The City Clerk read a Permit for Parking from Mr. S. L. Mackey, Right of Way
Agent in Olympia. The Permit stated that the State of Washington Toll Bridge
Authority will have the right, privilege and permit for Parking and ingress and
egress over and across a parcel of property owned b~ the City of Bremerton at any
time from date hereof until December 31, 1973. The parking location would be ad-
Jacent to the Administration Building.
Mayor Jarstad asked the City Attorney if there was a way to change the Permit
to include an agreement stating that if the City found future use for this prop-
erty, it would be able to use it as it saw fit.
City Attorney Walgren stated that this could be done.
Motion by Mr. Schoneman and Mr. Jarstad to accept the Permit and refer it to
the City Attorney for checking and possible changes, carried unanimously.
~e City Clerk read RESOLUTION NO. #1356 stating that the Chief of Police
authorized by Ordinance No. #1279, Section 1, has submitted in writing to the City
Council, a regulation controlling parking by prohibiting parking on the East Side
of Warren Avenue between 15th Street and 16th Street.
The City Clerk then read the REGULATION by the Chief of Police stating that
beginning December 13, 1967, there shall be no parking allowed on the East Side
of Warren Avenue between 18th & 16th Streets.
There was question raised among the Commissioners as to whether the authority
rested with the Chief of Police to give such an order.
Captain Ted Ingram stated that Ordinance No. #1279 authorized the Chief of
Police to make and enforce ~ules and regulations of any kind and nature for the
control of traffic, and Ordinance No. #1517, Section 56 empowers the Chief of
Police to make such rules and regulations for the direction and control of parking
thus making it valid.
Mayor Jarstad then questioned the fact that if this is true on one side of
this block, with whom the Jurisdiction on the other side lie.
City Attorney Walgren stated that the Council should comply with the request
and that it doesn't mean that everything else is in error.
Mayor Jarstad then moved for passage of the Resolution, seconded by Mr. Clark
and carried unanimously.
The City Clerk read ORDINANCE NO. #2769 providing for the assumption of Juris-
diction by the City of Bremerton of North Perry Water District's responsibilities,
property, facilities and equipment contained within those areas of North Perry
Water District previously annexed to the City of Bremerton.
Motion by Mr. Jarstad and Mr. Schoneman ORDINANCE NO. #2769 be approved on
first reading.
In response to a question raised by Mr. Joe Zaspel of KBR0 Radio, City Attor-
ney Walgren explained the procefure to be followed by the City as outlined in
RCW 35.13.243.
In the course of the discussion, Mr. Clark stated that he wished it made known
that the City of Bremerton is willing to accept all assets and liabilities of the
North Perry Water District and to provide water at Bremerton rates. He also added
that the City of Bremerton water rate is $2.00 as opposed to $3.75 in the North
Perry Water District.
Mayor Jarstad raised the question of assuming all liabilities when there are
no assets.
City Attorney clarified this in reading an excerpt in RCW 35.13.243 which
stated the owners and occupants of such annexed property shall continue liable for
payments of its and their proportionate share of any unpaid indebtness, bonded or
otherwise, with the right on the part of the District Officials to make tax levys
and collect charges on such property or owners and occupants and to enforce such
collections as if the annexation had not been made.
The motion was then put to a vote, and carried unanimously.
The City Clerk read a letter from the Lion's Club stating that the Bremerton
Central Lions Club requests the City Council to determine whether it would be
feasible to cover and heat the swimming pool at the Evergreen Park. It also stat-
ed that the Lions Club will consider this as a project if the findings prove that
December 13, 1967--Con't.
the pool could and would be used twelve months of the year.
Mayor Jarstad moved to refer the letter to the Park and Recreation Board and
the committee as a whole for study, seconded by Mr. Schoneman and carried unani-
mously.
Mayor Jarstad then stated that this would be a costly project for the Lions
ClUb and commended the Club for its good intentions.
Motion by Mr. Clark and Mr. Jarstad to pay all bills approved by a majority of
the Commissioners, carried unanimously.
Commissioner Clark gave the monthly financial report as of November 30th, 1967:
Cash on Hand was $190,212.10; throu6h that date, we have received of our antici-
pated receipts an amount totalling $2,106,306.28 or 97.3% of our estimated receipts
for the year. On expenditures, we have expended $2,068,803.72 or 89.2% of our an-
ticipated expenditures for the year 1967. Mr. Clark then cited some interesting
individual receipts which were as follows: Admission Taxes; Business & Occupation
Tax; Power & Light Franchise Tax; Parking Meters; Police Court Fines; Garbage Con-
tract; and Motor Vehicle Excise Tax. He stated that the economy of the Bremerton
area is growing steadily.
Commissioner Clark then ~ited the existing Garbage Contract which provides
that the rates be adjusted each year on the Cost of Living ~ndex. The raise which
will go ~nto e~fect the let of January will amount to 4.384~ increase. The prior
rate of $1.72~$ per month for a single can user will now be $1.80, exactly a 7~
increase. This percentage increase applies to all categories of users for numbers
of cans. For Commercial users of 25 to 35 cans per week which was $7.34, will now
be $7.66; and additional cans over that figure which have been $.15~ each will now
be $.16~.
Mr. Clark then compared Bremerton's garbage rates to some other Cities and
Counties in Washington which indicated Bremerton's rates are substantially lower
than others.
Mr. Clark commented on the new facility which will be available to Commercial
users of garbage. The Contractor has furnished a dumpster unit which consists of
sanitized, rat-proof, 100% maintenanced containers ranging from l~ yards to 6 yards.
