McConnetl, to the Planning Commission dated September 25, 1967, which included an excerpt from the Bremerton City Planning Commission minutes of September 20, 1967. They stated that the City Engineer suggests the City might have a future use for this strip of land and recommended denial of the vacation. After discussion by the Planning Commission, a motion has been made, seconded and carried that the request be denied. Next the Acting City Clerk read a letter from Fred J. Mebus, City Engineer, dated September 20, 1967. It stated that the property may have other potential uses in the future that are unknown at this time, therefore recommending the re- quest be denie(~ until all City departments had a chance to review the request. Mayor Jarstad asked if there was anyone in the audience who would like to ad- dress the Council regarding this matter at this time. Mr. Frank Cloward, a Marine Drive Water District Commissioner, stated that the City will not need the piece of property for a roadway and that he hoped the Coun- cil would make a determination in their favor this date. Next Mr. Don Burgess from the Title Company stated that in April of 1983 this portion of land was not ~n the City, but was in the County. At that time there was a petition for vacation to the County. The County held a hearing and it was their decision to grant the vacation, but before it could be put into effect, this por- tion of property was annexed to the City of Bremerton. He then stated that the City should concur with the County Commissioners in vacation of the property. Mr. Del Langton, another Water District Commissioner, stated that he did re- ceive word from the County that the property had beenvacated. He then asked the Council what use the City could have for a portion of land 40 feet by 100 feet. Mayor Jarstad answered by asking him what use they woul~ have for it. Mr. Langton stated that they want the property to straighten out their property. Mr. Clark assured them that this was a hearing to discuss the matter and that the minds of the Council were not previously convinced one way or the other. Mr. Schoneman stated that the initial petition was not presented properly to the Council, therefore it was denied. It then came back to the Council and they directed the Commissioners to take it before the Planning Commission. Mr. Cloward stated that they were now using this piece of property for parking purposes but that he still hoped the Council would favor their request. Mayor Jarstad stated that until the City put the property to other use, it could continue to be used as it is presently. Much discussion followed. October 25, 196U--Con't. The Acting City Clerk then read a letter from the Planning Director, R. L. McConnell, to the City Council dated October 20, 1967, staking that after fur- ther research on a petition from the City Shopping Center Corporation, the Plan- ning Department found it necessary to change their recommendation for the follow- ing reasons: (1) Because one of the owners of the property abutting the alley is opposing the vacation and. the revised Code of Washington states that "no vested rights shall be affected by the provisions of this chapter;" (2) The City Attor- ney found a Supreme Court Decision which'in part states "an abutting property owner upon a street or alley'has a vested right in the Sight to use the whole of the street for ingress, egress, light and air and the right to compensation for his damage by a vacation of a portion of the same regardless of which side of the street is vacated. The Planning Department therefore recommended that the request be denied unless the petitioner is willing to pay compensation to those who would be ad- versely affected by the subject vacation. Mr. Schoneman then moved that this case be referred back to the Planning Commission for study, seconded by Mr. Clark. William Garland, Attorney, brought his opinions out; the Council, however, elected to concur with their former decision. The motion was then put to vote and carried unanimously. City Attorney Walgren stated that a plat that has the approval of the Plan- ning Commission is an accepted rule according to law. In this case, it shows the approval of the Planning Commission Chairman and therefore may be recorded. Mayor Jarstad stated that this information must be forwarded to Rasmussen Construction ~ompany and therefore directed the City Attorney to draft a letter. Mayor Jarstad reported that he attended the Washington Recreation & Park Society's Annual Conference at the Tyee in Olympia on Sunday and part of Monday. Next Mayor Jarstad read a memo from Andrew Pendergast stating that the. Girl Scout Troop from the Star of the Sea School has entered the Spring Garden Design Contest and as a project they have selected the beautification of the area ad- jacent to the Forest Ridge Park restrooms and storage shed. The contest is part of the Presider~s Beautification Program to st~mulate local interest and participation in local beautification programs. Mayor Jarstad expressed his thanks to the leaders and girls for this gesture. He then announced that he was leaving after today's meeting to go to Everett to a meeting on Municipal Government. Mr. Vockrodt, a member of the Bremerton City Planning Commission, called the Council's attention to ~hat he considered three violations of the zoning ordi- nance: (1) The height of the spire on St. Luke's Methodist Church has been built too high; (2) ~e lack of parking facilities and the set-back of the buildings at Olympic College - not being far enough away from residences; (3) Planning Commission did not make zoning recommendations for newly annexed Kitsap Lake Area. Mr. Clark stated that the Kitsap Lake Area came into the City with the pre- sent zoning remaining.
