Mr. Yeadon stated there were three (3) properties involved in this rezone originally; however, Mr. Zampella withdrew from the application. Mayor 3arstad asked City Planner Plescher to speak on the rezone. Mr. Plesche stated the property being considered today is the Danskin property as Mr. Ryan never appeared either for or against the rezone and it is policy of the Planning Com~ission to drop or not take action on any application that a party does not appear in representation for. There were several questions on this procedure and Mr. Walgren stated in his opinion this could lead to legal action and ruling of spot zoning if only Mr. Danskin's application were granted. Discussion ensued. Commissioner Clark stated the planning Co~mmission's Resolution No. 191 not only has Mr. Ryan's property included on it but Mr. Zampella's also. Mr. Clark a~o stated that he felt it would be improper for the Council to take action on this rezone or Resolution with question of Mr. Ryan's perperty being included, on whether this would be considered spot zoning, and the erroneous description on the Resolution. Mr. Plescher stated he was not aware the legal descriptions had not been changed and would see that it was taken care of and also that Mr. Ryan be notified to find out if he wished his property included in the rezone or not. Mrs. Yuhl stated She felt if Mr. Ryan's property was included there would be residents in the area protesting the rezone. Mrs. Whitney stated she was not thoroughtly satisfied with some of the conditions of the rezone and wished some answers regarding the buffer zone, property lines, etc. Mayor Jarstad concurred with Mr. Clark's remarks and stated the rezone would not be in proper procedure to grant at this time.