He then quoted prices on these containers which is slightly higher than cans equal-
ling the same capacity. This facility will only be available; not mandatory.
Commissioner Schoneman reported that he had recently received word from Father
Knelleken concerning the need for sewer installation rather than a septic tank at
m~ich point they will shortly be arriving in construction of the new church. The
church is presently located in the County but it is the desire of the congregation
.to annex to the City of Bremerton. Our sewer line is Contiguous to the church lo-
cation, however. He stated that he had requested Father Knelleken to draft a let-
ter to the Council stating their wishes which he has done.
He then asked the City Clerk to read the letter to the Council.
City Clerk ~cGowan read the letter, signed by Father Knelleken, to the Council
which stated that Holy Trinity Parish requests that their properties on Pine Road
be annexed to the City as soon as it is possible. They also request that they be
allowed permission to tie into the Bremerton Sewer System, being most proximate
to their location. It also stated that the completion date of the church is April
16, 1968, but at the present time, the plumbing sub-contractor is delayed in his
work until a firm decision is forthcoming from the City of Bremerton.
CoK~issioner Schoneman then moved that we refer the letter to the City Attor-
ney and Council for study to see if provision could be made to allow the church to
connect to City Sewer because of their desire to come into the City.
Mr. Clark stated that our present Ordinance would not allow it. He also stat-
ed that he understood that there is an annexation program taking place in that
area at the present time. He added that the Council has been considering for some
time the possibility of an amendment to the present ordinance, similar to the type
of ordinance now existing in Yakima whereby they do extend beyond the City limits
under limited circt~nstances and the parties involved enter into a covenant that
runs with the land which is a binding agreement to annex at such time as annexa-
tion is practicable.
Commissioner Schoneman stated that the City does not normally extend City Sew-
ers outside the City limits, but since a roadway was going to be constructed, the
feeling of the Council was that within a short period of time, it would have to
be torn up to put in a sewer llne, therefore they took action to extend the sewer
line into the County at that time.
Mayor Jarstad stated that either an amendment to our ordinance or the annexa-
tion of the area will adequately provide for this need.
Comm~issioner Schoneman stated that the existing problem on Shorewood Drive will
hopefully soon be resolved. The present plan for construction will entail the
property owner allowing the City upon his property to construct a rip-rap wall that
presently is slipping. This project may be started next week.
There was question raised as to whether the property owner should be held
liable for the damages.
Mr. Clark then stated that before the City enters into any phase of improve-
ment, the City Attorney should review it.
Mr. Schoneman stated that the City Attorney has reviewed the situation and has
visited the site and should therefore have a comment.
City Attorney Walgren then stated that any action taken regarding to protect-
ing property would not cause any harm for further action.
December 13, 1967--Con't.
Commissioner Schoneman commended Mr. Joe Mentor who, at his own expense, wish-
es to put a turn lane on the Northwest corner of Park Avenue at llth Street.
Commissioner Schoneman stated that the City has been successful in the haul-
ing of several hundred loads of leaves from residential streets. This allows the
City to be prepared for the winter weather.
City Attorney Walgren stated that the City was sued last week with regard to
the vacation of property owned by Mr. Aberg represented by Mr. Sanchez. This
matter will be set for trial in the Superior Court.
City Attorney Walgren also stated that one of the Right-of-way Agents of the
State of Washington stated~their desire to exchange two small pieces of property
which the City owns in connection with the improvement of the Freeway. He had
prepared the necessary Statutory Warranty Deed which requires that the City of
Bremerton deed this land back to the United States then to the State; and the
State deed their property to the United States and then to the City. He also
stated that he has the necessary papers from the United States giving us our por-
tion of land and we can proceed no further until we have executed the deed.
Mayor Jarstad questioned the urgency of the matter.
Mr. Schoneman stated that the only urgency was for the State to be able to
properly place their fencing in order to open lanes.
It was decided that since there was no immediate urgency and the Council had
no previous knowledge of this matter that it be put on the agenda for the next
Council meeting and Mayor Jarstad so moved, seconded by Mr. Clark and carried
unanimously.
Mr. Steve Erickson of the Bremerton Sun, who was present in place of John
Christensen, was introduced by City Clerk McGowan.
Mayor Jarstad stated that the Police Department is very proud that the sta-
tistics have been reduced on the amount of vehicular d~mage and pedestrian injur-
ies from the previous year. He commended the citizens of Bremerton for their
cooperation on the highways.
Mayor Jarstad then stated that he will leave at noon for Seattle for a com-
mittee meeting which is for the purpose of studying pension laws for the Fire
and Police Departments. Following the meeting, he stated that he will deliver
the City's application for the land at the N.A.D. to be submitted to the Bureau
of Outdoor Recreation which states our use of the land, in order to obtain a 50
per cent federal grant.
He then stated that tomorrow morning at lO:00 o'clock a meeting has been calle,
of the Civic Auditorium Task Force which was appointed by Resolution of the City
Council to review findings that the Committee gave to the City Council at con-
clusion of their study. It is hoped that further steps may be taken for a study
of the use of a Civic Auditorium as a result of the meeting.
Mayor Jarstad moved that all City owned vehicles be marked with standard City
emblem and proper markings except Police Cars, and that the City Attorney be in-
structed to draft the necessary Ordinance or Resolution to enforce the same~
On discussion, Mr. Schoneman stated that all vehicles should be identified,
but that he would like to look into what happened to the City's last emblem.
Mr. Clark stated that this emblem, presently being used, ~as adopted by the
Council.
The question was therefore put to a vote: Mayor Jarstad and Mr. Clark voted
"yes", and Mr. Schoneman abstained from vote.
Meeting
adjourned.
