HomeMy WebLinkAbout03/21/68 March 21, 1968 A regular meeting of the City Council of the City of Bremerton was held in the Council Chambers of the City Hall at 7:30 P.M., p.s.T., on March 21, 1968, with Mayor Jarstad presiding. Also present were the following: Commissioner Clark, Commissioner Schoneman, City Attorney Walgren, City Clerk McGowan, Assiss- tant City Attorney Soriano, Attorney Sexton, City Planner McConnell, Office En- gineer Thornburgh, Judge Ryan, Attorney James Arthur, Attorney John Bishop, residents of the newly annexed Kitsap Lake area, residents of Oyster Bay, and representatives of the Press and Radio. The meeting was called to order by Mayor Jarstad and the Invocation was given by Reverend Glen Soule of Manette Community Church. The minutes of the previous meeting were read and approved as amended. The City Clerk announced that it was the time and place set for a public hearing on the Kitsap Lake Annexation Zoning. Motion by Mr. Clark and Mr. Schoneman the hearing be opened, carried unani- mously. Mayor Jarstad requested City Planner McConnell to explain the recommendation~ of the Planning Commission. C~ty Planner Ron McConnell pointed out the area to be rezoned on the map and explaine~ the Planning Commission's reasons for recommending the rezone from Kitsap County Commercial to Bremerton Business-Three (B-3). He stated that basi- cally these two classifications are the same, but if the City rezoned it to Bramerton Business-Three (B-3), it would have more Jurisdiction over the Maple Dale Trailer Court with which the people of that area were displeased. The trailer court would then be under the City Mobile Home Ordinance. Mr. Sch0neman stated that in the past, we have never attempted to correct the zo~ing when we have annexed other areas. City Planner non McConnell stated that this was because the County zoning was adopted in the Ordinance of annexation. Mr. Clark stated that the Ordinance was misleading because on one hand the property zoned by the annexation ordinance provided that the zoning would remain March 21, 1968--Con't. unchanged and on the other submitted by the Planning Commission accepted com- parable zoning. The Council had contemplated, however, that the people were to be neither benefited or damaged by the annexation as relabing to present zoning. Mayor Jarstad requested the City Clerk to read the correspondence from the Planning Cermmission. The City Clerk read Planning Commission Resolution No. #159 which requested the City Council to pass an ordinance amending the use and area maps of Ordinanc. No. #179~ and ~ezone the area known as Kitsap Lake from Kitsap County Commercial to Bre~erton Business-Three (B-3). ~ayor Jarstad asked if there was anyone in the audience who wished to speak for or against the rezone. Mrs. Daniel Eder spoke for property owners residing behind the ~aple Dale Trailer Court. She explained all conditions existing now and asked the Council to explain the conditions they may be under and what would be done about the violations of the Maple Dale Trailer Court. The Council advised her that the hearing tonight was for the purpose of ~tetermining whether the Council should rezone this area to Bremerton Business rather than have County zoning, then at a future date the Council could make a determination on the complaints of the people, regarding the Trailer Court. After much discussion, ~r. Schoneman asked the City Attorney if we could enforce something we have not adopted? (Speaking of County Zoning) City Attorney Walgren assured him that this was adopted by reference by the ordinance of annexation. Mayor Jarstad stated that when the annexation took place they told all busi. ness people that the present zoning, restrictions, rules and regulations would be accepted. This was the way it was stated in the Ordinance of Annexation will remain this way unless the Council concurs with the Planning Commission and rezones the area. Hotion by Mr. Jarstad and Mr. Clark the recommendations of the Planning Commission be denied and the zoning of this area remain as intended in the annexation ordinance. After much discussion, the motion was put to a vote and carried unanimously Notion by Mr. Clark and ?~r. Jarstad the hearing be closed, carried unani- mously. Motion by Mr. Clark and Mr. Jarstad the hearing for a rezone of property a~Jacent to the Hearthstone Inn be opened, carried unanimously. Mayor Jarstad requested the City Clerk to read the correspondence regarding the rezone. ~e City Clerk read a letter from City Planner Ron NcConnell which contain~ excerpts from minutes of various Planning Commission meetings regarding the request for rezone of this property. Attorney John Bishop, who acted as spokesman for O'Bay Company, stated that there is business zoning on Oyster Bay at the present time and if the parties so desired, they have the right to construct a dock to make use of as they wish. They do not want to make this use, however, they only want the rezone of a par- ticular piece of property for a parking lot. He further stated that if they were given this rezone, they would in turn give up the possibility of any future commercial ~evelopment of this land. This would be accomplished either by a restrictive covenant running with the deed or by Contrsct zoning or both pro- cedures. He also stated that the people had been concerned about the possibil- ity of water pollution through the usage of boats. He assured the citizens that the motel would not promote any boat traffic as there would be no access to the water from the motel. ~ayor Jarstad asked the Council if they had any questions regarding this rezone. ~r. $choneman asked ~r. Bishop if in the event that the rezone is not granted, is it the intent of the owner and contractor to build regardless? Attorney Bishop stated thst this is very possible. Mr. Schoneman then asked City Planner Ron McConnelllif the parking facility could not be constructed elsewhere. He was assured that it could, but may be inconvenient for the patrons of the motel. City Planner Hen ~cConnell pointed out the area in question on the map and explained the reasons for its present zoning. ~ayor Jarstad asked that all those who were opposed to the rezone present their arg~aments to the Council. The following spoke in behalf of the Oyster Bay citizens: Mr. Charles Warner, 5Ir. Schmickrath, Mrs. ~lane McBride, Mr. ~ike ~tles, ~r. ~aynard Herman, Mr. Chet Simpier~ Senator Morgan, Mr. Phil Chandler, Attorney James Arthur, Judge Frank Ryan, Mrs. Jack Conner, Mrs. John Verhelst, Mrs. Charles Ullock, Dr. Ted Burns, and Mr. Harry Gundlach. The residents all presented different views, but all were in accord in hoping that the Council would uphold the Planning Commission~s decision to deny the rezone in an effort to stop any future commer6ial development which this rezone could encourage. The people were also against a contract agreement be- cause they felt that in the end this wouldn't be upheld. March 21, 1968--Con't Since it was the feeling of the residents and the Planning Commission not to grant the rezone, Mayor Jarstad moved to deny the appeal by O'Bay Company for the rezone of property located adjacent to the Hearthstone Inn. Mr. Schoneman stated that he would concur with the residents as long as they understood what action may take place in the future. The motion was put to a vote and carried unanimously.
