HEARINGS
MENTOR REZONE., ROSS-KLETKE
Motion by Mayor Jaratad, ascended by Commissioner Schoneman, to open hearings carried unanimously.
City Clerk stated the notice of public hearing had been published in the newspaper.
Mayor Jarstad asked City Clerk to read the relating correspondence ragarding Mentor Rezone.
The following correspondence was read: Letter from the Planning Com~issioner dated June 22, 1970,
denying the application; letter from Mentor Construction Co. dated June 19, 1970, appealing the
denial; and a letter from Dorothy Justesen, 833 Pacific Avenue, Bremerton, Washington, dated
July 15, 1970 opposing the application for rezone as well as a petition from two residents who
were unable to attend the meeting--opposing the rezone. Mr. Jarstad asked the City Planner to brief
the Council on the rezone and its location, etc., and stated he felt the letter from the Planning
Commission did not state clearly enough why the rezone was denied by the Commission. Mayor then
opened the floor to anyone wishing to speak for the rezone.
Frank Shier, attorney for Mr. Mentor, spoke for the rezone on behalf of Mr. Mentor. Mr. Shier
stated he felt the rezone was progress and that he could understand the concern of the residents
involved in losing their yards, etc; however, that the society we live in today demands that we
sacrafice some of these things in order to live--and progress. The following spoke, in turn,
against the rezone: Mrs. Allen Thorn, 903 Pacific; William Patterson, 516 9th Street; Rea Ross,
Mr. Rhodes, 909 Pacific; Dorothy Justensen, 833 Pacific; also Mrs. Motiguits of Cogean.Street.
Commissioner Clark stated he felt this discussion had tendencies of a personal judgment, rather
than the issue at hand and therefore felt, in the interest of the City, the Comprehensive Plan, and
progress, the rezone should be granted--and so moved.
Motion by Commissioner Clark to approve the rezone.
Under discussion, Commissioner Schoneman stated he did not feel he could second the motion as there
were several allegations mede at this time that should be checked and answers given--or whatever
the outcome demands. Mayor Jarstad concurred with Commissioner Schoneman on this point. Not carried.
Motion by Mayor Jarstad and Com~issioner Schoneman to delay action on this matter until the allega-
tions had been checked into and a report given to the Council as to their validity; and to give
an opportunity to Mr. Mentor, Mrs. Thorn and possibly Assistant City Attorney Sexton, to defend
themselves in a meeting conducted as this one to obtain answers.
Under discussion, the Commissioners stated they felt this was the best possible answer at this time.
Motion carried unanimously.
BID OPENING FOR FIVE TREATED POLES FOR PARK DEPT.~ ASPHALTt CONCRETE AND RENTAL OF EqUIPMENT~ and
a POLICE AUTOMOBILE. City Clerk announced it was time for hid opening; that none had been
received on the poles; and that, as dealers wera unable to obtain a Police car at this late
date in the production year, there were no bids on the Police car; but that there was one bid
received on the asphalt and concrete paving material.
Motion by Commissioner Schoneman and Commissioner Clark to open the bid, carried unanimously.
City Clerk read the following bid for Asphalt and Concrete paving materials:
North Kitsap Gravel & Asphalt Co., Poulsbo(Bid Bond enclosed)
Estimated total $78,645.00, on materials.
Motion by Commissioner Schoneman and Commissioner Clark to accept bid and award it to North Kitsap
Gravel & Asphalt Co. Under discussion, City Engineer stated the bid was lower than the expected
estimate and many of the prices remained the same as last year. Commissioner Schoneman stated
the award was a good one as this company has been very good in every respect to the City in the
past and has always furnished all materials needed whenever the City needed them. Representative
of the North Kitsap Gravel & Asphalt Co. thankad the Council and Commissioner Schoneman for the
award of the contract and the kind words.
Motion carried unanimously.
ROSS-KLETKE REZONE. Mayor Jarstad asked City Clerk to read the relating correspondence, and the
following were read:
Letter from the Planning Commission dated June 22, 1970, stating a letter of appeal was
was attached for the denial of the rezone.
The appeal letter dated June 18, 1970 from Rea Ross.
Minutes of the Planning Commission meeting of June 17, 1970
A petition of 18 names opposing the rezone.
A petition of 64 names opposing the rezone, subject to some changes.
City Clerk announced the Public Hearing had been published.
Mayor Jarstad asked Mr. Plescher to brief the Council on the area involved and the conditions of
the rezone.
Messrs. Ross, Lyle, Micklea, Brady, Ward, and Mrs. Bergma and Mrs. Fillian spoke against the rezone.
Commissioner Schoneman stated he felt the rezone was not desirabla under the present request; but
that if Mr. Ross were willing to rezone the first 300 feet as B-3 and the second 300 feet R-2,
ha would be more inclined to favor the rezone; however, this cannot be done without a contract,
which Mr. Ross stated he was not in favor of signing--so he would have to refile after the waiting
period of one year, or 365 days, from the date of filing.
Motion by Commissioner Schoneman and Mayor Jaretad to deny the rezone.
Under discussion, Mr. Clark stated he did not like the way this was going because it left such a
long period of time before Mr. Ross could refile, even with the changes made. Mayor Jarstad
stated at this time that there was no alternative, as the recent Court decision ruled against
changing an application from its original form. Colissioner Clark raised the question whether
there might be a delay in this action and then an amending ordinance to give Council power to
direct applications back to the P.C. Commissioner Schonemen replied that this would still fall
under the old ordinance as it was filed under same--and called for a vote on his motion.
The Vote: Mayor Jarstad--Yes; Commissioner Clark--No; Commissioner Schoneman--Yes: Motion carried.
Commissioner Clark stated the amending Ordinance was still a necessity for the future.
