HomeMy WebLinkAbout08/05/70 August 5~ 1970 The regular meeting of the City Council of the City of Bremerton was held in the Council Chambers of the City ila11 at 10:00 A.M., D.S.T., Wednesday, August 5, 1970. Attending were: Mayor Jarstad (presiding), Conmissioner Clark, Corm~issioner Schoneman, City Clerk Yeadon, Asst. City Attorney Sexton, Fire Chief Holtine, Planning Aide Hofmann, City Engineer Parker, Mr. Ed Adams, Rev. Darrell Bellville of Sylvan Way Baptist Church, and representatives of the Press and Radio. ~Meting was called to order at 10:00 A.M., D.S.T. by Mayor Jarstad, opened with the Pledge of Allegiance, and the Invocation was given by Mr. Bellville. Minutes of the previous meeting were read and approved as amended. I~aNSKI N REZONE City Clerk announced this was the time and place set for a hearing on the rezone. ~otion by Commissioner Schoneman and Conmissioner Clark to open the hearing, carried unanimously. ~fi~lerk read Letter from the Planning Director dated July 21, 1970, recommending the Planning Co,~nission terminate the action on Zampella and Ryan properties; also read Planning Commission Resolution No. 191 recv,,u,mnding the rezone be approved; and read rough draft of Land Use Restric- tions. Planning Aide [bfmann briefed the Council on the location of the rezone, its proposed useage, and answered questions regarding the area. Mayor Jarstad opened the discussion first to those in favor of the rezone. Mr. M. E. Danskin, owner of the property, spoke in favor of the rezone application, stating the property did not lend itself well to Residential; that it was set apart from the Residential property by adjoining roads; that it had always been considered Commercial by the County and he was being taxed for its value as Commercial property; that he had submitted a plan and proposed contract to fit its use into the area the best way possible. He added that the improvement would increase the revenue to the City. The Mayor then invited those opposed to the rezone to speak. Mrs. Itoward ~hitney, Mr. E. P/. Costello and Mrs. G. N. Petrack spoke, addressing themselves principally to the following points: Their privacy would be lost if a building were placed on the property that is higher than their 'property; that it would bring in excess traffic; that it would raise their taxes if it increased their property value; that it would allow highway noises to increase if the tree-screening were removed; that possible stormdraln water would increase on their property; and that the property should remain Residential. Commissioner Schoneman referred to the fact that the property had been used mainly for Commer~ cial for many years; that the storm water and sewage could be handled, and would be handled, to nearby lines located east of the property; that traffic would be controlled, and that he could see no other use for the property. Mrs. Petrack was concerned that the property had access to the beach, but Mr. Danskin assured her that the access had been given to Mr. Shank some years ago. Discussion followed on the proposed use of the property and some of the terms set forth in the proposed contract, especially concerning the wording on "Professional Building" and "Employee- related" buildings. Mrs. Petrack was most concerned about the latter point; however, Mr. Clark explained that this latter point should not be removed from the context of the terms of the contract. The City Clerk commented: that he lived in the back of the present building and the noise level from the highway nearby was driving him from the residence and that the property was not suitable for Residential. Mrs. Whitney took exception to the City Clerk's right to speak-- which right was defended by the Mayor. C~u~dssioner Clark pointed out that the area was not considered as "spot zoning" because it was very close to another area that is already Commercial; and that the Comprehensive Plan indicated the area would eventually be Commercial--therefore it was not "spot zoning." Considerable discussion took place by the opposing residents before a motion was made. ~otion by Conmissioner Clark and Mayor Jarstad to approve the rezone. Under discussion, Commiss- ioner Schoneman stated he felt this would be the best possible use for this property and the new sewer system would take care of all drainage problems; that this rezone would prey ent any further encroachment on the properties on the waterfront as the residents would retain their same road access, and the whole installation would be an excellent buffer against noise. bbtion carried unanimously.
