Mr. Yeadon stated that the Western Farmers Association was high bidder so this lette
had no bearing on the bid or its award.
City Clerk Yeadon stated the lowest bidder was Agricultural Dealers Supply on all

rates and zones. Mayor Jarstad opened the floor for discussion; Mr. Lawrence Sor-
iano, Attorney at Law, representing Walker spoke. ~r. Soriano comment on several
points; Mr. Walker meets all requirements in the present ordinance; experienced
drivers; good moral character and standing; feel ther~is a need for more non-metered
cabs on the streets, there are 17 metered cabs and only two non-metered cabs running
in the City; only one of the three companies that fill a~l the requirements set up
by the ordinance. N~. Soriano also stated there is a monopoly of cabs on the streets
and people should have choice of what cab or cab company he wants to deal with. Mr.
Soriano stated as long as all the requirements set down by the ordinance are met
there is no basis for the Council turning down the application. Commissioner Clark
inquired whether Mr. Soriano felt that the Council was not necessary in maintaining
any decision on this particular issue. Mr. Soriano said it is the Chief of Police's
duty to check out the application according to the Ordinance and if all is well the
license can be issued. Mayor Jarstad inquired as to the basis for Mr. Soriano's
client ruuning his taxi inside the City limits before receiving a license. Mr.
Soriano stated when he read the ordinance there was nothing stipulating or prevent-
lng a person from ~unning his cab from outside the City limits when he received a
call from within the City limits and picking them up and delivering them where they.
requested to go. Mr. Soriano also stated his client stopped running his cab when he
heard from the Police Department that they did not like him doing it in order to
comply with the City's requests even when there is nothing preventing him from doing
so. Commissioner Clark asked Mr. Soriano to cite the instances the other cab com-
panies are breaking the requirements of the ordinance. Mr. Soriano cited them at
a later time in the meeting as follows: colors should be uniform under one owner;
companies owned by one man should all obtain the same name; etc.
Motion by Commissioner Schoneman and Commissioner Clark to take this matter under
advisement from the City Attorney; under discussion, Mr. Soriano stated he felt this
was Just a postppnement on behalf of the Council to try to avoid granting the appli-~
cation and his client would not let it drop even if it meant going to court. Com-

late in coming because the decision had already been made and at the time of bid

hearing. Mayor Jarstad then opened the floor for discussion from anyone either for
or against the rezone. Mr. ~. E. Morgan, 1328 Ivy Road spoke against the resone.
Mr. Morgan stated that Ivy Road is a very nice residential area and all the propertl
owners in this area objected to apartments being set in the middle of the residenti.
area. Mr. Haskin, also a resident of Ivy Road, spo~e against the rezone.
~!Robert Moriarity, Representative of the Conifer Company, spoke for the rezone. Mr.
Moriarity stated these apartments would be for small families and the land was use-
iless without access to the back lot. Mr. Moriarity stated he felt this was the best
use of this land and the project would fit in very well with the surrounding resident-
iital area. A lengthy discussion ensued. Commissioner Schoneman stated he was not in
flavor of the rezone as he had put himself into the place of the property owners that
now live there and he would not like something like this project being added if he
'had settled in an area that was believed to be purely residential. Mr. Schoneman alL
so stated the project was a good one but perhaps there could be another area that it
could be built and then the people moving in that area would know that it was going
to be there before they settled near it. Commissioner Clark stated he has mixed
feelings about the matter as he could not forget how much time had been put in by the
Planning Commission and that they ruled in favor of it; however, he did see the point
of view of the residents~in that area also but he believed that there could be some
type of a set back that could accommodate both parties. Mr. Moriarity then requested
permission to make a suggestion as a representative of the Conifer Company. Mr.
Moriarity suggested a contract be prepared with the provision for a 100 foot setback
that could be landscaped to fit in with the surroundings eliminating all structures
on this land. The Council felt this an ideal answer to the problem. Mr. Morgan
stated he felt this would be quite satisfactory.
Motion by Commissioner Clark and Commissioner Schoneman to instruct the City Attorney
to prepare an Ordinance stating this provision, under discussion, Commissioner Scho-
haman inquired if the provision for no buildings being built on the 100 foot setback
would be a convenant for any and all future owner's of this property. Commissioner
Clark replied affirmative. Motion carried unanimously. M~. Morgan thanked the
Council and Mr. Moriarity for their cooperation in this matter.
