for supplying of milk for federal installations and that the federal government only accepts bids from the highest rating~ for instance from dair- ies in Seattle, because the local dairies cannot comply with their specifications. Mt. Bennett stated it would be less costly to amend the ordinance and not adopt the milk code in full. Mayor Domstad stated this could be discussed with Mr. Holland and get it on next Wednesday's agenda. Mr. Lytle of the Phinney Bay Water District, thanked the City Council for solv- ing his problem by the annexation of the new area because the city would now be res- ponsible for the expense of changing a 2" water main to a 6" water main to serve a hydrant instead of the district. Mayor Domstad stated he was absent last Saturday, Sunday and Monday and was in attendance at State of Washington Tourist Committee of which he is a member; that the conference was worthwhile and a good part of the time was taken up with Century 21 World's Fair; also, he toured Naval establishment at Whidby Island and met with the Chief of Police at Mt. Vernon concerning new'parking system which the City of Bremer- is studying. Mayor Domstad stated he would be speaking to the Cham~r of Commerce on this shbject. Mayor Domstad stated that on Saturday, April 2~th, at the Naval Avenue School, there would be held the first Puget Sound AnnualSafety Conference; that he had~ked the Governor to be present but he was not sure he could because of a youth conference at the Capitol this weekend. Also, stated there would be a luncheon served by the school and he believed it would be a "survival" lunch. Mayor Domstad stated that beginning May 1st there would be a clean-up paint-up month which would start with the school children; that a prize would be given to the school doing the best job of cleaning up the school grounds. This is sponsored by the Fire Dept and Chamber of Commerce. April 26, 1961 (CON'T) Motion by Mr. Domstad and Mr. Clark to pay all bills that are approved by a ~maJority of the Commissioners, carried.
