with Mayor Jarstad presiding. Also present were the following: Commissioner Clark,
Commissioner Schoneman, City Cl~rk McGowan, City Attorney Fisher, Fire Chief Tillett,
City Engineer Mebus, and a representative of the press.

corrected.
City Clerk read a change of pay ~or WILLIAM C. MAVES, JR., Civil Service Eligible
from Patrolman first year to Mtr. Patrolman first year from $449.45 to $459.55 per
month effective September 1, 1965.

August 2?, 1965 (Cont'd)
City Clerk read Ordinance No. 2648, AN ORDINANCE providing for and establis~ing the
office of Assistant Chief of Police, declaring an emergency, and rescinding the passage
of Ordinance No. 2643.
Motion by Mr. Jarstad and Mr. Cla~k Ordinance No. 2648 be approved for passage
and publication after changing the pay of Wes Henry from $651.?0 to $670.00 according
to the ~ate voted by the people, carried unanimously.
In the discussion, it was clarified that the intent of the original ordinance which
is now~amended is to provide a pay scale that would go to the $6V6.VO schedule for him
but leave it one step under this amount for the first six months. It is adjusted upward
at the end of this period. Because of the initiative passed by the people with reference
to payroll which states his pay shall not be?leas than $670, the Council felt it nec-
essary to establish it at this ~un6u~t.
City Clerk read an Easement of the City's granting an easement to the STATE OF
WASHINGTON over and across certain described lands in Kitsap County.
Motion by Mr. Schoneman and Mr. Clark for approval of the easement, carried unan-
imously.
In the discussion it was pointed out that the request from the State for the ease-
ment came at a most opportune time because the City will also receive an easement to
State School lands. An exchange of easements is taking place without any cost to either
party.
City Clerk read an Ordinance concerning the discharge of firearms in the City limSs,
AN ORDINANCE amending Ordinances No. 325 as ~mended by Ordinance No. 363, 1152, 1832,
2492, and 2631 by providing for and licensing the discharge of ~irea~ns within the
City of Bremerton for the protection of growing or matured crops, and declaring an emer-
gency.
Mayor Jarstad explained at this point that the request came from a resident in
newly-annexed Valle-Hi who was licensed by the Government to destroy certain types of
birds harmful to his blueberry crops.
Motion by Mr. Jarstad and Mr. Schoneman that Ordinance No. 2646 be approved for
passage and publication, carried unanimously.
City Clerk read Ordinance No. 2647, AN ORDINANCE declaring the need for condemnation
of certain real property for placement, maintenance, operation, repair and replacement
of storm and sanitary sewer lines, pump station and structure to house the same, appur*
tenances and connection pertaining thereto and access for the operation and maintenance
thereof, dire~tlng condemnation of property and the payment of Just compensation there-
fore, and declaring an emergency.
Motion by Mr. Schoneman and Mr. Clark Ordinance No. 2647 be approved for passage
and publication, carried unanimously.
In the discussion, Mr. Schoneman stated that four properties are included in this
Ordinance, and three of them have indicated their willingness to yield to the City, while
some difficulty has been encountered with the fourth.
Mr. Clark commented that the acquiring of thSse lands is a tribute to both Mr.
Schoneman and his department and to the cooperation of the people in the area.
City Clerk read a letter dated August 14, 1965, signed by H. Holgerson, concerning
his donation to the City of Bremerton of a pumping plant and sewer system in the West-
Park area installed by him at an approximate cost of $15,000.
~r. Schoneman stated that this installation donation is in keeping with the City's
program.
~otion by ~r. Schoneman and ~r. Clark to accept ~r. Holgerson's offer and instruct
the City Attorney to prepare the necessary instruments, carried unanimously.
Mr. Clark commented on the budget balancing effort coming before the City soon
and stated our relatively small imbalance t~is year does not include many needed items
by the departments nor any potential salary increases.
Mr. Schoneman reported the paving on Park Avenue is under way and expressed the
hope that the businesses on Park Avenue will bear with the inconvenience caused by the
paving process.
Mr. Jarstad congratulated the men of the Public Works Department for the fine Job
being done on Park Avenue.
All three commissioners commented on Mr. Schoneman's impending trip to Norway and
wishes him a happy, restful vacation.
At this point, the Council recognized the presence of a group of residents from
Sheridan Park concerning the rezone of lots l, 2, and 20, Sheridan Park.
Mr. Harmon approached the Council first and raised the question wanting to know
if the City Council intended to do anything about Mr. BJork moving in the units before
the Ordinance becomes effective on Septmber 12,
Mr. Jarstad stated that the Council's action was for a rezone.
City Attorney Fisher stated that the 30-day period before an Ordinance becomes
effective is the time in which to inform the people of the passage of the Ordinance.
The only way the action could be changed would be to draft another Ordinance during this
30 days rescinding the previous Ordinance.
August 27, 1965 (Cont'd)
Mr. Harmon again stated that it was his understanding that the people thought a
four-plex was going ~o be put on the land, and further stated that if Commissioner Clark
knew the plans for the land, he should have stated for the benefit of the people that
a four-plex was in effect not the only unit to go on the property.
In reference to the question of whether the people could go the Planning Commission,
Mr. Clark stated that the Planning Commission did nob turn down the request to construct
a four-plex, nor did the City of Bremerton approve the construction of a 14-plex. The
P!m~ning Commission did, because they are an advisory body, decline to recommend the
rezone. The Planning Commission makes recommendations to the Council which the Council
uses for evaluation.
Mr. Clark further stated that he and the entire Council knew what Mr. BJork planned
to construct on the land and the question before the Council was may it be rezoned, not
how many units are to be put in.
Mr. Clark pointed out that the signing of a petition is not a control over action
by the Council, but that it is rather an indication of feeling for the benefit of the
Planning Commission and the City Council to use as it may affect their thinking. Also,
if a rezone would in effect be in the best interests of the community, it should be
accomplished. The 6ouncll cannot base its thinking entirely on what the immediate neigh-
borhood thinks. There was no objection at the time of the hearing and we did not antici-
pate any objection.
Mr. Curt Coons, attorney for Mr, BJork, approached the Council and stated that the
Covenants for the peo;~le of Sheridan Park provide that the people can go to a court of
law and restrain a person from violating any of the Covenants and that this right is
not a matter that is of any concern of the City Council.
At this point, Mr. Pat Carey pointed that they way the situation washandled by the
Council leads the people to believe they were deceived by not being informed of the type
of construction to go into the area.
Mayor Jarstad pointed out that plans soon to be approved by the Council will more
clearly define the type of construction to be permitted in a rezoned area and will
alleviate the future occurrence of this problem. Mr. Jarstad further stated that there
is a large number of rentals in the area and it is his belief that they type of construc-
tion planned will iN,prove the area.
Meeting adjourned.
