showed p~ans for eight units and not sixteen.
Mayor Jarstad remarked that the control that is exercised on the land relative to
density would be by appropriate ordinance and should not enter into the decision by the
Council as to whether or not an area should be rezoned.
Mrs. Byrne presented a petition to Mayor Jarstad containing signatures of residents of
the area who were opposed to the rezone.
Mayor Jarstad asked the Attorney to voice an opinion on the petitions which have been
before both the Planning Commission and the City Council relative to this proposed rezone.
City Attorney Walgren said that there is some question in his office as to the
legality of the requirement of an over 50% petition. While this question has now been
abandoned in the new zoning ordinance~ now under study, it is felt that should this be tested
in Court, it would be declared unconstitutional. He feels that this matter is properly be-
fore the Council at this time because when a propez haaring was held before the Planning
Commission, the petition apparently had sufficient signatures.
Mr. Byrne challenged City Attorney Walgren's remarks on the grounds that when the
petition was first before the Planning Co~ission~ it was for a smaller parcel of land which
he subsequently increased by another parcel. To which Mr. Walgren replied that by the time
the matter was before the Planning Commission for the second time, both parcels were being
considered. This was confirmed by Mr. Byrne.
Mr. Clark stated that he felt, in view of the Attorney's opinion, that this request
had been properly considered by the Council, that the request conforms with the Comprehensive
Plan, and he therefore moved that the City Attorney be instructed to draft the necessary
ordinance for consideration at f_he next Council n~eting.
Several of the opponents of the rezone then asked the Council to defer action to a
later date, preferably a night Council meeting.
