Mayor Jarstad stated this !iprocedure is against his feelings as the land is donated free of cost and the vacated land should be ~returned free of cost. Commissioner Clark stated he felt this procedure would increase the chances iof the owners requesting a price for their property rather than donating as in the past. City Planne~ !Plescher illustrated with the use of maps the location of the vacation for right-of-way. Mt. Frohard stated in connection with the vacation on 4th & 5th Street his company would be glad to go along with !what ever procedure the Council took and they would pay 1/2 of the appraised value if necessary for !itheir vacated alley. !iMotion by Commiss~oner Clark and Commissioner Schoneman to approve the vacation eliminating the claus~ i subject to 1/2 payment of the appraised value of the land." and to instruct the City Attorney to prepare the necessary instrument; under discussion, Mr. Mentor thanked the Council for their coopera- iltion in granting this vacation and also stated he was glad to pay the money if instructed to do so by ~the Council; however, he felt it is not a good practice and cited the example of the alley vacated for ~Penney's and without the vacation the complex would not have been built and no amount of money could benefit the City as much as the new Penney's complex.
