At this time, the Council reported that they had viewed the area in consider- ation in the proposed vacation of a portion of John Street. Mr. Jarstad stated that from his own observations, it has been established that the area is a proper access area and right of way belonging to the City. It does provide access for both homes to be maintained as an access area and necess- ary travel in serving both homes under consideration. Motion by Mr. Jarstad and Mr. Schoneman that on the basis of the investlga- tion made by the Commissioners that the petition for vacation be denied, carried unanimously. Mr. Clark pointed out that any blocking of the access way will have to be removed. The Commissioners also viewed the site of, a second proposed vacation described as a po~tian of Bayview (or Ninth Street) near Oyster Bay~ At the time the matter was before the Planning Commissioner, adequaSe information was not available as to Just where the proposed vacation was~located. Mrs. Arthur Waaga approached the Council and stated that the matter had come up while she was out of town and she would like to further acquaint herself and her husband with the matter before a decision is made. Mr. Skirvtng then stated that the street was no use to anybody and is ac- tually a front yard. Some discussion followed in which the City Attorney explained the 1890 laws as amended by the 1909 law dealing with the matter of whether the street was automatically vacated if it~was declared unused for public purposes during the period between 1890 and 1909. Mr. Clark remarked that the question before the Council was the vacation of the land and not whether the 1890 law was applicable, but should the City deny the vacation, then the law could become an issue with the property owners concerned. AfEer further discussion, a motion was made by Mr. Jarstad and Mr. Clark that the matter be set aside and judgment be reserved until after the completion of a study of the boundaries of the area concerned and that proper notice be given to the effect that the decision on the vacation will be rendered by the Co~mcil on November 30, at the regular Council meeting, and carried unanimously.
