Biggs, Director of the State of Washington Department of Ecology advising that the application submitted for financial assistance in modifications to sewage treatment facilities has received a priority rating by the Department of Ecology for a Federal Grant of $136~400, representing 33% of the estimated cost of those portions of the project eligible under PL 84-660 construction grants program; that, before certification, the Department must have comments of the Kitsap County Planning Commission; that final September 23~ 1970 (Cont'd.) eligibility will be based on the actual cost of construction, but that failure to proceed according to the schedule given in Section V, Part C of the application, will endanger the Federal Grant. ADDITIONS TO SIX-YEAR CONSTRUCTION PROGRAM Clerk stated that the time had arrived for hearing on addition to six-year program of improvements to Sylvan Way from Pine Road to Almira Drive, for grading, drainage, curbs, sidewalks and paving. Clerk stated hearing had been published in the BREMERTON SUN. Discussion followed among Council members regarding timing of this project and other schedules. Engineer Parker pointed out that the purpose is to tie our arterial on Pine Road to future of Almire (showed on map). Commissioner Schoneman mentioned that that portion of Sylvan Way from Wheaton Way intersection going east is stat highway and that portion of improvement would be borne by the state; anything west of Wheaton would be on our gas tax program. CLARES MARSH EASEMENT/ORDINANCE NO. 2909 Clerk read memo from Engineer Parker dated September 22, 1970, tO Commissioner Schoneman reporting he had contacted several owners involved and that owners representing 3,000 feet--of approximately 4,300 feet of easement involved--indicated willingness to cooperate; that there would be trouble spots in remaining areas, and that he had indioated to the various property owners that the City would institute Court action necessary to obtain permission to remove the restriction on the pipe size. Clerk stated that he had proposed Ordinance on file. Motion by Commissioners Clark and Schoneman that Ordinance be read, carried unanimously. Clerk read Ordinance No. 2909, declaring the need for condemnation of a strip of land in and through certain real property for the purpose of constructing and installing a drainage pipe line, and declaring an emergency. Motion by Mayor 3arstad and Commissioner Clark to pass Ordinance No. 2909, carried as follows: Mayor 3arstad - Yes; Commissioner Clark - Yes; Commissioner Schoneman - Yes. HOUSE NUMBERS ON CURBS Clerk presented request from J.Cs. for permission to paint house numbers on curbs with luminous paint, and stated that he had forwarded Ordinances to City Attorney for review. Attorney's opinion was that Ordinance #996 had no application, but it appeared that the restrictive language of Ordinance #732 applied--although it doesn't specifically say curb is included as part of sidewalk. Commissioner Schoneman remarked that this ia probably the tenth request we have had (fr~m Boy Scouts, etc.) to paint such numbers; it has been our policy that we deny same, as not all property owners would want them, and wear and tear on the paint would result in a bad curb appearance. He suggested denying the request. PAYMENT OF BILLS Motion by Commissioner Clark to pay all bills that have been approved by a maJorlty of the Commission, seconded by Mayor Jarstad; carried unanimously. GENERAL REPORTS Commissioner Clark:- Proceeding as rapidly as we can on implementation of bus tax and contemplate that first bill- ing will be for October and will appear on utility bill going out in November; thereafter, billing will be bi-monthly, at the rate of 60¢ per month~ Estimate the number of taxable units, includ- ing business units, as 12,000. Wanted to make clear that while the units to be billed have been referred to as "household units," each businesa unit will also be billed the 60¢. Stated that we are nearing the end of the three-month interim arrangement with the present bus operators and we will not be able to work out our long-term arrangements before the end of that term and that it will be necessary to extend the interim arrangement. Mr. Taylor, of Price Waterhnuae, was coming over that afternoon to further review the bus situation. Motion by Commissioner Clark and Commissioner Schoneman that, at the close of this Council sess- ion, the meeting be recessed until 11:00 A.M., Thursday, September 24, to finalize interim arrangements with the present bus operators, carried unanimously. Regarding the parking facility, the financial people, Harper & Sons, will soon bring their study to a head; this was waiting for Jacobson's study re the desirable size, which has now been determined as a 280-car garage. And as the bid specifications implied we would make final award within 90 days from bid-opening date (although not mandatory), we are approaching that 90-day period and have discussed this situation with the contractor, Wick and Associates, and they are sending letter agreeing to an extension of that period 15 days. Beautification project at (former) Craven Center parking lot is virtually completed, and commended Park Department and Superintendent Pendergsst. Commissioner Schoneman, at this point, added to the commendation of Mr. Pendergast and his Board