Motion by Mr. Cl~rk and Mr. Jarstad the rezone be approved and the City Attorney be instructed to prepare the necessary ordinance, carried unanimously. Motion by Mr. Clark and Mr. Sc~oneman the hearing on an appeal from a decisio of the Planning Commission rejecting the application of Haselwood Buick Company for a Conditional Use Permit to permit customers~parking be convened, carried unanimously. Attorney Walgren, appearing with Mr. Haselwood, spoke on his behalf. He stated their feeling that the application to the Planning Co,mission was a rea- sonable one and in accordar~ce with the plans adopted by the City. Also, they felt the Planning Commission did not carefully consider the evidence before it. Mr. Wlagren recommended a decision in favor of the Permit on the bases of the re- commendation of the City Planner and the evidence presented. Mr. T. A. Pullman, ~175 7th Street, read his comments in opposition to the Conditional Use Permit. He stated he spoke for most of the property own.ers in the vicinity of the property on 7th Street in that they object to the Conditional Use Permit for parking. Mr. F. W. Stokes, 2~30 7th Street, based his opposition upon the seemingly apparent disregard by the Conm~issioners of the present zoning laws. He felt his interpretations were comparable to what others, including the Commissioners, would be, and that there is no basis in the zoning laws for such a rezone or a Conditional Use Permit. Mr. Soriano, Deputy City Attorney, explained that the City's legal Counsel has studied the laws and the interpretations and opinions are made known to the Contmissioners propm~l~. August lC, 1966--Con't, Mr. Stokes contended that the City Commissioners are establishing tendencies and situations that will be followed in the future. At this time; the City Clerk read the appeal as submitted to the Council, which stated the Permit was requested for customer parking. City Planner McConnell gave his views ~h the conditions for granting Condi- tional Use Permits, with emphasis on the portions that apply to these particular lots. City Clerk read the City Planner's recommendation for approval of the request of the Conditional Use Permit provided all requirements are met in accordance with Ordinance No. 1792 and Ordinance No. 2297. It was further pointed out that the permit is revocable if conditions are not met. However, Mr. Clark remarked the fact that Conditional Use Permits have been issued in the past and the requirements have not been met to the letter, but in this case, it seems that every precaution is being taken to see that the condi- tions are met. Mr. Schoneman cited a number of such per, nits that have been granted sinceL 1965 alone, and the fact that such a permit is not a new thing. Considerable discussion proceeded wherein "commercial" vehicles were dis- cussed and also what constitutes customer parking. Motion by Mr. Schoneman and Mr. Jarstad the permit be granted, carried unani- mously. Mr. Jarstad stated that such decisions by the Council are not popular ones, but the.Council makes them with proper study and reasons.- Mr. Clark stated he felt that the people in the area will actually be well 2atisfied with the improvements to the area and he hoped there would not be exces- sive "nit-picking" over what constitutes a co~nercial vehicle and what doesn't. Motion by Mr. Jarstad and Mr. Clark the meeting be recessed until ~:00 o'cloct at ~ich time the rest of the business will be considered, carried unanimo~sly. Meeting recessed. City Clerk had a petition AGAINST annexation submitted by Charles Speigle for an area West of Perry Avenue between Magnuson and Sylvan Way. The petition contained approximately 1V8 signatures. Mr. Clark pointe~ out that a petition of this nature is of little signi- ficance in. the light that if 7~% of tho property owners of the assessed valuation want annexation~ it constitutes a s~bstantial majority of those in favor of the annexation. City Clerk had an easement from the Merit Company and Michael J. Tucci and Josephine Tucci for the City of Bremerton to install, operate and maintain a sanitary sewage pump station and necessary sewer pipes, together with any mee- essary appurtenances within the easement.
