The City Clerk read a letter from Planning Director Plescher which in- clude¢l an excerpt from the Plannlna~ Commission Neeting ~inutes of November 1969. The excerpts revealed that the rezone was denied, by motion, to to the fact that the property adjoins the Walgren-~J~ntor property which had been denied for a rezone also, and it wo~l~ be a spot zone if it were approved. Plsnning Director Plescher pointed out the location of the property on vari- ous ma?s. The Comprehensive Plan idap showed the property as Residential use. Co~ntsstoner Clark asked h~r. Plescher if it was likely that the property would ever be develope~ as residential. ~,~r. Plescher stated that, in his op~n- ion, this woul~n't be possible because of the shape of the property. He also state~ ~hat he felt that ~,~r. Wagner's proposed use for the property? (lease to a trailer sales establis~ment) was the best. The trailer sales is now operating on sai~] prope'.~ty ~na~er a Conditional Use Permit, but a legal lease a ~reement can- not be entere~ and 2~uprovements cannot b~ ma~ie ~ntil it is zoned Commercial. ~Ja~or Jarstad asked if there was any one in the audience w]~o wished to spe~k for or against the rezone. ~.~r. The City Clerk read a PETITION, sit,ned by ~9 property owners in the vicini- ty of the property, which objected to the rezone and requested tha~ the appeal to the City Council be denied. The residents based their objection to said rezone on the fact that the area is currently a strictly residential area and is so zoned an~t that the Comprehensive Zoning Ordinance also reco~ends that it remain so. The overall feeling among the ci- tizens objecting to the rezone was that the whole area is now residential and that the conm~ercial zone and parking lot would be a detriment to the neig:hborhood. After much ~]iscussion, Commissioner Clark moved to concur ~ith the Planning Co,remission decision to deny the rezone, seconded by Comrmissioner Schoneman. Under discussion: Commissioner Schoneman stated that it would almost be impossible to locate a pa~.ktng lot on a lot of this size after the proper screening, etc. has been placed, and it '.'~oul5 be more ¢]esireable 4o keep this well-kept residential area as such. The motion was then put to a vote, and carried unanimously. The City Clerk announce~] tha~: a public hearing was held on December 10, 1909 on an sppeal by Joseph P. I,~entor and Cordon L. Tennis, 1712 Crestview Drive; and John Remain, 1317 Crawfor~] Drive. The general feeling muong the petitioners was they felt that a more res- trictive zone could accomplish the proposed purpose and that a contract shoul(~ be entered between ~he city and the ovn~er limiting the use of the property and setting forth the proposed use. ~.ir. Joseph P. ~,~entor was present to speak for thc rezone, tie presented a sketch of his proposed plan and ~escribed the topography to the Council members. U. uch discussion followed by L~r. ~;lentor and Idr. Burchfield.