for their beautification programs, including Burwell Street connector; also commended them for their summer programs for the children. Commissioner Schoneman:- Re the Washington Narrows interceptor sewer. Had met with Godat, whose outllne shows how it could be accomplished--and it's a difficult project. Mr. Godat is attempting to obtain both Federal and State support, especially because as one end would be at the State ferry terminal, and he will shortly present us with a plan and it will then be necessary to have a hearing on it. We are moving without a formal L.I.D. and, although City does have right to force an L.I.D. (as we are contributing to a real pollution problem and it is a "must"), we would rather have participation willingly by all owners. Kitsap sewer project will be activated in November; Just a matter of cleaning up blacktop and lift stations. Madrona Point stations No. 1 and 2 are complete. September 23, 1970 (cont.) In connection with the High Avenue project, some concern had be~n expressed that the parents would not be able to stop to unload students; explained that the four lanes do not prevent stopping to unload, but that there will be no parking. West Iligh School will find much less traffic noise due to the type of paving used. A number of streets require tree planting and he has given list to Park Board. Washington Avenue should be replanted. City Attorney:- Attorney Walgren reported on his meetings with various State agencies at Richland, and commented on the reduced truck rates on the Seattle-Bremerton ferry. POLICE DEPT. ~LOTHING - ORDINANCE NO. 2910 Clerk read Ordinance No. 2910, appropriating $3,000.00 into the Police Department M & O; Item 3.33-A, from the General Fund; and declaring an emergency. Motion by Commissioner Clark and Mayor Jarstad to pass Ordinance #2910. Under discussion, City Clerk suggested that a resolution be drawn up for clarification as to how money should be spent. Mayor Jarstad said he would have Police Chief draft guidelines in form of a resolution and submit to Council for approval. Motion carried as follows: Mayor Jarstad - Yes; Commissioner Clark - Yes; Commissioner Schoneman - Yes. C}5~NGE ORDER - KITSAP LAKE SEWER INTERCEPTOR Clerk read Change Order No. 4 to repair and reinforce 60 ~eet of 8-inch line developing cracks. Motion by Commissioner Schoneman and Mayor Jarstad to approve Change Order. Under discussion, Mayor Jarstad raised question whether the City might have claim against someone for the amount of the Change Order. City Attorney said he had discussed this and we probably could make a case' out of it--but the matter of the per cent of the recovery is problematical. Motion by Commissioner Clark and Schoneman to' amend original motion to include: " .... and that the City Attorney be instructed to pursue the matter of possible recovery on any portion involved in which we may have a right." Motion as amended, carried unanimously. TRUCK RENTAL Commissioner Schoneman commented that we have need for 10-yard trucks to haul sand and gravel' away from Pine-and-Sheridan Avenue sewer line Job;.that Mr. Higgs had come in with a proposal to rent three, new GM 10-yard trucks at a lower rental than anyone else. Motion by Commissioner Schoneman and Commissioner Clark to make arrangements with Mr. Htggs for renting his equipment, carried unanimously. REPAIRS TO CITY HALL Commissioner Clark mentioned that, weather permitting, the repair of the South Wall of City Hall will commence next week; that as soon as that is done, we can begin to do inside work, especially in the area of the Police Department, where there has been leakage. ABANDONED VEHICLES ORDINANCE Mayor Jarstad advised that another proposed ordinance had been set aside for study. PARK PLANNING Mayor Jarstad related that he had discussions with Mr. Pendergast and they would like to be able to contract with professional park planners for laying out the large holdings of the Park Department. Commended the fine work of Mr. Pendergast and Plescher, and pointed out that for the approach to the Interagency Co~m~ittee, it was required that the work be done by professional park planners recognized by the Interagency Committee in its requirements. Mr. Pendergast will be bringing in additional information and is now making contacts and-obtaining costs. ROSS REZONE Mayor Jarstad pointed out that Mr. Ross was present, and suggested that he meet with the Commissioners and Mr. Plescher after the Council meeting had recessed. Meeting recessed until 11:00 A.M. the following day. September 23~ 1970 (Cont'd. The recessed meeting of the City Council of the City of Bremerton, Washington, was held in the Coun- cil Chambers, City Hall, at 11:00 A. M., DST, Thursday, Septembe~ 24, 1970. Attending were: Austin M. Clark, Mayor pro rem, Commissioner Schoneman, City Clerk Yeadon, City 'Attorney Walgren, City Engi neet Parker, and a representative of Radio. Primary purpose for the recessed meeting was to consider the interim agreement with the bus company, and Clerk read the bus agreement. Commissioner Schoneman, who stated he had not seen the bus agreement previously, asked if there should be an exact list of the equipment that the City proposed to lease, to which City Attorney Walgren replied that the agreement contemplates the bus company will carry on the existing, usual amount of service and will provide all necessary equipment to carry out all reasonable services, and that the agreement is broad enough to cover this point. Mr. Clark explained that the rate of paymen is 81¢ per mile and the Company will be paid for mileage--so they will provide equipment for any extended service the City may wish to have. Mr. Schoneman asked about supervision of the bus company, particularly policy such as additional routes. Mr. Clark answered that policy will be the concern of the entire Council but that day-to- day problems confronted by the operator, Ben Rust, will have to be handled by one person--and that fs the reason for his being named in the agreement. Mr. Schoneman asked for a clarification on Page 3 of the Agreement, where it refers to "the City", whether this should be "City Council". Mr. Walgren answered that "The City" means "The Council". Mr. Schoneman asked if the Mayor had had an opportunity to review the Agreement and it was acceptable to him. Mr. Clark answered that he has seen it in part. Mr. Schoneman asked if Mr. Rust has read it, and Mr. Clark answered that he has, and is in agreement with it. Mr. Clark reported that Mr. Rust did not come to the Council meeting this morning because he was tied up on other business; that the agreement embodies all of the intent and results of the study and embodies the entire program on an interim basis, which runs for three months, and contem- plates renewal from month to month until a permanent agreement can be reached. A permanent agreemen cannot be reached by October 1, and probably won't be reached before January 1, until the ongoing program can be worked out. Motion by Mr. Clark and Mr. Schoneman that the agreement be approved, and to authorize signing by the Mayor and the City Clerk, subject to approval by the Company, carried unanimously. City Clerk read letter from Redford Engineers dated September 22, 1970, addressed to Commissioner Schoneman, subject "K-Werner Interchange Connection Engineering Report". The letter gave their recommendations for location of an arterial connection to the interchange. Attached to the report was a copy of the study made, with accompanying maps. Mr. Schoneman commented that in planning for the future, this proposed route gives the ability to proceed north at a later date. One of the results in the future could be making Wycoff and Montgomery one-way streets. Also, it would be possible to construct a bridge in the future from Rocky Point to Tracy~on. Mr. Schoneman stated also that Redford Engineers feel they have recommended the best route--and he agrees with them. No action is necessary at this point, but it will be necessary to sit down with the consultants and see how to proceed with the arterial connectioN. Attorney Walgren stated that Chief Plouf and Captain Little were present to discuss a problem which needs some action by the Council. Chief Plouf stated that Superior Court Judge Bryan wishes to have some arterial photographs taken of a location in Bremerton involved in a trial for a man's death, where two men are being tried, and the Judge wants pictures taken at close range which have the ability to be blown up and still retain their detail. The cost of obtaining these photographs is about $200.00. The problem is that it is difficult to determine financial responsibility for obtaining the photographs. Mr. Walgren stated that the State of Washington would not pay, and neither would the Sheriff nor the County Prosecutor; that the providing of evidence finally falls on the City Police Department in whose Jurisdiction the case originated. This matter was discussed briefly by the City Attorney, Police officials, and the Commissioners. Chief Plouf stated that ther~ isn't money set aside for this purpose in the budget. Motion by Mr. Clark and Mr. Schoneman that, in the interest of expediency, the expenditure be autho- rized and the City Council take that into account in any emergency that may be necessary, carried unanimously. Mr. Clark stated that at Wednesday's Council meeting, he had repo~ted that the proposed parking contractor would send a letter extending the time necessary to complete preliminary requirements involving financing. That letter has been received. City Clerk read letter dated September 23, 1970, to the City Commissioners from Wick Construction Company which stated the Company would extend the period for bid analysis and award fifteen calendar days, to October 9, 1970. Mr. Clark then read from the bid specifications indicating that the contractor would receive a notice to proceed ninety days after award. Mr. Clark said that he had the City Attorney's office opinion that if the specifications had stated "shall be", the City would have been required to give "Proceed" order by September 24. However, this is not the case, and he has been advised that the City does not have to give the "Proceed" order immediately; that this letter simply clarifies this point and the con- tractor understands that the City needs to extend the time fifteen days. Motion by Mr. Clark and Mr. Schoneman that the letter be accepted for the extension of the analysis psriod for fifteen days, and the contractor be notified it has been accepted by the City, carried unanimously. Council meeting adjourned at 11:45 A. M.~~--~~P~OVED: Glenn K. Jars~, Mayor G.C. ~9~don, Sr., City Clerk
